Present for the meeting were Mr. Tim Eubanks, Mr. Eddie Ray Bryan, Mr. Ronnie Hatton and Mr. Richard Kelly. Mrs. Louise Johnson, Mrs. Dorothy Brown and Mr. Jesse Young were absent from the meeting. President Eddie Ray Bryan called the meeting to order, Chaplain Richard Kelly led in prayer and President Bryan led in the Pledge of Allegiance. MOTION TO APPROVE MINUTES FROM SEPTEMBER 4 AND 25, 2012 MEETINGS ORDINANCE # 2012-10-0002 BE IT ORDAINED, ETC., that the Franklin Parish School Board approve minutes from September 4 and 25, 2012 meetings. MOTION: Mr. Tim Eubanks SECOND: Mr. Richard Kelly The motion was approved. RECOGNITION OF VISITORS - AGRICULTURE EXTENSION OFFICE SPEAKER Mrs. Carol P. Allison gave an update on the projects and activities of the Agriculture Extension Office. A lot of changes have occurred in the Ag. Extension Office. Board Members were given a quarterly report. Ms. Allison has all of the 4-H Club meetings signed up for the year. HEAD START REPORT – PAM MCBROOM Mrs. McBroom gave the Board an update on the activities of the Head Start Program. She has not received word when monitors will be in parish. Head Start is up to date on all screenings. Head Start is using DSC for state assessment. She has 91% average attendance. Board Members received July and August financial reports. MOTION TO CONSIDER AND/OR TAKE ACTION CONCERNING SICK LEAVE BANK POLICY ORDINANCE # 2012-10-0003 BE IT ORDAINED, ETC., that the Franklin Parish School Board approve the Sick Leave Bank Policy. SICK LEAVE BANK The Franklin Parish School Board recognizes that major illnesses and catastrophic injuries may warrant the need for additional sick leave by an employee. The Board shall create and maintain a Sick Leave Bank which provides an opportunity for employees to donate sick leave days, which in turn may be used by employees in emergency situations when their own sick leave days have been exhausted. Donations of sick leave days shall be made to the Sick Leave Bank and not directly to individual employees, shall be made by notarized Acts of Donation, and shall be made in accordance with other provisions of this policy. Once executed, any donation made shall be irrevocable. Receipt of sick leave days from the Sick Leave Bank shall be based on a written application submitted by an employee to the Superintendent and/or his/her designee. Assessment and any decisions regarding the granting of days from the Sick Leave Bank shall be the responsibility of the Superintendent. His/her decisions shall be final, and such decisions shall not be subject to review by the School Board or subject to the Board’s grievance procedures. Administration of Sick Leave Bank Donations of sick leave days shall be made directly to the Sick Leave Bank. Three (3) separate accounts shall be established within the Sick Leave Bank: one for teachers, one for bus operators, and one for school employees. Donations to the Sick Leave Bank shall be credited to the appropriate account depending on the classification of the donor. Applications for receipt of donated sick leave days from the Sick Leave Bank shall be in writing and include a statement from a licensed physician certifying a medical necessity for the employee to be absent from work. The application shall be submitted at least twenty (20) work days prior to the anticipated beginning date of leave. In cases of extenuating circumstances, the Superintendent may waive or alter the application deadline. Upon review of the applications, if questions about the validity or accuracy of the certification arise, the Superintendent may require additional medical certification as outlined under Extended Sick Leave in policy GBRIB, Sick Leave. Medical necessity shall be the result of a catastrophic illness or injury, which means a life-threatening, chronic, or incapacitating condition of the employee or a member of his/her immediate family. Immediate family member shall mean a spouse, parent, or child of the employee. All records generated in the administration of the Sick Leave Bank, as well as the confidentiality of applicable records, shall be properly maintained by the Superintendent and staff in accordance with statutory provisions. Donor Eligibility 1. Employees who wish to donate accrued sick leave days shall have been actively employed by the School Board for a period of thirty-six (36) consecutive months as of the date of the intended donation. 2. Only employees with a balance of more than fifty (50) sick leave days as of the date of the intended donation shall be permitted to donate to the Sick Leave Bank. No donation shall be permitted which causes the donor’s sick leave balance to fall below fifty (50) days. A maximum of ten (10) days may be donated in a fiscal year. An individual may make only one (1) donation in a fiscal year. 3. Employees wishing to donate sick leave shall complete the appropriate Act of Donation Form. The donation shall irrevocably relinquish all future claims and rights to such donated sick leave. The days donated shall be permanently deducted from the total number of accumulated sick leave days the employee has on the date the donation is approved. 4. All donations shall be strictly voluntary. 5. No transfer shall become valid until all forms, verifications and signatures have been completed and signed by the Superintendent. 6. All donations shall be in units of whole days. Recipient Eligibility 1. Recipients shall be actively employed by the School Board at the time that medical necessity is determined. 2. Recipients shall have been employed by the School Board for at least thirty-six (36) consecutive months as of the date of the intended usage. 