Mr. Richard Kelly left at 5:55 p.m. MOTION TO CONSIDER AND/OR TAKE ACTION ON ARRA POLICY ORDINANCE # 2012-06-0009 BE IT ORDAINED, ETC., that the Franklin Parish School Board approve the new ARRA Policy as presented. AMERICAN RECOVERY AND REINVESTMENT REPORTING REQUIREMENTS The Franklin Parish School Board shall adhere to federal and state guidelines in the receipt of report/s on the use of funds received through the federal American Recovery and Reinvestment Act of 2009 (ARRA). These guidelines require the School Board, as sub-recipient of Recovery Act funds, to submit quarterly reports through EGMS on the use of such funds to the Louisiana Department of Education (LDE) no later than the 15th day following the end of each quarter. ARRA funding for may include Title I, Title I School Improvement, Title II – EETT-TIG, Title II Connect Tech, Title II High Tech, IDEA Part B, IDEA Preschool, Homeless, and Education Jobs. Reporting information should include: the recovery funds received, funds expended or obligated per program; a list of activities for which recovery funds were expended or obligated, including the name of the project or activity; a description of such, an evaluation of the completion status of the project or activity and an estimate of the number of jobs created or retained by the project. Information on any vendor information required by the e-grant program as set by the LDE. A Full time equivalents spreadsheet is prepared quarterly on the time worked by any positions funded by each project. This spreadsheet is provided by the LDE and completed and submitted with the e-grant (EGMS) Periodic Expense Report. The school board is required to register and maintain current registration with the Central Contractor Registration database for the US Federal Government, as well as obtain a valid and current Dun and Bradstreet D-U-N-S number. MOTION TO CONSIDER/OR TAKE ACTION ON DEBIT CARD POLICY ORDINANCE # 2012-06-0010 BE IT ORDAINED, ETC., that the Franklin Parish School Board approve the new Debit Card Policy as presented. DEBIT CARDS The use of Debit Cards for all Franklin Parish School Board bank accounts as well as all school activity accounts is disallowed unless authorized by Superintendent. MOTION TO CONSIDER AND/OR TAKE ACTION ON CREDIT CARD USAGE POLICY Credit Card Usage Credit cards are a precious commodity which can enhance to purchasing power of the Franklin Parish School Board, when used wisely. The Franklin Parish School Board has the following lines of credit available with credit cards: Wal-Mart, Home Depot, Staples, Office Depot, SAM’s, and American Express The first five cards may only be used in conjunction with an approved purchase order. A purchase order is to be generated before a card for Wal-Mart, Home Depot, Staples, Office Depot or SAM’s is used. Each purchase order must be logged with the Administrative Assistant or designated other, before a card can be released for use. Once the purchase is made, both card and original receipt must be turned back to the Administrative Assistant, school bookkeeper or designated other and the card signed back in. If this is not done, any purchases made may be the responsibility of the person who signed out the card. The American Express card may be used to reserve and pay for lodging during conferences. A purchase order with the confirmation number for lodging should be processed after reservations are confirmed. Receipts for lodging or other must be turned in upon return from a conference. Any charges made other than for what has been authorized by purchase order are the responsibility of the person making the charge. The purchase of gift cards with credit cards is strictly prohibited. The use of gift cards for purchases for FPSB and schools is also prohibited. This is an existing policy and will need to lay over thirty (30) days for review. MOTION TO CONSIDER AND/OR TAKE ACTION ON PROPERTY, GENEAL LIABILITY, LEGAL LIABILITY AND CRIME INSURANCE PREMIUM ORDINANCE # 2012-06-0011 BE IT ORDAINED, ETC., that the Franklin Parish School Board approve the Property, General Liability, Legal Liability and Crime insurance premium. The total premium for this coverage is $140,941.00. This is an increase of $16,238.00. MOTION:Mr. Tim Eubanks SECOND: Mr. Jesse Young The motion was approved. SUPERINTENDENT’S REPORT Dr. Lanny Johnson reported on House Bill on extended sick leave and sabbatical leave. In the language of the Bill the School Board may grant sabbatical and extended sick leave for catastrophic illness or injury. This Bill lowers the number of days and monies for extended sick leave and sabbatical leave. This lowers extended sick leave from 90 days to 45 days. Sabbatical leave personnel could draw 65% of salary this bill lowers that amount to 50% of teacher’s salary. This bill only applies in years when school board does not receive the 2.75 increase to MFP. Some parishes have eliminated all sabbatical leaves. The Governor will need to sign this House Bill before it is effective. At some point we will need to decide are we going to consider granting sabbaticals or having extending sick leave and if we do it will be for catastrophic illness or injury. We do not have to grant extended sick leave. The law supersedes any school board policy. PRESIDENT’S REPORT Mr. Eddie Bryan reported on a couple of items. An insurance company that visits schools that is for disability insurance is not paying