Pursuant to provisions of the laws of the State of Louisiana and particularly Title 30 of the Louisiana Revised Statutes of 1950 as amended, and provisions of Statewide Order 29-N-1 (LAC 43:XVII, Subpart 1), notice is hereby given that the Commissioner of Conservation will conduct a public hearing at 1:00 P.M., July 28, 2010.  The hearing will be held in the Franklin Parish Police Jury Meeting Room located in the Courthouse Building at 6558 Main Street, Winnsboro, Louisiana.
 
At such hearing, the Commissioner or his designated representative will give any interested person the opportunity to present testimony, facts, or oral or written comments relative to a draft permit (Order) concerning application from Atmos Pipeline and Storage, LLC of 13430 Northwest Freeway, Suite 700 Houston, TX, 77040  to convert, complete, and operate one Class III Brine Extraction (Solution Mining) Well in the Fort Necessity Salt Dome at its Fort Necessity Gas Storage Facility in Section 017, Township 12 North, Range 07 East near Winnsboro, LA, Franklin Parish.
 
The proposed well is identified as TCF Brine Mining Well No. 001,  Serial Number 237629.  Solution Mining is proposed to occur initially at an approximate depth of 3,700 to 5,400 feet below ground level.  The base of the lowermost underground source of drinking water near the facility location occurs at an approximate depth of 360 feet below ground level.
 
A copy of the draft permit (Order), a fact sheet, or information concerning the application may be obtained by writing Ms. Luzma Mata de Leder at the address below, by calling (225) 342-8639, or by e-mailing to Injection-Mining@La.gov.  Written comments concerning the application must be received by the Office of Conservation no later than 4:30 P.M., July 30, 2010.  Submit all comments to: Joseph S. COUNCIL MEETING
MAY 17, 2010
6:00 PM - CALL TO ORDER
The Board of Aldermen of the City of Winnsboro, Louisiana, met in regular session on Monday, May 17, 2010, at 6:00 PM at the Winnsboro City Court, 1308 Cornell Street, Winnsboro, Louisiana, with Mayor John Dumas presiding.

Prayer led by Richard Mahoney
Aldermen present: Richard Mahoney, Rosemary Davis, Betty Johnson, Craig Gill, Rex McCarthy
Absent: None
Motion by Johnson, second by Gill to approve the minutes of the regular session held on April 19, 2010. Unanimously approved.
FRANKLIN PARISH BLACK ACHIEVERS:
Ms. Jackie Johnson appeared on behalf of the Franklin Parish Black Achievers requesting a completion date on the repairs to the concession stand that had been flooded at the ballfield in Westside Park. Mayor Dumas informed the Board that Entergy had been contacted about moving the power lines in order to repair the concession and build a press box above. Rex McCarthy wanted to go on record in support of constructing new concession stand and press box.
PUBLIC HEARING AND ADOPTION OF ORDINANCE NO. 937:
AN ORDINANCE INCREASING THE MONTHLY PAY FOR THE BOARD OF ALDERMEN OF THE CITY OF WINNSBORO, LOUISIANA TO $300.00 PER MONTH EFFECTIVE WITH THE TERM BEGINNING ON JULY 1, 2010.
BE IT ORDAINED, by the Board of Aldermen of the City of Winnsboro, Louisiana convened in regular session on May 17, 2010, that they hereby set the base salary for each alderman at $300.00 per month effective with the term beginning July 1, 2010.
BE IT FURTHER ORDAINED, that the amount paid to each alderman that attends a special called meeting will remain at $50.00 per meeting.
After a public hearing was held on the above ordinance, the title having been read and the ordinance considered, a motion was made by McCarthy, second by Johnson and unanimously approved to adopt Ordinance No. 937, a recorded vote was taken and the following result was had:

Whereupon the presiding officer declared the above ordinance duly adopted on May 17, 2010.

