Notice
Notice is hereby given, pursuant to Article IV, Section 21(D)(1) of the Louisiana Constitution, that on July 21, 2011, Entergy Louisiana, LLC (“ELL” or the “Company”) an electric public utility providing retail electric service to customers in forty-six (46) Parishes of the State of Louisiana, filed with the Louisiana Public Service Commission (“LPSC”), pursuant to Article IV, Section 21(D)(3) of the Louisiana Constitution and Title 45, Section 1163.1 of the Louisiana Revised Statutes, a supplemental Application (“Application”) for Re-Approval and Re-Issuance of a Financing Order to Securitize Investment Recovery Costs Related to the Little Gypsy Unit 3 Repower Project authorizing the Company to finance its investment recovery costs pursuant to Act 988. This filing relates to LPSC Docket No. U-30192 and is being filed in LPSC Docket No. U-31894.
On April 13, 2011, ELL filed with the LPSC a document styled “Supplemental and Amending Application for Approval to Securitize Investment Recovery Costs Related to the Little Gypsy Unit 3 Repower Project” (April Application”) and a proposed Financing Order. The parties to that proceeding entered into a Stipulated Settlement with regard to the Company’s April Application and Financing Order and the LPSC approved the April Application and Financing Order at its June 22, 2011 meeting and that approval was memorialized in LPSC Order Nos. U-31894 and U-31894-A issued on June 24, 2011. ELL’s current Application effectively seeks re-approval and re-issuance of the Financing Order solely to cure a publication of legal notice error that occurred in five parishes in which ELL operates. There are no material changes between the Financing Order for which ELL is now seeking approval and the Financing Order previously approved by the LPSC.
In conjunction with Act 988 of the Louisiana Legislature’s Regular Session of 2010, the parties reached agreement on a Proposed Uncontested Stipulated Settlement (“Stipulated Settlement”) in LPSC Docket No. U-30192 (Phase III) and the Commission approved that Stipulated Settlement at its May 2011 meeting, thereby resolving all issues among the parties in Phase III, including: (1) the cancellation of the Little Gypsy 3 repowering project; (2) the establishment of a quantification of the prudently incurred and recoverable cancellation costs; (3) the level(s) at which carrying costs may be accrued on a going forward basis; (4) the appropriate allocation of the recoverable cancellation costs among the Companies’ customer classes and customers; and (5) subject to the issuance of an appropriate financing order, the framework for the securitization of the recovery costs.
The Financing Order submitted with this July 21, 2011 filing in LPSC Docket No. U-31984 addresses the request of ELL, under Act No. 988 to: (1) finance, through the issuance of investment recovery bonds, ELL’s investment recovery costs in the amount of $200,000,000.00, as determined in LPSC Docket No. U-30192 (Phase III), plus carrying costs on such investment recovery costs and up-front financing costs associated with the issuance of investment recovery bonds; (2) approve the proposed financing structure and issuance of investment recovery bonds; (3) approve the creation of investment recovery property, including the right to impose and collect investment recovery charges sufficient to pay the investment recovery bonds and associated financing costs; (4) approve a tariff to implement the investment recovery charges; and (5) approve another tariff to implement ancillary cost offsets and cost recovery relating to the investment recovery costs process.
Because the actual revenue requirement will not be known until after the pricing of the investment recovery bonds, it is only possible to estimate typical bills at this time. The estimated monthly bill of a typical residential customer using 1,000 kWh will increase by $0.45 per month, representing a 0.48% increase.

Franklin Parish Police Jury
Regular Meeting
June 9, 2011
The Franklin Parish Police Jury met in Regular Session following at Public Hearing on Thursday, June 9, 2011 at 6:00 P.M. in the Police Jury Meeting Room, Courthouse Building, with the following Jurors present. Honorable Ricky Campbell, President, K.W. “Buddy” Parks, James Harris, Leroy Scott, Joe Lewis, W.H”Rawhide” Robinson, and Troy Hendry.
Juror Scott led the group with the prayer and pledge.
Motion made by Juror Harris and seconded by Juror Parks to approve the agenda. Unanimously approved
Motion made by Juror Scott and seconded by Juror Hendry to approve the minutes from May 12, 2011. Unanimously approved
Blake Kramer joined the group with the hospital updates- Franklin Medical Center now has wound care, and MRI five days a week. Mr. Kramer stated that financial are going well. He also gave an update on the Crowville Clinic; they are waiting on the blue prints to be approved by the state Fire Marshall. Mr. Kramer asked on behalf of Franklin Medical Center for the Jury to adopt the resolution allowing the hospital to incur up to $500,000.00 in debt from the Bond Commission for the Franklin Medical. This is a precautionary measure in the event a need arises from the ongoing healthcare reform.
