Public Notices Published Wednesday, July 28th, 2010Franklin Parish Police Jury Public Hearing/Regular Meeting May 20, 2010 @ 6:00 P.M. The Franklin Parish Police Jury met in Regular Session following a Public Hearing at 6:00 P.M. Thursday, May 20, 2010 at the Franklin Parish Police Jury Meeting Room, Courthouse Building, Winnsboro, Louisiana with the following Jurors present: Honorable Ricky Campbell, President, K.W. “Buddy” Parks, James Harris, Leroy Scott, Jackie Johnson, Harvey Guimbelllot and Troy Hendry. Leroy Scott led the group in Prayer and the Pledge. Motion by Parks and seconded by Hendry to approve the agenda. Unanimously approved Motion by Scott and seconded by Harris to approve the minutes of April 8th, 2010 and April 30, 2010 minutes. Unanimously approved The meeting was now opened for Public Hearing to receive any comments or protests to: (1) taking 200 feet of Woodrow Road out the Parish Road System; (2) Take approximately 900 feet of R. Campbell Road from the intersection of Curtis and R. Campbell Road north out of the Parish Road System; and (3) Amend Subdivision Ordinance No. 3309. There were no protests or comments to the above mentioned items and the following action was taken. Motion by Johnson and seconded by Harris to (1) Take 200 feet of Woodrow Road out the Parish Road System; (2) Take approximately 900 feet of R. Campbell Road from the intersection of Curtis and R. Campbell Road north out of the Parish Road System; and (3) Amend Subdivision Ordinance No. 3309. Unanimously approved PROPOSED AMENDMENT TO ORDINANCE NO. 3309 SUBDIVISIONS SECTION VI. DESIGN STANDARDS SECTION E. LOTS SUBPARAGRAPH 2. Revise to match DHH requirements which are mandatory to follow. Residential lots served by a public sewer system shall not be less than 22,500 square feet and a minimum frontage of 80 feet. Where approved individual mechanical plant is to be utilized a minimum area of 16,000 square feet and a minimum frontage of 80 feet. Where an approved individual mechanical plant is utilized and is followed by 100 feet of modified absorption field a minimum area of 12,000 square feet and a minimum frontage of 60 with accessible right of way or adequate drainage. SECTION VII. REQUIRED IMPROVEMENTS SECTION C. SUBPARAGRAPH 2. Sanitary Sewerage System Change from Chapter XII to Title 51, Part XIII SUBPARAGRAPH 3 POTABLE WATER Insert reference: The subdivider must meet Louisiana sanitary code, Title 51, Part XII if potable water supply not available and shall have drilled a test well for potable water within the inner fifty percent (50%) of the area of the subdivision and shall attach a certificate to the final plat showing the depth at which potable water was found, and a certificate from the department of health that the water found was tested and found suitable for human consumption. SECTION XV. DEFINITIONS SUBDIVISION: Change from 5 acres to 3 acres. Motion by Parks and seconded by Scott to adopt a resolution appointing Frye Magee, LLC as the Administrative Consulting Firm for LCDBG Disaster Recovery Program for improvement projects in Franklin Parish. Unanimously approved Laura Bradley with LSU Ag Center gave a brief update on recent activities at the Ag Center. Under any visitors: Leodis Norman informed Jurors he received some complaints from parents about the bathrooms not being handicapped accessible. The bathrooms need handicap rails. Norman stated cement and materials would cost about $2500.00. He said the Sheriff’s office would furnish the labor with the cost of materials coming from Park funds. Juror Scott said the price on the handicapped rails seem somewhat high and that he would get with Norman and measure how much cement will be needed. This will be tabled until next month’s meeting. Norman also stated that the Park would like to have an attendant booth whereby traffic and people coming into the Park can be monitored. He had two (2) quotes for materials one from Kiper’s for $1244.00 and one from Home Hardware for $1484. Kiper’s had the lowest quote of $1244. Motion by Johnson and seconded by Scott to build an attendant booth at Nolan Norman Park in order to monitor the entrance of traffic and people at the park. Unanimously approved Norman also stated that there is a problem with a sewage leak on Fields Drive under the street. He asked if the Parish would come in a tear out the street and resurface it so they can get to the pipe that’s bursted. Motion by Johnson and seconded by Parks that the Franklin Parish Police Jury would tear out and resurface Fields Drive to replace bursted pipe that’s causing sewage leak. Unanimously approved Motion by Johnson and seconded by Hendry to appoint The Franklin Sun as the Official Journal. Unanimously approved Harvey