INTRODUCE ORDINANCE ON BUDGET FOR 2010-2011:
Motion by Gill, second by McCarthy and unanimously approved to introduce an ordinance to adopt the budget for fiscal year ending June 30, 2011, for the City of Winnsboro, Louisiana.
LANNY RUNDELL – AIRPORT LEASE:
Motion by McCarthy, second by Johnson and unanimously approved to authorize John Dumas to sign airport lease contract with Lanny Rundell as Airport Manager.
RESOLUTION NO. 10-0501:
WHEREAS, the City of Winnsboro has received a grant from Delta Regional Authority in the amount of $110,000 to repair and improve the drive/road access area around Winnsboro Rubber Recycling, LLC located in the City of Winnsboro Industrial Park; and
WHEREAS, Winnsboro Rubber Recycling, LLC had originally divided the scope of work on this project into the three phases; and
WHEREAS, Phase 1 is the removal and replacement of approximately 18,267 square feet of concrete replacing a large portion of the area where trucks and equipment drive around the facility; and
WHEREAS, Phase 2 is the removal of approximately 3,087 square feet of concrete and construction of a truck dock on the facility; and
WHEREAS, Phase 3 is the removal and replacement of approximately 4,070 square feet of concrete to continue the repair of the area where trucks and equipment drive over the facility; and
WHEREAS, Winnsboro Rubber Recycling, LLC is requesting to continue with Phase 1 and expand Phase 3 to an area of approximately 10,974 square feet at this time; and
WHEREAS, additional funding will be pursued to complete Phase 2 after Phase 1 and 3 are completed.
NOW THEREFORE BE IT RESOLVED, that the Board of Aldermen of the City of Winnsboro, Louisiana, does hereby approve these changes.
BE IT FURTHER RESOLVED, that the Board of Aldermen does hereby authorize Mayor John Dumas to sign all necessary documents on this project until June 30, 2010 and beginning July 1, 2010 Mayor Jackie Johnson will be authorized to sign all documents on this project.
Motion by McCarthy, second by Mahoney and unanimously approved to adopt the above resolution on this 17th day of May 2010.

RESOLUTION NO. 10-0502:
WHEREAS, the City of Winnsboro has submitted an application for financial assistance through Delta Regional Authority Federal Grant Program; and
WHEREAS, the City has been awarded a grant in the amount of $110,000; and
WHEREAS, this grant is to reconstruct an access road, loading dock and parking area for Winnsboro Rubber Recycling, LLC located in the City of Winnsboro Industrial Park; and
WHEREAS, this project will require bids to be submitted and awarded by the Board of Aldermen.
THEREFORE BE IT RESOLVED by the Board of Aldermen of the City of Winnsboro, Louisiana, convened in regular session on this 17th day of Mayor, 2010, that they hereby authorize the Mayor to proceed with the advertisement of bids on this project.

POLICE CHIEF MONTHLY REPORT:
Chief Lester Thomas gave a monthly activity report for the City of Winnsboro Police Department. Motion by Mahoney, second by McCarthy to accept the report as given. Unanimously approved.
HIRING OF POLICE OFFICER:
Upon the recommendation of Chief Thomas a motion was made by Mahoney, second by McCarthy and unanimously approved to hire Sherry Pruitt as a post-certified police officer for the City of Winnsboro Police Department.
FIRE CHIEF MONTHLY REPORT:
Chief Truman Welch gave a monthly activity report for the City of Winnsboro Fire Department. Motion by Johnson, second by McCarthy to accept the fire report. Unanimously approved.
MONTHLY FINANCIAL REPORTS:

Motion by Gill, second by McCarthy to accept the monthly financial reports. Unanimously approved.
ADJOURNMENT:
There being no more business to come before the board at this time, a motion was made by Gill, second by Mahoney and unanimously approved that the meeting be adjourned.

TOWN OF WISNER
Regular Council Meeting
May 13, 2010

The Town Council of Wisner met in regular session on Thursday, May 13, 2010 at 6:30 p.m. at the Wisner Town Hall.
Present: Mayor Allyn Jean Luckett, Nettie B. Brown, Thomas Moore, and Mike Caldwell, Thomas Lemle and Marc McCarty.
Also present: Town Clerk, Police Chief and guests.
There being a quorum Mayor Luckett called the meeting proceedings to order.
The invocation was led by Thomas Lemle.
The Pledge of Allegiance was led by Mike Caldwell.
Mayor Luckett asked permission to change the agenda to allow for the town's auditor to give his report and get an update on the community center progress.
NEW BUSINESS:
Kenneth Folden gave an audit report for the town. He announced that everything was in order for the FY 2009/2010.
Thomas Magee representing McManus Engineers reported that construction for the community center would begin soon.
A proposed Budget Ordinance for the FY 2010/2011 was introduced. Motion by Mike Caldwell to accept the Proposed Budget Ordinance #06/10. Seconded by Marc McCarty. Proposed Budget Ordinance carried for FY 2010/2011.
OLD BUSINESS:
Motion by Thomas Lemle to approve minutes from previous meeting. Seconded by Thomas Moore. Motion carried.
The financial reports and expenditures were provided for the month of May. Nettie B. Brown made a motion to approve the financial reports. Marc McCarty seconded. Permission granted to pay all bills.

Chief Billy Cureington gave a report for the police department.
FIRE DEPT.