Motion was made by Juror Scott and seconded by Juror Lewis to approve the Resolution # 412 Franklin Parish Hospital Service District No. 1. Unanimously approved
LSU Updates- Terri Crawford- Kid Chef Mini Camp ages 9-12 starts July 12-14, camp will be held at the LSU AG center to attend the cost is $20.00, Diabetes News- New educational program learning to live with diabetes, the program will have five classes June 28 through August 2 the program will be held at the Franklin Medical Center Auditorium $15.00 registration fee to attend.
Visitors- Johnny Browning Jr.- regarding French turn Road. Mr. Browning asked that the jury install a 12 inch drop pipe under French Turn Road allowing Mr. Browning access to the waterway. Mr. Browning will purchase the drop pipe. Motion was made by Juror Scott and seconded by Juror Hendry for the jury to assist with placement of the pipe. Unanimously approved
Jimmy Dale Robins- discussed the situation with the jury regarding the water supply for the Wilderness Lane.
Administrative consultant for Horace White/ Abe Lincoln subdivision Sewer Project-Motion was made by Juror Scott and seconded by Juror Parks to award the Administrative consultant for Horace White/Abe Lincoln subdivision to Frye Magee. Unanimously approved
Engineering Services for Horace White/Abe Lincoln subdivision Sewer Project -Motion was made by Juror Scott and seconded by Juror Lewis to award the engineering services for Horace White/Abe Lincoln to McManus Engineering. Unanimously approved

Juror Scott discussed assignment of truck- For the Record
“Gentlemen, recently the Franklin Parish Police Jury traded in a larger or heavy duty truck (which was driven by James Killian). This truck was using too much fuel for its assigned job sites each day. As you may recall, I spoke against purchasing this type truck years ago. Never the less, we purchased the truck anyway. The truck the jury has purchased should have been assigned to James (who happened to be black), but it was not assigned to James. It was assigned to Luther Smith. The reason stated for not assigning the newly purchased truck‚ was to purchase a two-wheel drive truck for Luther and give the older model truck to James (which happened to be a four-wheel drive truck). The two- wheel drive truck supposedly would have used less fuel than the four-wheel drive truck. I have check with several mechanics and was told that the increase in fuel consumption would only happen when the four-wheel drive is placed in to use. The four-wheel drive truck rarely would be used. As a whole, the significant of the two trucks is very small. Fellow jurors, this is a disguised and -I say this politely and nicely toward our part- form of prejudice and /or disintegration. Surly, we must do our best in saving fuel cost. This does not look good in order to network the employees with the jurors and citizens of Franklin parish. An act like this is what causes displeasure between workers and not trusting others. If we are really concerned about fuel cost, why not purchase an S-10 or some other smaller vehicle. So, I just sit here and think that it just threw up a wrong flag. I don’t like to use the work black, I don’t like to use the word white, I like to use us as employee’s and jurors because we are the body and should be working with each other.”
Nolan Norman Park Supervisor- Motion was made by Juror Scott and seconded by Juror Harris to pay $400.00 for Nolan Norman Park Supervisor for June and July 2011. Unanimously approved
Jessie Lemle- Discussed with jury the possibility of adding another park in Wisner. Juror Campbell asked that Juror Lewis talk to the Major of Wisner, and the matter be discussed at the July meeting.
Juror Scott stated that $800.00 left in park account after paying $250.00 for purchasing a fence for baseball field. He would like to donate $500.00 to new park in Wisner if new park is constructed. Motion was made by Juror Scott and seconded by Juror Robinson. Unanimously approved
Ryan Daniels and Cain Finkbeiner from the Wildlife Fisheries came to discuss Turkey Creek. Mr. Daniels explained to the Jury that they have no plans on draining the creek again and that they have been spraying every week to kill the salavina in the creek Mr. Daniels wants people to know that a lot of the time duckweed is usually mistaken for salavina. Mr. Daniels was asked if Wildlife and Fisheries had any plans of adding fish to the creek. Mr. Daniels stated that they added 30,000 Florida bass to Turkey Creek. Mr. Daniels was asked if individuals could stock the creek. Mr. Daniels informed the jury that there was a permit that had to be acquired from Wildlife and Fisheries.