Guimbellot talked to Jurors about 911 signs being taken/stolen. Guimbellot said he would like to see the person convicted get some jail time. He said a week-end in Jail might change the minds of the persons taking the signs. Discussion ensued between Jurors. It was suggested that we get in touch with David Doughty and get his opinion on jail time. Regarding the Elam Sewer Board members: It was the recommendation of the Public Works Committee to hold off on appointing Board members until we can search out other avenues and get with the people in the Community to discuss with them who wants to be on the Board. Motion by Harris and seconded by Hendry to advertise for a Public Hearing on taking out the end of Wardell Reeves Road out of the Parish System. Unanimously approved Motion by Guimbellot and seconded by Hendry accepting the recommendation of Ken McManus Engineer awarding water system materials to H.D. Supply Water Works, Monroe, Louisiana in the amount of $12,814.97 for LCDBG – LAStep No. 675280. Unanimously Motion by Parks and seconded by Guimbellot accepting the recommendation of Ken McManus Engineer awarding rental of equipment to North Franklin Water Works, Crowville, Louisiana in the amount of $2,600.00 per month for LCDBG – La Step No. 675280. Unanimously approved Harvey Guimbellot talked about missing signs. He stated something needs to be done about this situation. Guimbellot recommended offering a reward. Sam said that we couldn’t do this. Discussion ensued Leroy Scott wanted to know the procedure for prioritizing the complaint list. Greg explained that all complaints are evaluated and if it is an emergency someone goes out immediately to check out the problem. Luther prints a review and documents what their findings are. Concerning Turkey Creek Scott said Wildlife & Fisheries will draw down between five (5) and (6) six feet. He also stated Turkey Creek could have an economical impact on Franklin Parish. Scott stated he would like to see the stumps in the Lake cut down. Sam advised him that we are in the process of getting funds to remove the stumps. Ken McManus said that there is about $150,000 available to be used at Turkey Creek. Fire District #4 and First Alarm Fire: Sam stated that Roger Young was to deliver the fire truck to Fire District #4 today but with the weather being bad he made arrangements to deliver the truck on Saturday. The District has some issues on another truck the purchased from First Alarm. The Board voted to not pay Roger Young with First Alarm for thirty (30) days so the truck can be checked out because the last truck purchased from him within thirty day starting having problems such as leaking fluids, fuel, etc. Larry Newman was absent. Hendry stated he thought that issue had been resolved. Riley Williams a resident of the Abe Lincoln subdivision talked to Jurors concerning property owners not keeping their property clean (grass mowed, etc). He stated that this was a serious problem in the subdivision. Williams wanted to know if the Jury had an Ordinance in place for this type of situation. Jackie Johnson advised Williams that if he could get the addresses of the property owners, the Jury would write a letter to them stating that they were in violation of Ordinance No. 3242 and that they need to respond to the letter in a timely manner. Johnson stated that if the property owner did not respond to the letter, the Jury will go in and clean up the property and bill the property owner. If the property owner fails to pay the Jury, then the Jury can have this amount added to their taxes. Motion by Guimbellot and seconded by Parks to appoint Steve Dean to Fire District Number 3 Board. Unanimously approved Superintendent’s Report: Motion by Parks and seconded Hendry to approve May work schedule as presented by Greg Humphries, Superintendent which includes Capital Improvement and Chipseal Lists. Unanimously approved Greg also gave Jurors FEMA updates. He stated that no money is obligated for 1863 and they are working on 1786 projects. Public Works Committee Report: Motion by Harris and seconded by Parks to approve Hardship Certification for J.C. Nichols, 282 Dean Road, Winnsboro, Louisiana. Unanimously approved Purchasing Committee Report: Motion by Parks and seconded by Hendry for Greg Humphries, Superintendent to exchange Parish equipment no longer needed for public purposes for a Duel Tandem Pintle Pull Trailer with Air brakes. Unanimously approved Personnel Committee Report: Motion by Hendry and seconded by Harris to terminate Andrew Mullican from his position with the Franklin Parish Police Jury. YEAS: Parks, Harris, Scott, and Hendry NAYS: Johnson and Guimbellot ABSENT: None ABSTAINED: None Motion passed Motion by Parks and seconded