REQUEST FOR RELEASE OF FUNDS On or about June 11, 2010 the Franklin Parish Police Jury will submit a request to the Louisiana Division of Administration for the release of Louisiana Community Development Block Grant Funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake a project known as FY 2009 LCDBG Public Facilities, for the purpose of Potable Water Improvements to the North Franklin Water Works. FINDING OF NO SIGNIFICANT IMPACT The Franklin Parish Police Jury has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. RELEASE OF FUNDS The Franklin Parish Police Jury certifies to Division of Administration that Ricky Campbell in his capacity as President consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Division of Administration approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Franklin Parish Police Jury to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The Division of Administration will consider objections to its release of funds and the Franklin Parish Police Jury’s certification received by June 28, 2010 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the Franklin Parish Police Jury approved by the Division of Administration; (b) the Franklin Parish Police Jury has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the Division of Administration; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Those present were as follows: Mayor Mike Stephens, Clerk Diane Parker, Alderman Kay Dunaway, Leo Miller and Louis Ezell. Also present were Joann Evans, Bill McLemore, Ty Britt, and citizens. CALL TO ORDER: Mayor Mike Stephens called the meeting to order. Bruce Lofton led in opening prayer. Diane Parker led in the pledge of allegiance. The Franklin Parish Police Jury met in Regular Session on Thursday, April 8, 2010 6:00 P.M. in Police Jury Meeting Room, Courthouse Building, Winnsboro, Louisiana with the following Jurors present: Honorable Ricky Campbell, President, K.W. “Buddy” Parks, James Harris, Leroy Scott, Harvey Guimbellot, and Troy Hendry. Jackie Johnson entered at 6:10 P.M. Leroy Scott led the group in Prayer and the Pledge. Motion by Leroy Scott and seconded by James Harris to approve the agenda. Unanimously approved Motion by Leroy Scott and seconded by Buddy Parks to approve the minutes of March 11, 2010 and March 25, 2010 meetings. David Doughty, Parish Attorney spoke to Jurors concerning Elam Sewer System. David told Jurors and the Elam Sewer Board the best and quickest way to get funds to expand or change the boundaries of the District is to apply through USDA. Elam Sewer Board did not purchase Washington Sewer System four (4) individual Board members did. He said the Board of Directors can acquire something within the District but can’t acquire something outside the District without approval from the Police Jury with a notice of intent to expand the boundaries. David also stated that Elam and Washington cannot be co-mingled. That’s mixing public funds with private funds and that’s a no – no under the law. If this has been done it needs to be corrected immediately. He said there can be all kinds of problems resulting from this. David stressed to the Board to get everything cleared up as soon as possible. Discussion ensued Leodis Norman, Elam Board member stated that the Elam bank account has been closed and the money in now is an account called the Greater Elam Sewer District. David told Norman mixing funds could be a huge problem. There could be ethic issues. He said forming a non- profit organization would be the best thing to do. Norman said he would re-open the account and put the money back in. David told the Board Members he would assist them any way he could. Sam stated the bills are behind and the Parish cannot legally pay them with funds being inter-mingled between the four (4) individuals who bought Washington Sewer. Sam said she needed a bank statement from the old account for audit purposes and since Willie Williams is a signer on the account, he could get a copy of a statement. Discussion ensued Motion by Guimbellot and seconded by Hendry that David Doughty would assist the Elam Sewer Board in following the proper procedures in getting the affairs of the Board back in order. Unanimously approved Motion by Guimbellot and seconded by Parks to adopt a resolution authorizing Ricky Campbell to enter into the first amendment to the Cooperative Endeavor Agreement with the Louisiana Division of Administration, Office of Community Development Disaster Recovery unit to secure community Development Block Grant (CDBG) Disaster Recovery funds and to sign any and all documents required in the submission of the required applications and subsequent administration of the Program. Campbell Road from the intersection of Curtis Road and R. Campbell Road north out of the Road Maintenance System. Unanimously approved Motion by Guimbellot and seconded by Hendry to adopt a resolution canvassing the returns and declaring the results of the special election held on March 27, 2010 to authorize the levy of special taxes therein. Unanimously approved Stuart Roane, Landscape Contractor talked to Jurors about a Parish Dumpsite. Roane stated that as a Contractor there is a problem of disposing of materials in Franklin Parish. He cited an example of a dumping site in Texas that was very accessible providing a collection point where you could easily dispose of materials. Roane suggested that the Parish should get a dumpsite where citizens could dispose of materials rather than dumping on the roads, ditches, etc. A committee of James Harris, Harvey Guimbellot, Leroy Scott, Stuart Roane, and Danny Massey (Delta Disposals Manager) will meet to discuss the pros and cons of a dumpsite in Franklin Parish. Two