Riley Williams- Discuss the need for the ditches on Claybon Road to be dug out. And two culverts were removed by the parish and needs to be replaced. Mr. Williams’s son stated that the ditches on Claybon Road have not been cleaned out in many; years and also, the canal needs to be cleaned out. The parish Superintendent explained that Mr. Killingworth will not sign right of way allowing access to the canal. The Superintendent was asked to shoot the grade on the ditch and get with Mr. Parker and David Doughty to obtain the proper right of ways. Juror Campbell asked the Superintendent to check on the situation and add ditching of Claybon Road to the work schedule.
Superintendent Report- Completed Roads: Canal Road and Chapman Road - In Progress Roads: Carroll Road, Loflin Road, Lee Boutwell Road, and Elam Woods Road
Motion was made by Juror Parks and seconded by Juror Hendry to approve the work schedule for the month of June. Unanimously approved
Public Works Committee-
Accepting Roads into the system- The following request were made: Wimberley Road, a road off of Ward III School Road, road off of Roberts Road, and Beatrice Ezell Road. Due to discrepancies and request being received after the public works committee meeting on the 7th, the committee held another meeting on the 9th and decided the following - it is the recommendation of the committee to revise the parish ordinance before accepting more roads in the system. Each juror has been provided with all documentation regarding parish road criteria. The jurors are asked to please edit their package and return to Christina for a revised ordinance to be considered. It is also the recommendation of the committee to consider leaving the section pertaining to newly constructed roads being inspected by the parish engineer and the section regarding roads that were left out of the parish system when 911 communications was established. The committee agrees that these roads should be accepted back into the system.
Abe Lincoln Sewer accepting sewer sludge- around Dec. 2010 Dr. Reed contacted Sam Wiggins to find out if any of the parish sewer districts could accept sewer sludge or waste from port o potties. After months of questioning, resubmitting Abe Lincoln’s standard permit to reflect intent to change, the application for disposal of sewage sludge (biosolids) began. There is a portion that Ms. Wiggins was not qualified to answer therefore: the question was forwarded to the Parish Engineer. It is the recommendation of the committee to comply with the engineer’s advice to deny accepting Sewage Sludge into parish system. Motion was made by Juror Parks and seconded by Juror Scott. Unanimously approved
Bus Turnarounds - The expense of installing larger culverts and supplying materials for bus turnarounds were discussed.
Garbage Truck Turnaround- all garbage truck turnaround needs to be noted, billed out separately and paid from the sales tax fund.
Parish Work Schedule- It is recommendation of the committee to continue the 4-12 hour day work schedule. Motion was made by Juror Parks and seconded by Juror Hendry for to continue for 8 more weeks of the current work schedule. Unanimously approved
Purchasing Committee- Land Purchase There was discussion regarding three acres being acquired for the public works facility to be constructed through the LCDGB grant. A parcel of land being considered is listed with Gary Robinson. David Doughty asks that the jury request him to obtain an opinion from the Ethics Board before the purchase is made. Motion was made by Juror Harris and seconded by Juror Parks. Unanimously approved
Material Bids- It is the recommendation of the committee to authorize for the advertising of bids for parish materials. Motion was made by Juror Parks and seconded by Juror Hendry. Unanimously approved
Personnel Committee-
Troy Jacobs 6 months probationary period as shop foreman- It is the recommendation of the committee to increase Mr. Jacob’s rate of pay by .75. Mr. Jacobs has preformed outstandingly as a mechanic, as a foreman and has saved the parish thousands by performing major repairs in- house. Motion was made by Juror Robinson and seconded by Juror Lewis. Unanimously approved
Brandon McMurray- Mr. Jacobs approached the committee requesting that Brandon McMurray be taken from probationary status to full-time employee with an increase of pay. The committee feels that Mr. McMurray should complete his 6 month probationary period to continue with consistency in personnel policy. Mr. McMurray’s probationary period will be completed in Sept. of this year.
