COUNCIL MEETING
JULY 19, 2010


6:00 PM - CALL TO ORDER
The Board of Aldermen of the City of Winnsboro, Louisiana, met in regular session on Monday, July 19, 2010 at 6:00 PM at the Winnsboro City Court, 1308 Cornell Street, Winnsboro, Louisiana, with Mayor Jackie R. Johnson presiding.
Prayer led by John Dumas
Pledge led by Mayor Jackie R. Johnson
Aldermen present: Richard Mahoney, John Dumas, Betty Johnson, Craig Gill
Absent: Rex McCarthy
Motion by Gill, second by Johnson to approve the minutes of the regular session held on June 21, 2010 and special called meeting held on July 13, 2010. Unanimously approved.
APPOINTMENT OF CITY OFFICIALS:
Mayor Johnson recommended Clarence “Skipper” Stinson for the appointment of superintendent. Motion by Gill, second by Dumas and unanimously approved.
Mayor Johnson recommended Roxy Fletcher for the appointment of city clerk. Motion by Johnson, second by Mahoney and unanimously approved.
Mayor Johnson recommended Sykes Hamilton for the appointment of fire chief. No motions were made.
Mayor Johnson recommended Carol Lexing for the appointment of city attorney. No motions were made.
Mayor Johnson recommended Marcus, Robinson & Hassell for city auditor. Motion by Gill, second by Dumas and unanimously approved.
PUBLIC HEARING AND ADOPTION OF ORDINANCE NO. 939:
An Ordinance providing for the incurring of debt and issuance of One Hundred Ninety Thousand Dollars ($190,000) of Certificates of Indebtedness, Series 2010, of the City of Winnsboro, Parish of Franklin, State of Louisiana, prescribing the form, terms and conditions of said Certificates, designating the date, denomination and place of payment of said Certificates, providing for the payment thereof in principal and interest; and providing for other matters in connection therewith.
Motion by Gill, second by Johnson and unanimously approved to adopt Ordinance No. 939.
PUBLIC HEARING AND ADOPTION OF ORDINANCE NO. 940:
ORDINANCE OF THE CITY OF WINNSBORO, LOUISIANA, GRANTING TO ATMOS ENERGY CORPORATION (A TEXAS AND VIRGINIA CORPORATION WITH ITS PRINCIPAL OFFICE IN THE CITY OF DALLAS, DALLAS COUNTY, TEXAS) AND ITS SUCCESSORS AND ASSIGNS THE FRANCHISE AND RIGHTS TO CONDUCT IN SUCH CITY THE BUSINESS OF ACQUIRING, MAINTAINING, CONSTRUCTING, LAYING, REPAIRING, REMOVING, REPLACING, INSTALLING, OPERATING, AND DISPOSING OF A GAS SYSTEM FOR THE SALE, TRANSPORTATION, AND DISTRIBUTION OF NATURAL GAS WITHIN AND BEYOND THE MUNICIPAL BOUNDARIES OF THE CITY AND TO THE RESIDENTS AND BUSINESSES LOCATED THEREIN FOR LIGHT, HEAT, POWER, AND ANY OTHER PURPOSES AND THE RIGHT TO USE THE PRESENT AND FUTURE STREETS, ROADS, HIGHWAYS, ALLEYS, BRIDGES, PUBLIC WAYS, AND IMMOVABLE PROPERTY IN SUCH CITY AND OWNED OR CONTROLLED BY SUCH CITY FOR SUCH PURPOSES; PRESCRIBING THE TERMS AND CONDITIONS TO WHICH SUCH FRANCHISE AND RIGHTS ARE SUBJECT; AND PRESCRIBING THE TERM OF SUCH FRANCHISE AND RIGHTS.

Motion by Dumas, second by Mahoney and unanimously approved to adopt Ordinance No. 940.
RESOLUTION NO. 10-0703:
A RESOLUTION AMENDING THE GENERAL FUND OPERATING AND SPECIAL REVENUE FUND BUDGET FOR THE CITY OF WINNSBORO FOR FISCAL YEAR ENDING JUNE 30, 2010.
BE IT RESOLVED, by the Board of Aldermen of the City of Winnsboro, Louisiana, convened in regular session on July 19, 2010, that they hereby amend the General Fund operating budget and the Special Revenue Fund budget as attached.