claims. The Sheriff is interested in the campus at Wisner Early Childhood Center. Adjourn President Eddie Ray Bryan gave the floor to Mrs. Dorothy Brown. Mrs. Brown is a member of the Louisiana School Board Association board. A letter from the Louisiana School Boards Association and a copy of Resolution was given to each Board Member. This resolution is being filed seeking to have Act 2 and SCR 99 (MFP) of the 2012 Regular Session of the Louisiana Legislature declared unconstitutional and/or a violation of state law. Attorney Robert Hammonds of Hammonds & Sills Law Firm will prepare the suit and is recommending that district school boards pass the resolution to come on board with the lawsuit. The cost of this lawsuit will be on a pro rata basis if such litigation if filed in conjunction with other public school boards of the State. This Act 2 is the voucher bill concerning the separation of church and state. Board members and Superintendent discussed the resolution and lawsuit at length. Superintendent Johnson will be getting more information concerning how many districts will be passing this resolution and the possible cost to the Franklin Parish School Board. No action was taken on the Class Action lawsuit. Superintendent Johnson made a few announcements before adjournment. The 13th check will be distributed to Principals on Wednesday, June 20th to be handed out to teachers and support personnel at their respective schools. All Principals are to be trained on July 25 & 26 at the High School. This training is for the Value-Added Personnel evaluation. Also at the same time we will have Kindergarten and 1st grade teachers at the school board office during a 3-day in-service on Common Core Curriculum. All teachers in the parish will need to get this training on Common Core Curriculum throughout the upcoming year. Every teacher will have to be evaluated this year on the value-added evaluation. Dr. Johnson reported he had the value-added state scores on all the teachers that are in tested subjects. Dr. Johnson reported that we are going back with incentive pay for teachers. A couple of years ago we led the state in growth that was the year we gave incentive pay to teachers. We are going to take some of our Title 1 & 2 money to do this. We will offer teachers $1,000.00 if 80% of their students make 60 or above. The End of Course test will be used for the high school teachers. There is a cap of $4,000.00 per teacher. Dr. Johnson said we are downsizing H. G. White Learning Center in a program. He will keep the principal and 3 teachers at HGW. One teacher will be a GED teacher. The other teachers from HGW will be sent to other schools in the parish. The other 2 teachers at HGW will be presenting the EAGLE program to students that are sent there for discipline reasons. HGW has been on the unacceptable status for 2 years and one more year the State come in and take over. A new law is in effect that if 50% of parents of a school vote to go into the Recover School District the RSC will take over. Mrs. Brown asked about support personnel getting less money in the 13th check this year. The amount given is $86.00 less than last year. Eddie Ray Bryan, President Franklin Parish School Board Franklin Parish School Board 7-25 1tb mmm Winnsboro, Louisiana June 26, 2012 The Franklin Parish School Board met for its regular scheduled agenda meeting on Tuesday May 29, 2012 at 5:00 p.m. The maintenance committee met at 5:00 p.m. with the finance committee and agenda meeting to follow consecutively. Present for the meeting were Mrs. Dorothy Brown, Mr. Eddie Ray Bryan, Mr. Ronnie Hatton and Mr. Jesse Young. Mrs. Louise Johnson, Mr. Tim Eubanks and Mr. Richard Kelly were absent from the meeting. President Eddie Ray Bryan called the meeting to order, Mrs. Dorothy Brown led in prayer and President Bryan led in the Pledge of Allegiance. Maintenance committee was called to order by Mr. Jesse Young. Mr. Doug Clark, Maintenance/Transportation Manager reported the biggest problem is plumbing. The sewer system at Baskin is the main problem. Baskin needs a complete re-haul on its system. Crowville’s new sewer system was built under trees. These trees have been cut down and this should fix that problem. Fort Necessity was having sewer pump trouble. We had a pump in the warehouse and that has been fixed. The high school is have trouble also, the clay pipes under the floor behind the cafeteria are broken. This can be a major problem. Floor may need to be busted up to replace these clay pipes. Mr. Clark has a report of eight (8) a/c units down in the parish. The main problem this summer is sewer. Mr. Clark has had inmates and our personnel to re-furbished the dressing rooms at the high school. We are re-doing showers, painting, tile, removed old lockers, making a new storage closets, new lights and new doors. Mr. Clark has contacted someone on checking a price for a speaker system for the high school. The health department has written the parish up for not having anything under the playground equipment. Pea gravel has been approved to be used with playground equipment and some has been put out. Crushed rubber is very costly. The ag. building at Fort needs to be torn down. It is used for storage. Mr. Clark spoke on needing new buses for the next school year. Mr. Jesse Young adjourned the maintenance committee. Finance committee was called to order by Mrs. Dorothy Brown. Mrs. Whitten