James Killian- Mr. Killian was asked by the jurors if he had any issues or problems with the vehicle assigned to him last month. Mr. Killian stated that his only problem was that the truck needs shocks. Mr. Killian was asked if he would like the truck that was purchased to replace the truck (#3) instead of the one he is driving. Mr. Killian replied, “No, that truck is a two wheel drive and I need a four wheel drive. Mr. Killian also stated, “That Ford truck (referring to #3) was killing me getting in and out of it. Also, rolling that thing leaning out the door was tough.” Mr. Humphries asked Mr. Killian to confirm that he was asked about the vehicle change prior to the change being made and Mr. Killian stated yes.
Mosquito Sprayers- if one of our current employees also sprays mosquitoes, then their pay for spraying will fall into/ad to overtime. The mosquito fund will not sustain paying overtime wages.
Motion was made by Juror Scott and seconded by Juror Parks for 12 hour holiday pay under new work schedule. Unanimously approved
Motion was made by Juror Scott and seconded by Juror Parks - Robert Gladen- In years past, Skipper Stinson was paid 2,000 a year to allow the parish to spray mosquito under his license. Mr. Gladen has since been licensed and leads our mosquito abatement program. Mr. Humphries ask that Mr. Gladen be paid the same rate for the use of his license. After referring with the parish auditor an option was found. Mr. Gladen can be paid 76.92 per check for the use of his license in the mosquito abatement program. (2000 divided by 26 pay periods= 76.92) as long as he retains his license for the parish. Motion was made by Juror Scott and seconded by Juror Parks. Unanimously approved
Recreation Committee- Mr. Tyrone Johnson request that 6 gloves, 1 bat, 1 home plate and 1 pitcher’s mound be purchased for the park. Mr. Lewis asks that he himself be issued the equipment at the beginning of each summer and he will take the responsibility of replacing any lost equipment. The committee asks that the decision made in years past to be reversed and allow the equipment be purchased. Motion was made by Juror Scott and seconded by Juror Hendry. Unanimously approved contingent upon the advice of the Parish Auditor and Parish Attorney.
Turkey Creek Park- Mr. Scott stressed the need for the ramps to the bathrooms at Turkey Creek Park are constructed immediately. Due to lack of funds, this project was delayed. The committee agrees and requests the jury to vote for the construction of the ramp. Motion was made by Juror Parks and seconded by Juror Scott. Unanimously approved
Treasurer’s Report- Budgets were presented and a financial update given, along with a report of increase and decreased of FEMA money in the last three years.
Treasurer asked the Jury to authorize Ricky Campbell to sign the contract with Providence Engineering that was approved at the last meeting for the Wind Retrofit Project. Motion was made by Juror Scott and seconded by Juror Parks. Unanimously approved

A resolution ordering and calling a special election to be held in the Parish of Franklin, State of Louisiana, to authorize the levy of special taxes therein; making application to the State Bond Commission in connection therewith; and providing for other matters in connection therewith.
BE IT RESOLVED by the Police Jury of the Parish of Franklin, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Franklin, State of Louisiana (the “Parish”), that:
SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Sections 26, 30 and 32 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5 and Chapter 6-A of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the Parish on SATURDAY, OCTOBER 22, 2011, between the hours of six o’clock (6:00) a.m., and eight o’clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following propositions, to-wit:

Shall the Parish of Franklin, State of Louisiana (the “Parish”), levy a four and twenty-six hundredths (4.26) mills tax on all property subject to taxation in the Parish (an estimated $252,700 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of five (5) years, beginning with the year 2014 and ending with the year 2018, for the purpose of the purchasing, operating and maintaining of road equipment and for the purpose of salary adjustments for employees of the Parish?
SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in The Franklin Sun, a newspaper of general circulation within the Parish, published in Winnsboro, Louisiana, and being the official journal of the Parish, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as “Exhibit A” and incorporated herein by reference the same as if it were set forth herein in full.
SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the Police Jury Room of the Franklin Parish Courthouse, Winnsboro, Louisiana, on THURSDAY, NOVEMBER 10, 2011, at SIX O’CLOCK (6:00) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the results of the said special election.
SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.
SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Thursday, November 10, 2011, as provided in Section 3 hereof. All registered voters in the Parish will be entitled to vote at the special election, and voting machines shall be used.
SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Federal Voting Rights Act of 1965, as amended.
SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Franklin Parish and the Registrar of Voters of Franklin Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.
SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the special taxes provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.