3. Employees who are recipients shall have exhausted all current and accumulated sick leave and have used all days of extended sick leave and any other applicable leave to which the employee may be entitled. In addition, those employees who receive annual leave shall have exhausted all annual leave time before becoming eligible to receive sick leave days from the Sick Leave Bank. 4. The maximum number of sick leave days that may be granted to a recipient at one time shall be twenty (20) work days. 5. Of those days granted, any remaining unused at the end of the fiscal year shall be returned to the Sick Leave Bank. 6. A separate application shall be submitted for each occasion that an employee may request receipt of sick leave days from the Sick Leave Bank. Each application shall include necessary documentation attesting to medical necessity. The physician’s certification must address circumstances relative to each separate request. The separate application requirement may be waived by the Superintendent as circumstances may warrant. 7. Donated sick leave shall not be used on an intermittent daily basis. Miscellaneous Provisions 1. The Superintendent shall be authorized to make determinations and clarifications of these provisions. All determinations and clarifications made by the Superintendent shall be final. 2. All transactions shall become part of the permanent personnel files of the employees. Act of Donation Forms shall be placed in donor personnel files depicting the actual number of days deducted from accrued sick leave days on file after the donation is made. 3. The number of days withdrawn from the Sick Leave Bank shall not exceed the number of days available within the appropriate account of the Bank. Ref: La. Rev. Stat. MOTION TO CONSIDER AND/OR TAKE ACTION CONCERNING REDUCTION OF PERSONNEL POLICY ORDINANCE # 2012-10-0004 BE IT ORDAINED, ETC., that the Franklin Parish School Board approve the Reduction of Personnel Policy (RIF) as updated by the State Department of Education. REDUCTION OF PERSONNEL It shall be the policy of the Franklin Parish School Board to maintain a fair and balanced educational program consistent with the functions and responsibilities of public schools. When faced with circumstances which may necessitate a reduction of personnel greater than can be accomplished through attrition and appropriate reassignment, a reduction of personnel action may be employed. All feasible alternatives to the layoffs of employees shall be considered prior to the implementation of the provisions stated herein. The determination for the need to implement reduction of personnel procedures and all decisions effecting such action shall be made by the Superintendent. Except as otherwise provided herein, any existing procedure for reconsidering or examining an employee discharge, non-reappointment, or grievance shall not be considered in implementing a reduction of personnel action. Similarly, no personnel action other than a reduction of personnel may be considered under this policy. Employees on Board approved leaves of absence shall be treated in the same manner as other regularly employed personnel insofar as application of this policy. TEACHERS AND ADMINISTRATORS Reduction of teachers and administrators shall be based solely upon demand, performance, and effectiveness, as determined by the performance evaluation program adopted by the Board in accordance with La. Rev. Stat. Ann. §§17:3881 through 3905. Any reduction of teachers and administrators by the Superintendent shall be instituted by dismissing the least effective teacher within each targeted subject area or area of certification first, and then proceeding by effectiveness rating until the reduction of personnel has been accomplished. ALL OTHER EMPLOYEES Reduction of school employees, including bus drivers, who are not evaluated pursuant to La. Rev. Stat. Ann. §§17:3881 through 3905, shall be based upon the following criteria: 1. Performance and effectiveness as determined by the Board’s personnel evaluation plan. 2. Certification or academic preparation, if applicable. NOTICE TO INDIVIDUAL EMPLOYEE When a reduction of personnel action is instituted, written notice of termination shall be given by the Superintendent or his/her designee by certified mail, return receipt requested, to the employee to be terminated. The notice shall include a statement of the general conditions requiring a reduction of personnel. The employee’s address, as it appears on the School Board’s record, shall be deemed to be the correct address. It shall be the employee’s responsibility to see that the School Board has his/her current address on file. REVIEW OF INDIVIDUAL TERMINATIONS Within ten (10) days after receiving a notice of termination, an employee may request, in writing, a review of the action taken and shall receive notice of the results of the review in a timely manner, but no later than ten (10) days after the notice to review is received. The employee shall have the right to pursue a reduction action through the Board’s grievance procedures. SEVERABILITY OF PROVISIONS If any provision of this policy or the application thereof is held invalid, such invalidity shall not affect other provisions of this policy which can be implemented without the invalid provisions and, to this end, the provisions of this policy are hereby declared severable. Any and all provisions of this policy shall yield to existing state law, whether statutory or not, when held to be in conflict with said law or laws. Ref: La. Rev. Stat. MOTION: Mr. Richard Kelly SECOND: Mr. Ronnie Hatton The motion was approved. SUPERINTENDENT’S REPORT Dr. Lanny Johnson reported on the RIF policy. The SDE is getting into putting input of policies that the Board passes. If the RIF policy and other are not up to what the SDE wants, they will publish your name in the paper. Franklin Parish has never used the RIF policy under Dr. Johnson. We have always used retirement and resignations to take care of personnel matters. The direction the state is going and our funding we may need the RIF policy. This year we are losing $328,000 in our MFP. Other systems will lose more depending in size. To put this in context it is 6 teacher positions. We are teetering on going on a deficit situation with the funds coming into the parish. It looks like the State is trying