by Harris to hire Greg Tatum as Shop Foreman at a rate of $12.00 per hour plus benefits on a 6 month probationary period. YEAS: Parks, Harris, Scott, Johnson, and Hendry NAYS: None ABSENT: None ABSTAINED: Guimbellot Motion Passed Motion by Hendry and seconded by Parks to hire Eric McMurray as Mechanic Helper at a rate of $8.50 per hour plus benefits on a six month probationary period. YEAS: Parks, Scott, Johnson, and Hendry NAYS: None ABSENT: None ABSTAINED: Harris and Guimbellot Motion Passed Motion by Harris and seconded by Scott to postpone hiring an Accounts Payable Clerk until the next meeting to give the Committee a change to check references. Unanimously approved Motion by Johnson and seconded by Parks to contract Leodis Norman as Nolan Norman Park Supervisor at a rate of $500.00 per month for May, June, and July. Unanimously approved Treasurer’s/Finance Report: Sam stated that she needed to make a budget amendment for Asphalt FOR $50,000.00. Motion by Scott and seconded by Harris to accept the Treasurer’s Report as presented by Sam Wiggins, Treasurer with budget amendment to the Asphalt fund for $50,000. Unanimously approved Old Business: Scott stated that we need to improve Turkey Creek Park. He said he talked to Ken McManus about installing a beach at the Park. Ken McManus to check on this. The Franklin Parish Police Jury met in Regular Session on this the 14th day of June, 2010 at 6:00 P.M. in the Police Jury meeting room, Courthouse Building, Winnsboro, Louisiana with the following members present: Honorable Ricky Campbell, Buddy Parks, James Harris, Leroy Scott, Jackie Johnson, Harvey Guimbellot, and Troy Hendry. Leroy Scott led the group in Prayer and the Pledge. Motion by Hendry and seconded by Guimbellot and to approve the agenda. Unanimously approved Motion by Parks and seconded by Hendry to approve the minutes of May 20, 2010 meeting. Unanimously approved Motion by Parks and seconded by Guimbellot accepting the resignation of Jackie Johnson, Police Juror District 7. Unanimously approved Motion by Harris and seconded by Hendry approving calling for a special election to be held to fill the unexpired term for the office of Police Juror, District 7. Unanimously approved Regarding the appointment of Police Juror District 7: Leroy Scott recommended Charles Brass James Harris recommended Joe Lewis Jackie Johnson recommended Rev. Eugene Lumpkin The vote went as follows: Charles Brass: Scott, Guimbellot Joe Lewis: Harris, Hendry, Parks Eugene Lumpkin: Johnson Joe Lewis was appointed to fill the unexpired term of Jackie Johnson Police Juror, District 7 effective July 1, 2010. Carol Pinnel-Alison informed Jurors that she was stepping down as Parish Chair effective June 30, 2010. Taking here placed will be James Hendrix, Area Agent – Louisiana Master Farmer Program and Environmental Education whom she introduced. She also introduced John Barnett – Northeast Regional Director who will be working in this area also. Contract between Franklin Parish Police Jury and LSU Ag Center is as follows: Motion by Hendry and seconded by Guimbellot extending the contract between Franklin Parish Police Jury and LSU Ag Center at the same level of funding: Salaries - $1833.00 per month = $21,996 per year; telephone and copier - $32,339.63 per year not including utilities and office space through December 2010. Unanimously approved Any Visitors: Mary Ann Reed addressed the Jurors concerning an article in the Franklin Sun pertaining to the hiring policies of the Jury in regard to inmates, oil being buried at the Barn, inmates being issued cell phones, and no security at a shed that houses explosives. Discussion ensued sometimes heated between Mrs. Reed, members of the audience, and Jurors. Jurors wanted to know if Mrs. Reed had proof to the allegations she was making. Mrs. Reed stated it is up to the Police Jury to prove if these allegations are right or wrong and bring back the faith the people have in the Police Jury. She also stated she has been in touch with the EPA. The President stated if the EPA has a finding then the Jury will hear from them. He then asked if there were any other visitors. Patricia Hawsey came forward and expressed her concerns about a $200.00 inspection fee from Inspections Unlimited (Parish Inspector). Sam informed Ms. Hawsey that there was a misinterpretation of the law in 2007 that mobile homes were exempt from this rule. An Attorney General’s opinion stated that mobile home are to have an Electrical Inspection before power is turned on and we have to comply with this ruling. Another visitor Rev. Paul Stubbs addressed the Jurors. Rev. Stubbs said there was an issue at his Church behind the Horace White Learning Center which was on a Thursday night he