WATER DISCHARGE PERMIT
The LDEQ, Office of Environmental Services, is accepting written comments on a FORMDROPDOWN Louisiana Pollutant Discharge Elimination System (LPDES) permit prepared for the City of Winnsboro, Winnsboro Industrial Park, P.O. Box 270, Winnsboro, Louisiana 71295. The facility is located on LA Hwy. 15, 1.5 miles north of Winnsboro, Franklin Parish. Upon the effective date of the final permit, the LPDES permit shall replace the previously issued LPDES permit, LA0038253.
The principal discharge from this existing source is made into an unnamed ditch, thence into Turkey Creek, waters of the state classified for primary contact recreation, secondary contact recreation, and propagation of fish and wildlife. Under SIC Code 4952, the applicant proposes to discharge treated sanitary wastewater from a publicly owned treatment works serving the Winnsboro Industrial Park.
During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody. As with any discharge, however, some change in existing water quality may occur.
Written comments, written requests for a public hearing or written requests for notification of the final decision regarding this permit action may be submitted to LDEQ, Public Participation Group, P.O. INVITATION FOR BIDS
Sealed bids will be received by the City of Winnsboro, at Winnsboro City Hall, until 2:00 p.m. Local Time, August 19, 2011, for the furnishing of all labor and materials and performing all work for constructing the following contract:

At the specified time, all bids will be publicly opened and read aloud. The opening will be held in the Conference Room of the, City of Winnsboro City Hall 3814 Front Street Winnsboro, Louisiana 71295.
Major items of work include crack cleaning and sealing, pavement rejuvenation, and markings.
Approximate quantities include:
Crack Cleaning and Sealing - 20,000 LF
Pavement Rejuvenation - 30,000 SY
Markings - 15,000 SF
A Disadvantaged Business Enterprise (DBE) goal of 0% has been established for this project. In order to assist Contractors in securing DBE participation, a pre-bid meeting will be held on August 10, 2011, at 2:00 p.m. local time in the Conference Room of the, City of Winnsboro City Hall 3814 Front Street Winnsboro, Louisiana 71295, for the purpose of briefing prospective bidders and DBE’s about this project. All prospective bidders are urged to attend.
Plans and specifications may be inspected at the City of Winnsboro, 3814 Front Street, Winnsboro, Louisiana 71295, the office of Volkert, Inc. (formerly known as Volkert & Associates, Inc.), Consulting Engineer, 3466 Drusilla Lane, Suite A, Baton Rouge, Louisiana 71295.
Bidding Documents (the contract documents, specifications and drawings) are available to contractors who are properly licensed in Louisiana or to bona fide suppliers of materials and equipment. Copies may be obtained from Volkert, Inc., Consulting Engineer, 3466 Drusilla Lane, Suite A, Baton Rouge, Louisiana, 70809, (225) 218-9440, upon payment of a deposit of $40.00 to Volkert, Inc. The deposit will be refunded upon return of the documents in reusable condition within ten (10) days after the bid opening. No plans and specifications will be issued to contractors later than twenty-four (24) hours prior to the time indicated above for receiving bids.
Bids must be submitted upon the forms as issued to the prospective bidder by the Engineer. Guarantee will be required with each bid as follows: At least 5% of the amount of the bid, but in no event more than ten thousand dollars, shall be filed in the form of a certified check or bid bond payable to the City of Winnsboro.
Contractors Submitting bids shall be Licensed LA license R.S.37:2150-2164 Classification II Highway, Street and Bridge Construction.
Contract bond will be required as follows: 100% of the contract price. Labor and Materials Bond will be required as follows: 100% of the contract price.
The awarding of the contract will require the Contractor to pay all workers on this project the prevailing scale of wages as noted in Division III, Section 160 and Division VI of the Contract Documents.
Certification of Nonsegregated Facilities and Equal Opportunity Report Statement must be signed as included in the bid proposal. Failure to complete these forms may be grounds for rejecting bid.
Disadvantaged Business involvement data and certificate of compliance must be included with each bid.
No bids will be considered unless the bidder, whether resident or non-resident of Louisiana, is properly qualified to submit a proposal for this construction in accordance with all applicable laws of the State of Louisiana.
No contract will be awarded unless the contractor holds a current license from the Louisiana State Licensing Board for General Contractors. In addition, non-residents of the State, if a corporation, shall show evidence of having qualified with the Secretary of State to do business in Louisiana.
No bid shall be withdrawn for a period of 120 days subsequent to the opening of bids without the consent of the Owner.
The right is reserved to reject any or all bids and waive informalities in the bidding.
