Unanimously approved. PUBLIC HEARING AND ADOPTION OF ORDINANCE NO. 951: AN ORDINANCE TO ANNEX VACANT LAND WHICH IS CONTIGUOUS TO ITS EXISTING CORPORATE LIMITS FOR GARY STREET VILLAGE, LTD. Motion by Johnson, second by Mahoney to adopt Ordinance No. 951. Unanimously approved. RESOLUTION NO. 12-0301: WHEREAS, NEW HORIZONS DEVELOPMENT, LLC, a Mississippi limited liability company (“Owner”), is the owner of record of approximately ten (10) acres of immovable property located within the city limits of Winnsboro, Louisiana (at the terminus of Martin Luther King, Jr. Drive), as more specifically described on Exhibit “A”, attached hereto (the “Property”); WHEREAS, Owner applied to the City for zoning approval to develop and construct on the Property a multifamily development consisting of forty-eight (48) units, to be known as the “Northbrook Apartments” (the “Project”); WHEREAS, Owner petitioned the City of Winnsboro, Louisiana (the “City”) for zoning of the Property from R-1 Residential to allow for the following variance for a Planned Unit Development (“PUD”) as stated in the City of Winnsboro Zoning Ordinance (the “Code”); WHEREAS, pursuant to Section IX of the Code, entitled “Variance and Modifications”, applications for variances or modifications of the Code regulations shall be submitted to the City Municipal Planning and Zoning Commission (the “Planning Commission”), and such applications shall include a statement setting forth the nature and extent of the requested variance, or modification, together with evidence supporting the need for such variance. WHEREAS, pursuant to the provisions of the Code, entitled “Criteria for Grant of Variances or Modifications”, as it pertains to planned unit developments, the requirements and standards of the Code regulations may be modified by the Planning Commission in the case of the plan and program for a planned unit development, which in the judgment of the Planning Commission provides adequate public spaces and improvements for the circulation, recreation, light, air and service needs of the tract when fully developed and populated, and which also provides such covenants or other legal provisions as will assure conformity to and achievement of the plan. WHEREAS, after consideration of the Owner’s request for zoning approval for the Project, it was the recommendation of the Planning Commission that the Property be zoned to allow for a variance as a PUD; WHEREAS, Owner proposes to develop the Property in accordance with the provisions and standards of the Code; WHEREAS, the Board of Aldermen of the City of Winnsboro, Louisiana, agree to allow for a variance on the Property to a PUD zoning designation, subject to the conditions and restrictions and variations provided herein. NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Board of Aldermen of the City of Winnsboro, Louisiana, that: 1. The Mayor and Board of Aldermen find that the facts stated in the preamble of this Resolution are true and correct and are incorporated into the text of this Resolution to the same extent as if each had been set forth herein its entirety. 2. A variance is hereby granted to allow for a PUD on the Property (which is currently zoned R-1), subject to the following terms and conditions containing modifications for a PUD and including: (a) No co-mingling of single and multi-family dwellings shall be allowed. 3. No change or modification of any ordinance, code or regulation shall be applied for a period of twenty (20) years from the date of approval of this Resolution so as to adversely affect the zoning modification of the Property or the uses permitted thereunder by the City Code in effect as of the date of approval of this Resolution or hereinafter adopted as hereinbefore provided; and shall not (i) eliminate the departures allowed hereunder, or (ii) result in any lot or lots or structure erected on any lot pursuant to this Resolution being classified as non-conforming. 4. Except as modified by the terms and provisions of this Resolution, the Owner shall comply in all respects with the conditions and requirements of all ordinances, rules and regulations of the City applicable to similar property within the City as they may exist from time to time including, but not limited to, those requiring the issuance of permits or the payment of fees thereof. 5. The provisions of this Resolution, and all obligations, conditions, restrictions, and limitations related thereto shall run with and be jointly and severally binding upon the fee simple owner and the beneficial owner of all or any portion of the Property. All obligations, requirements, and rights of the owner shall run with the land and shall automatically be assigned to be binding upon and insure to the benefit of its successors and assigns, including, but not limited to, any entity acquiring any financial interest in the Property and/or any subsequent owner and/or beneficial owner of all or any portion of the Property. 6. Each exhibit which is attached to this Resolution is deemed to be and is expressly made a part of and incorporated into this Resolution to the same extent as if each such exhibit and the plans identified therein had been set forth in its entirety in the body of this Resolution. 7. This Resolution shall be in full force and effect upon passage, approval and publication pursuant to law. BE IT RESOLVED that the Mayor and Board of Aldermen of the City of Winnsboro, Louisiana does hereby accept the lowest responsive bid offered for the construction of this project by: Hasco, Inc. Bid Amount - $82,800.00 BE IT FURTHER RESOLVED that said bids are accepted subject to confirmation by the project engineers, Volkert, Inc., as to accuracy of said bids and the availability of funds. Johnson will execute all documents on this project. NOW THEREFORE BE IT RESOLVED by the Board of Aldermen of the City Of Winnsboro, Louisiana, on March 19, 2012, that Mayor Jackie R. PAAC: Ms. Rita Tucker with People Against Animal Cruelty (PAAC) appeared before the Board asking them to consider passing an ordinance to ban the roadside sale of animals in the city limits. The introduction to this ordinance will be brought before the Board on the April 16th meeting. John Dumas arrived at this time. SPRING FAIR 2012: The Mayor brought before the Board for discussion a fair to be located in Winnsboro on the Old Union Compress Property during the last week in April. After the discussion a motion was made by Dumas, second by Gill to support the fair but also look for a more suitable location. HUMANE OFFICE REPORT: Russell Grant gave a monthly report on the activity at the Winnsboro Animal Control Facility. Motion by Gill, second by Dumas to accept the report. Unanimously approved. ECONOMIC DEVELOPMENT REPORT: The Mayor introduced his new economic development staff, Billy Cobb and Shirley Hammons. COMMUNITY CENTER REPORT: Alice Wallace gave a monthly activity report on the Jack Hammons Community Center. Motion by Gill, second by Johnson to accept the report. Unanimously approved. FIRE CHIEF MONTHLY REPORT: Chief Truman Welch gave a monthly activity report for the City of Winnsboro Fire Department. Motion by Mahoney, second by Dumas to accept the report. Unanimously approved. POLICE CHIEF MONTHLY REPORT: Chief Lester Thomas gave a monthly activity report for the City of Winnsboro Police Department. Motion by Mahoney, second by Dumas to accept the report. Chief Lester Thomas presented the Mayor and Board of Aldermen with a letter requesting a $23,050.00 increase in his operating budget for the City of Winnsboro Police Department.