reported that we will end the year with a surplus. She has been working on the budget for the next fiscal year. According to the information she has received, MFP will increase up to $22,000.00. The EDJU jobs, whose program has ended will go back into the general fund. Retirement will be up for next year. Dr. Johnson spoke on the timber sale on the Bayou Macon tract of land. The Police Jury has a requirement of a road bond to repair the road. Also, we may have to pay Madison Parish School Board for part of the timber. We just need to find a way to get the trucks into the land to get the timber out. Dr. Johnson said he needed to have a meeting with some Police Jury members. Dr. Johnson reported that he was told that a November 6, 2012 election was being held on term limit for school board members. Dr. Johnson reported on Act 788, sick leave, extended sick leave and sabbatical leave. This gives the Superintendent permission to grant the leave. The Act left it at 90 days in a 6 year period with 65% of salary being paid. What changed was that it must be a “medical necessity.” This is the result of a catastrophic illness or injury which means a life-threatening, chronic, or incapacitating condition. Also in the Act, is says as a parish , we must establish a sick leave bank policy to allow for sick leave. We will need to report to the state on the sick leave bank. Extended sick leave a doctor’s statement must be in within 3 days. Dr. Johnson reported that Supervisors have had meetings on the new personnel evaluation last week. We have a new plan, new job descriptions, in-service for principals and in-service for teachers. Every teacher in the parish will need to be evaluated and it take the principal approx.. 2.5 hours on the computer to do one evaluation on one teacher. We will come up with the guidelines and deadlines for the evaluation process. A teaching target will need to be developed. A salary schedule will need to be developed for this before 2013-2014 school year. Step increase will not be automatic. There are 5 steps to making a salary schedule. We will be hiring Forethought Consultants to re-do our Policy Manual. Dr. Johnson reported on the incentive pay for teachers based on their student’s test scores. Charter Schools do not have to do all of these regulations. We have had request from Virtual School student to participate in extra-curricular activities. Mrs. Brown adjourned the finance meeting. Adjourn MOTION TO APPROVE RESOLUTION TO JOIN LAWSUIT ORDINANCE # 2012-06-0017 BE IT ORDAINED, ETC., that the Franklin Parish School Board approve the resolution to join in the lawsuit with the Louisiana School Board Association and other school districts. FRANKLIN PARISH SCHOOL BOARD RESOLUTION WHEREAS, the Louisiana Legislature has passed and Governor Jindal has signed into law Act 2 of the 2012 Regular Session of the Louisiana Legislature; and WHEREAS, Art. 3, Sec. 15 of the Louisiana Constitution requires that all bills in the Legislature have a single object or purpose; and WHEREAS, Act 2 of 2012 is forty-seven (47) pages long and addresses charter schools, school “scholarships”, and other objects or purposes in apparent violation of Art. 3, Sec. 15 of the Louisiana Constitution; and WHEREAS, Art. 8, Sec. 13 of the Louisiana Constitution provides that state funding for public education shall be equitably allocated to the public school systems of the State for the benefit of public education; and WHEREAS, Act 2 of 2012 calls for state funds to be used in support of students in private and parochial schools and calls for such allocations of public funds to be made directly to those non-public schools, all in apparent violation of Art. 8, Sec. 12 of the Louisiana Constitution; and WHEREAS, the First Amendment of the United States Constitution and Art. 1, Sec. 8 of the Louisiana Constitution require the separation of church and state; and WHEREAS, Act 2 of 2012 authorizes the expenditure of state funds in support of programs of education for students and parochial schools in apparent violation of the First Amendment of the United States Constitution and Act. 1, Sec. 8 of the Louisiana Constitution; and WHEREAS, Act 2 of 2012 contains other provisions that are legally and/or constitutionally suspect; and WHEREAS, the only way to get definitive interpretations of Act 2 of 2012 and the constitutionality and/or legality of its provisions is through litigation; NOW, THEREFORE, BE IT DULY RESOLVED, by the Franklin Parish School board in special session duly convened that: Section 1. The Franklin Parish School Board authorizes the institution of litigation in federal and/or state court, either individually or as a member of a group of other public school systems with similar purpose, challenging the constitutionality and/or legality of Act 2 of the 2012 Regular Session of the Louisiana Legislature. Section 2. The School Board also authorizes the payment of all reasonable attorney’s fees and other costs incurred if such litigation is filed only by this School Board or on a pro rata basis if such litigation is filed in conjunction with other public schools board of the State. Section 3. The Superintendent is directed to come back to the Board with a recommendation of legal counsel to handle such litigation on behalf of the Board and to present to the Board at that time for its consideration special counsel resolution employing such attorney for such purpose.