RECOGNITION OF VISITORS:
Hiliary Scott asked the Board if he could present a proposal at the August meeting on maintaining and updating the Winnsboro website.
Sammy White appeared before the Board concerned about the Mayor’s salary compared to other towns in the surrounding area.
David Strange with New Horizons Development and Meadowbrook Subdivision gave the Board an update on the subdivision.
RESOLUTION NO. 10-0704:
A resolution of support for the Big Brothers Big Sisters of Northeast Louisiana was presented to the Board. Motion by Dumas, second by Gill and unanimously approved to table this resolution until they have more information on this organization.
ALCOHOL LICENSE:
Upon the recommendation of Chief Lester Thomas alcohol license were approved for Jesse’s Steakhouse. Motion by Johnson, second by Gill and unanimously approved.
INTRODUCTION OF ORDINANCE:
Motion by Gill, second by Dumas and unanimously approved to introduce an ordinance for the incurring of debt and issuance of $1,000,000 of Sewer Revenue Bonds.
The Board also amended the Resolution No. 10-0401 extending Sewer Revenue Bonds from 20 to 21 years.
CHUCK PARISH:
The Board was presented with the lease between the City of Winnsboro and Chuck Paris, D/B/A Paris Flying Service. Alderwoman Johnson said she had received a call from an individual interested in leasing the hanger at the airport. Motion by Dumas, second by Mahoney and unanimously approved to table this until the city attorney had reviewed the lease.
MAYOR’S VEHICLE:
The Mayor asked the Board to consider purchasing him with a city owned vehicle. Dumas indicated that the Board had already agreed to offer the Mayor a car allowance or a vehicle and no action needed.
DOG KENNEL:
The Mayor informed the Board of a dog kennel that he had located from Mr. Allen Butler that would house 38 dogs. The cost of the kennel is $14,000 and possibly moving the kennel to a location on the old water plant grounds. Motion by Mahoney, second by Gill and unanimously approved to table until further information was presented.
SELECTION OF COMMITTEES:
Mayor Johnson asked the Board to review the current committees that they served on and he would like for everyone to remain on the same committees.
HUMANE OFFICER REPORT:
Russell Grant presented the Board with a monthly activity report.
FIRE CHIEF MONTHLY REPORT:
Chief Truman Welch gave a monthly activity report for the City of Winnsboro Fire Department. Motion by Gill, second by Mahoney to accept the report as presented. Unanimously approved.
POLICE CHIEF MONTHLY REPORT:
Chief Lester Thomas gave a monthly activity report for the City of Winnsboro Police Department. Motion by Johnson, second by Mahoney, to accept the report as presented. Unanimously approved.
MONTHLY FINANCIAL REPORTS:
Motion by Gill, second by Johnson to accept the monthly financial reports. Unanimously approved.
ADJOURNMENT:
There being no more business to come before the board at this time, a motion was made by Gill, second by Dumas and unanimously approved that the meeting be adjourned.

2 (A)(4)(b)(i) of the Constitution of Louisiana.
A JOINT RESOLUTION
Proposing to amend Article III, Sections (A)(3)(a)
and (4)(a) and 19 of the Constitution of Louisiana, relative to the legislature; to provide for the convening of the legislature for annual regular sessions; to provide for the effective date of legislation enacted at such sessions; and to specify an election for submission of the proposition to electors and provide a ballot proposition.
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members elected to each house concurring, that there shall be submitted to the electors of the state, for their approval or rejection in the manner provided by law, a proposal to amend Article III, 10 Sections 2(A)(3)(a) and (4)(a) and 19 of the Constitution of Louisiana, to read as follows:
ß2. Sessions
Section 2. (A) Annual Session.

(3)(a) All regular sessions convening in even-numbered years shall be general in nature and shall convene at noon on the last second Monday in March. The legislature shall meet in such a session for not more than sixty legislative days during a period of eighty-five calendar days. No such session shall continue beyond six o'clock in the evening of the eighty-fifth calendar day after convening. No new matter intended to have the effect of law shall be introduced or received by either house after six o'clock in the evening of the twenty-third calendar day. No matter intended to have the effect of law, except a measure proposing a suspension of law, shall be considered on third reading and final passage in either house after six o'clock in the evening of the fifty-seventh legislative day or the eighty-second calendar day, whichever occurs first, except by a favorable record vote of two-thirds of the elected members of each house.

(4)(a) All regular sessions convening in odd-numbered years shall convene at noon on the last second Monday in April. The legislature shall meet in such a session for not more than forty-five legislative days in a period of sixty calendar days. No such session shall continue beyond six o'clock in the evening of the sixtieth calendar day after convening. No matter intended to have the effect of law, except a measure proposing a suspension of law, shall be considered on third reading and final passage in either house after six o'clock in the evening of the forty-second legislative day or fifty-seventh calendar day, whichever occurs first, except by a favorable record vote of two-thirds of the elected members of each house.

ß19. Effective Date of Laws
Section 19. All laws enacted during a regular session of the legislature shall take effect on August fifteenth first of the calendar year in which the regular session is held and all laws enacted during an extraordinary session of the legislature shall take effect on the sixtieth day after final adjournment of the extraordinary session in which they were enacted. All laws shall be published prior thereto in the official journal of the state as provided by law. However, any bill may specify an earlier or later effective date.
Section 2. Be it further resolved that this proposed amendment shall become effective January 1, 2012.
Section 3. Be it further resolved that this proposed amendment shall be submitted to the electors of the state of Louisiana at the statewide election to be held on October 2, 2010.
Section 4. Be it further resolved that on the official ballot to be used at said election there shall be printed a proposition, upon which the electors of the state shall be permitted to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall read as follows:
To move the convening of the legislature in annual regular session in even numbered years to the second Monday in March and in odd-numbered years to the second Monday in April and to change the effective date of legislation enacted at such sessions to August first.

Proposing to amend Sections 2(B)(11) and (12) and to add Section 2 (B)(13) of Article X of the Constitution of Louisiana, relative to public officials and employees; to provide that the director, deputy director and all employees of the Governor's Office of Homeland Security and Emergency Preparedness shall serve in unclassified service of the state civil service; and to specify an election for submission of the proposition to electors and provide a ballot proposition.
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members elected to each house concurring, that there shall be submitted to the electors of the state, for their approval or rejection in the manner provided by law, a proposal to place the director, deputy director and all employees of the Governor's Office of Homeland Security and Emergency Preparedness in the unclassified service of the state civil service and to amend Sections 2(B)(11) and (12) and to add Section 2(B)(13) of Article X to the Constitution of
Louisiana, to read as follows:
ß2. Classified and Unclassified Service

(B) Unclassified Service. The unclassified service shall include the following officers and employees in the state and city civil service:

(11) commissioners of elections, watchers, and custodians and deputy custodians of voting machines; and
(12) railroad employees whose working conditions and retirement benefits are regulated by federal agencies in accordance with federal law.; and
(13) the director, deputy director, and all employees of the Governor's Office of Homeland Security and Emergency Preparedness.