TO ISSUE NOT EXCEEDING $1,000,000
OF SEWER REVENUE BONDS OF THE
CITY OF WINNSBORO, PARISH OF FRANKLIN,
STATE OF LOUISIANA, SERIES 2010

PUBLIC NOTICE IS HEREBY GIVEN, pursuant to the provisions of a resolution adopted on April 19, 2010, by the Mayor and Board of Aldermen of the City of Winnsboro, State of Louisiana (the "Governing Authority"), acting as the governing authority of the City of Winnsboro, Parish of Franklin, State of Louisiana (the "City"), and in accordance with the provisions of Part XIII, Chapter 4, Title 39 of the Louisiana Revised Statutes of 1950, as amended (La. R.S. 39:1011, et seq.), and other constitutional statutory authority ("Act"), that the Governing Authority does hereby declare its intention to issue not exceeding ONE MILLION AND NO/100 DOLLARS ($1,000,000) of Sewer Revenue Bonds of the City, Series 2010 (the "Bonds"), in one or more series, the proceeds of which will be used to construct and acquire improvements, extensions and replacements to the sewer system of the City, including appurtenant equipment, accessories and properties, both personal and real, a work of public improvement for the City. The Bonds shall be limited and special revenue bonds of the City, secured by and payable in principal, interest and redemption premium, if any, solely from the income and revenues derived by the City from the operation of its sewer system (the "System"), after paying the reasonable and necessary costs and expenses of operating and maintaining the System. The proposed Bonds shall not be a charge on the other income and revenues of the City as prohibited under the provisions of Article VI, Section 37 of the Louisiana Constitution of 1974, nor shall they constitute an indebtedness or pledge of the general credit of the City. The Bonds will be exempt from all income taxation in the State of Louisiana and will be issued and authorized by ordinance of the Governing Authority and shall be of such series, bear such date, mature at such time or times (not to exceed twenty (20) years from their date of issuance), bear interest at such rate or rates (not exceeding three per centum (3%) per annum), be in such denomination or denominations, be in fully registered form, carry such registration privileges, be payable in such medium of payment and at such place or places, be subject to such terms of redemption and be entitled to such priorities on the income and revenues of the System as such resolution may provide.

The City will in such ordinance enter into such covenants with the future owner or owners of the Bonds as to the management and operation of the System, the imposition and collection of rates and charges for the services rendered thereby, the disposition of such fees and revenues, the issuance of future bonds and the creation of future liens and encumbrances against the System and the revenues therefrom, the carrying of insurance, the keeping of books and records, and other pertinent matters as may be deemed proper by the Governing Authority to assure the marketability of the Bonds, consistent with the provisions of the Act. Such ordinance will also include remedies in case of default, provisions for the issuance of parity bonds and such additional covenants, agreements and provisions as are judged advisable or necessary by said Governing Authority for the security of the owners of the Bonds, including sinking funds and reserves for the payment of principal and interest on the Bonds, and an adequate depreciation funds for those repairs and improvements to the System as may be necessary to assure adequate and efficient service to the public, all as provided by the Act.

The City further may determine in such ordinance to designate the Bonds as "Build America Bonds ("Direct Payment") pursuant to Section 54AA of the Internal Revenue Code. In such case, the Bonds will also be payable in part from a direct interest subsidy payments (if any) received from the United States of America by virtue of all or a portion of the Bonds being designated as "Build America Bonds" pursuant to the American Recovery and Reinvestment Act of 2009.

NOTICE IS HEREBY FURTHER GIVEN that the Bonds will be privately placed with the Louisiana Department of Environmental Quality (the "Department") pursuant to the Municipal Facilities Revolving Loan Fund established by the State of Louisiana, pursuant to Subchapter II, chapter 4 of Title 30 of the Louisiana Revised Statutes of 1950, as amended, specifically La. R.S. 30:2078, et seq.) in the custody of the Department, which is to be used for the purpose of providing financial assistance for the improvement of sewerage systems in the State. Notwithstanding the foregoing, the Bonds may be sold at public or private sale, as provided for in the Act and statutory authority.

NOTICE IS HEREBY FURTHER GIVEN that the Bonds will, before the delivery thereof, be approved by the State Bond Commission, Baton Rouge, Louisiana.

NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority will meet in open and public session on July 19, 2010, at six o'clock (6:00) p.m., at the City Hall, Winnsboro, Louisiana, to hear any objections to the proposed issuance of the Bonds, provided, however, if at such hearing a petition or petitions duly signed by electors of the City in an aggregate number not less than five percent (5%) of the number of the electors of the City voting in the last special or general election held in the City object to the issuance of the Bonds, then the Bonds shall not be issued until approved by a vote of a majority of the qualified electors of the City who vote at a special election held for that purpose in the manner provided by Title 18 of the Louisiana Revised Statutes of 1950. Any such petition shall be accompanied by a certificate of the Franklin Parish Registrar of Voters certifying that the signers of the petition (s) are registered electors of the City and the number of signers amounts to not less than five percent (5%) of the registered voters that voted in the last election held in the City, all as provided by the Act.