spoke with someone from the Police Jury Friday morning the problem had been taken care. Rev. Stubbs also stated when issues are brought before the Jury the Jury should vote for the people of the Parish not a just a particular district. He asked to Jurors to stand for what is right and to serve all of Franklin Parish. Leodis Norman thanked the Jurors for their help in repairing the sewer leak on Fields Drive. Danny Massey of Delta Disposals talked to Jurors concerning adopting a resolution selling their contract to a new Company. The contract will not be changed. Motion by Parks and seconded by Guimbellot authorizing the consent of the Franklin Parish Police Jury to the transfer and assignment of that Collection and Disposal Agreement with CWI White Oaks Landfill, LLC, to Waste Connections, Inc. Unanimously approved Natures Acres Park: Motion by Scott and seconded by Parks to assist in meeting the 25% grant funding required match with equipment and labor at the Jury’s convenience. Unanimously approved Reeves of Fire District No. 4 told Jurors that Board would like to rescind motion of holding check for 30 days for First Alarm Fire. Reeves stated Mr. Young delivered the Truck and it is working good. Motion by Guimbellot and seconded by Johnson to accept the rescinding of Fire District 4 Board members not paying First Alarm for 30 days and to go ahead and release check to Mr. Roger Young of First Alarm Fire. Unanimously approved Leroy Scott talked about Alleys in the Abe Lincoln subdivision. He stated the alleys needed cleaning and that tractors couldn’t get back there because of various utility lines. Scott stated he talked with Sheriff Pylant and the Sheriff said he would let inmates go in and cut the grass with the Jury providing equipment and blades. Scott also stated he would like to send out letters to propert owners who are not keeping their properties mowed/cleaned. He said we have an Ordinance on this and we should give the property owner a certain amount of time to get the property mowed and if they don’t then the Jury will go in and mow and have it charged to their taxes. Scott advised Jurors that Park Supervisors Alvin White, Ester Credit Park and Maple Shaw, Ephron Rollins Park will work this summer. Both White and Shaw worked as Supervisors last summer. Scott further stated that both parks Ester Credit and Rollins Park need work done. Repair work done at the Parks will be taken from Park funds. Three quotes were brought in by Scott for work at both Parks. Motion by Harris and seconded by Guimbellot to accept the low quote of Johnny Howard in the amount of $5125 to do work at Ester Credit and Ephron Rollins Parks. Unanimously approved (This is for labor only with material and supplies coming from Park funds) Shelby Grant talked to Jurors about a problem he is having on Rayborn Road with a proprety owner who has taken some Police Jury right of way by putting a fence to close to the road. The property owner (Mr. Rayborn) says Mr. Grant has a ditch that’s higher than the road which is creating a drainage problem. Water stands in front of Mr. Grant’s house. Discussion ensued. It was suggested by Ricky to check with John Parker, Right of Way Agent on the right of way issue and with David Doughty Parish Attorney to write a letter to Mr. Rayborn. Blake Kramer of Franklin Medical Center gave a brief update on the Hospital. Kramer stated the Hospital finished in the black. Kramer asked the Jury to adopt a resolution to incur debt of up to $200,000.00 to purchase the rural health clinic in Newellton from Tensas Parish. Motion by Johnson and seconded by Harris approving the issuance of $200,000.00 in aggregate principal amount of Revenue Bonds by the Franklin Parish Hospital Service District No. 1, State of Louisiana to acquire and improve the healthcare facilities known as Newellton Health Clinic and Newellton Intensive Outpatient Psychiatric Clinic. Unanimously approved Motion by Guimbellot and seconded by Hendry approving equipment rental agreement with North Franklin Water Works for LCDBG LaStep No. 675280. Unanimously approved. Motion by Parks and seconded by Johnson to approve the sales agreement with H.D. Supply Water Works for LCDBG LaStep No. 675280. Unanimously approved Motion by Guimbellot and seconded by Parks to name private road off Lawson Road, Allenville Road. Unanimously approved This road is in a new development/subdivision waiting Jury approval after criteria is met. Allenville Road will be the only road in this new development which will serve about 24 (twenty-four) residents. Motion by Guimbellot and seconded by Parks to adopt a resolution in support of reduction of federal moratorium on deep-water drilling from 6 (six) months to no more than 30 (thirty) days. YEAS: Parks, Harris, Scott, Guimbellot, Hendry NAYS: Johnson ABSTAIN: None Superintendent’s Report: Motion by Hendry and seconded by Guimbellot to approve June work schedule presented by Greg Humphries, Superintendent which included Capital Improvement and Chip seal lists. Unanimously approved Greg also gave Jurors an update on FEMA projects. Supplemental Agenda: Kendricks Ferry Road. Will cover under Public Works Committee Report. Public Works Committee Report: Kendricks Ferry Road- There is an ongoing dispute about Kendricks Ferry Road being a parish road and the possibility of the private road leading to the Church being brought into the System. Nothing was settled on this matter. There was a lot of controversy on this Road several years ago. President stated to move on to the next item on the agenda. Strickland Road – Motion by Parks and seconded by Guimbellot to ask David Doughty to write a letter to the parties concerned authorizing the Jury to dig the ditch. Unanimously approved Ken McManus stated that it is almost time to apply for Water Enrichment funds. The Town of Wisner (Water Treatment Improvements) and the Village of Gilbert (Distribution Extension) would like to apply for funds through CWEF $25,000 each. Motion by Harris and seconded by Hendry approving the Town of Wisner and Village of Gilbert request of support and approval to apply for $40,000 for each municipality to help with water improvements and distribution extension. Unanimously approved (Town of Wisner and Village of Gilbert will apply for $25,000 each towards this project) Treasurer’s Report/Finance Committee Report: Sam advised that a midyear analysis will be provided at the next meeting. Old Business: Guimbellot stated there is a problem with 4-wheelers and to check with David Doughty about if any action can be taken. Guimbellot also wanted to know if we’ve come up with anything on stealing 911 signs. Sam advised him that David Doughty is checking to see if any civil action can be taken. Nolan Norman Park – Handicap rails in restrooms. Motion by Johnson and seconded by Harris to purchase materials and supplies (concrete) for handicap rails in the amount of $1130.00 and the Sheriff’s office furnish labor. Unanimously approved Leodis Norman stated they are having a fund raiser at the Park to purchase a sewer lift station. Norman asked for donations from the Jurors. Scott asked Ken McManus about the status of funds for Turkey Creek. Ken suggested sending a letter to Rep. Ellington to find out how much money is left. Scott said maybe some of these funds could be used to remove stumps at Turkey Creek. Charles Brass wanted to know the status of Ash Slough. Ken McManus stated that Bob Mears is working with this and there was enough storm damage to qualify for well over a million and a half in damage. There is also Ike/Gustav money available also. There being no further business to discuss, on a motion by Guimbellot and seconded by Hendry the meeting was unanimously approved adjourned. /s/Johnnie Wesley, Secretary /s/Ricky Campbell, President Franklin Parish Police Jury Franklin Parish Police Jury 7/28 1tb mmm Franklin Parish Police Jury Special Meeting June 24, 2010 Roll Call Prayer Pledge The Franklin Parish Police Jury met in Special Session on this the 24th day of June, 2010 in the Police Jury Meeting Room, Courthouse Building, Winnsboro, Louisiana with the following Jurors present: Honorable Ricky Campbell, Buddy Parks, James Harris, Leroy Scott, Harvey Guimbellot, and Troy Hendry. Jackie Johnson was absent from this meeting. Leroy Scott led the group in Prayer and the Pledge. Motion by Parks and seconded by Hendry to approve the agenda. Unanimously approved Van Thomas Subdivision: Discussion ensued – James Harris stated he was approached by Ms. Asberry Brass and Ms. Doris King regarding putting a Mobile Home behind the Anthony Flowers Road for Ms. Brass’s grandson Derrick Brass. Harris said he went to Hendry to find out what was needed to get the road in the system. Harris then relayed information to Ms. Brass and Ms. King who then along with Derrick Brass brought the road up to standards. Harris was not aware that this area was a subdivision and that certain criteria has to be meet in order to be permitted by the Health Unit and the Jury. Scott asked what the Jury needed to do to rectify this situation. Hendry stated that we should certainly stay within our legal bounds. Ricky stated that the Jury should meet with David Doughty Parish Attorney and Ken McManus, Engineer to see how to proceed with this matter. Motion by Harris and seconded by Parks to contact David Doughty, Parish Attorney and Ken McManus, Engineer to discuss the correct procedure on how to handle this matter.