to do the public schools in. More vouchers and charter schools will open. We have lost 41 students to vouchers. Franklin Parish has gain some students back from private schools. Mr. Kelly asked that the State takes over a school, can a private contract firm take that school over? Dr. Johnson reported that they can or the Recovery School District may take that school over. When the school is taken over, by law, they can fire the principal and whole staff. Mr. Kelly asked what happens next if the RSD does not provide an improvement to the school? Dr. Johnson said he did not know. In the New Orleans area they have hired a lot of Teacher for America teachers. These teachers have not always worked out. Education reform should be for all the children. What the Legislature is doing is not for all the children. It is reform for a select few. In New Orleans 2500 students took advantage of the voucher system. When we get a new governor this all may change. Ms. Angela Miller, LAE representative spoke at this time. BESE seems to think they need to approve everything now. It is not written anywhere that they can supersede in the power you have as a School Board. The LAE has some limited language that she could share with the Board. Most parishes are using the Forethought version of the RIF policy. Right now public schools are under attach and so is the School Board under this new law, Act 1. She has information to share with the Board on the value added and effectiveness and ineffectiveness of a teacher. President Bryan asked if the striking of the teacher union in Chicago accomplished anything? Ms. Miller said if did on some points. Some of the basic education needs were accomplished. PRESIDENT’S REPORT President Bryan spoke on the situation that happened at the High School. We have about 2 weeks before students will be returning to school. Eddie Ray Bryan, President Franklin Parish School Board Franklin Parish School Board 12-5 1tb mmm Winnsboro, Louisiana October 30, 2012 The Franklin Parish School Board met for its regular scheduled meeting on Tuesday, October 30, 2012 at 5:00 p.m. in the Franklin Parish School Board Complex conference room. Present for the meeting were Mr. Tim Eubanks, Mrs. Dorothy Brown, Mr. Eddie Ray Bryan, Mr. Ronnie Hatton, Mr. Jesse Young and Mr. Richard Kelly. Mrs. Louise Johnson was absent from the meeting. President Eddie Ray Bryan called the meeting to order, Chaplain Richard Kelly led in prayer and President Bryan led in the Pledge of Allegiance. Mr. Richard Kelly called the maintenance committee to order. Dr. Johnson reported that most of the work has been on a/c units and pumps going out before the cold weather. We have had several school bus drivers to retire, so Mr. Clark will have to train some bus drivers. Right now we have a shortage of bus drivers. Dr. Johnson reported that we have several projects in the parish that need to be done. We have a little money left over from our building tax. I have talked with Ms. Whitten and I would like to give each school a $10,000.00 account for the school to do a capital outlay project. We are not giving the money directly to the schools. They will do the work and invoice the school board. Dr. Johnson and Mr. Doug Clark will approve individual projects for each school. Dr. Johnson would like to add this item to the agenda for Boards members to approve giving this money to the schools. This money can only be used for capital outlay and not for salaries. We cannot use this money to booster the general fund. Mr. Kelly adjourned the maintenance committee. Mrs. Dorothy Brown called the finance committee to order at 5:20 p.m. Mrs. Whitten presented the budget revision to the Board. We are showing a $543,000.00 deficit. This the amount of money going to the Charter School. The State shows we are getting the money, but in actually we never get this money. This money is taken away from us in the MFP dollars. The state subjects this from our MFP before it is sent to us. We have 41 voucher students attending FCCS and Charter School. Dr. Johnson explained to the Board how the State withholds this amount of money from the MFP. We are up about 10 to 15 students up enrollment wise. We will get another adjustment in February in our MFP. The MFP money follows the student. The lawsuit that the school boards had against the state, a judge in Baton Rouge struck it down. Tangipahoa has filed another lawsuit against the state in federal court. Mr. Young asked for a total amount of monies given from MFP for last year. This is the first time this year the State is removing the MFP monies from the parish school board allotment. On the student count taken from the JPams it is showing the 41 students going to state scholarship. Mrs. Whitten presented the new salary schedule for 2013-2014 to the Board. The State is not interested in seeing degree level or years’ experience. The State is moving toward merit pay. The step increase is being based on effectiveness, work experience and/or demand. Once the money is put into the salary, salary cannot be decreased. An ineffective teacher will not get a pay increase. We are not sure is the state will approve this salary schedule, but it has to be sent in to the State. Our teachers have been writing SLT’s (student learning targets). The principals have to write SLT’s now. The State Superintendent John White said that certified teachers are not necessary. With no further business to discuss, Mrs. Dorothy Brown adjourned the finance committee. Dr. Johnson reported that schools will be closed on November 6 for Election Day. The board members must have 6 hours of board training. We need to come up with a date for this training. We may need to do this training in two sessions. Board members must also do a 1hour ethics training. Board members were given a copy of test scores for each school. Franklin Parish High School came up 17 points. All schools with the exception of Winnsboro Elementary gain points. Dr. Johnson is very proud of all schools.