other citizens in the audience citied examples of dumpsites out of state. Ginger Boutwell of LSU Ag Center gave a brief update of activities going on at the Ag Center and passed out quarterly reports. She said the Book Shelf Club has grown to 99 families and also talked about ways to prevent triggers of Asthma. Ken McManus talked to Jurors about the state approved projects through Gustav/Ike. The projects are as follows: Ash Slough - $2,885,570.00; Turkey Creek - $1,390,574.00; Bayou Macon Cut Off No. 2 - $864,884.00; Wisner Community Center - $337,355.00; and Franklin Parish Public Works Building - $677,932.00; Boggy Bayou Drainage - $890,028.00; and North Franklin Water Works was awarded $726,350.00 for a 200,000 gallon elevated water tank. Ken encouraged Jurors to talk to Rep. Ellington and Senator Riser to see if they could get additional funding. He said a couple hundred thousand dollars could make a lot of difference. Cathy Mitchell of 826 Riley Road spoke to Jurors about replacing a culvert on her rental property. She said this request was made about 2½ years ago and the work still has not been done. Buddy assured her that her request has been turned in as we now have a new automated system in place. Superintendent’s Report: Motion by Parks and seconded by Harris to approve work schedule for April 2010 which includes Capital Improvement and Chip Seal List as presented by the Superintendent. Unanimously approved Greg also gave Jurors a handout with an update on FEMA projects. LGAP Grant: Greg stated that an application had been submitted for a LGAP Grant for a mini excavator ($85,000) and a new truck ($15,000) of which $48,600 was approved ($33,600 for the mini excavator and $15,000 for the truck). Bob Mears told Jurors they are two (2) options: (1) don’t use the money this year hold over apply again next year and add that money to it; (2) once funds are awarded request to combine the two (2) and void the one concerning the truck. Motion by Parks and seconded by Harris to use the combined amount of $48,600 to purchase the mini excavator. Unanimously approved Public Works Committee Report: Motion by Parks and seconded by Hendry to approve the Hardship Certification of Ottice Hatten at 2192 Highway 130, Winnsboro, LA. Unanimously approved Motion by Hendry and seconded by Guimbellot to approve the Hardship Certification of Louis R. Reed at 1105 Highway 857, Baskin, LA. Unanimously approved Purchasing Committee Report: Motion by Guimbellot and seconded by Hendry to advertise for a Double Drum Vibratory Roller. Unanimously approved Motion by Guimbellot and seconded by Hendry giving the Superintendent permission to exchange Parish equipment no longer needed for public purposes for a service truck. Unanimously approved Personnel Committee Report: Motion by Harris and seconded by Hendry to dismiss Allen Martin because his volume of work was not acceptable. Unanimously approved Motion by Parks and seconded by Hendry to hire George Brown and James Neilson as Truck Drivers at $10.00 per hour with benefits on a 6 months probationary period beginning April 19, 2010. Unanimously approved Johnson had questions about the starting pay for Truck Drivers. Unanimously approved The committee also recommended that the following necessary signs be posted stating: Rules, Hours, Stop sign on the left side of the road, and phone number. Motion by Hendry and seconded by Scott to charge $1.00 per person entering the Park for fishing only. Unanimously approved It was also discussed that everyone sign-in upon entering the park. This is for insurance liability purposes. The Superintendent was asked to have the ditches sloped and to look at the concrete around the lift station. Insurance Committee Report: Motion by Scott and seconded by Hendry to comply with the employee hand book and offer vision insurance at a rate of $6.14 per person per month. Unanimously approved Motion by Parks and seconded by Johnson to insure the values of the following structures at these amounts: Unanimously approved Abe Lincoln Community Center - $190,000; Storage building in rear - $3,000; and Grill on premises - $1,000. Turkey Creek Park Guard House - $30,000; Playground & Tables - $15,000; Pavilion - $10,000; Restrooms - $30,000; and Camp site Lights - $15,000. Unanimously approved Old Business: Harvey Guimbellot talked about the stealing of road signs and liter on Parish roads. He said something needs to be done about this. Sam stated that about $14,000 had been spent on replacing signs. Guimbellot asked Tom Bonnette with the Franklin Sun to write an article on both topics of discussion. Sam also stated that 911 signs not in place 50 days after resident receives them can be fined from $10.00 to $100.00. Motion by Parks and seconded by Guimbellot to adopt an ordinance stating there will be a $1000 fine for stealing signs. Unanimously approved Motion by: Parks Seconded by: Guimbellot Ordinance No. 3421 WHEREAS, road signs are very important to our citizens; and WHEREAS, road signs are much needed in emergency situation; WHEREAS, if road signs are not up for emergency personnel, valuable time could be lost trying to locate someone in dire need of assistance; WHEREAS, replacing these signs is very costly to the Parish and taxpayer; BE IT RESOLVED, that the Franklin Parish Police Jury will impose a fine up to $1,000.00 and jail time if anyone is caught tampering with or stealing road signs. Mears stated when he worked in Union Parish there was a Liter Court. Constables supplemented their incomes by handling the Court. The fine for littering was up to $200.00 if caught in Union Parish. Sam advised Jurors she talked to David Doughty, Parish Attorney about amending Hardship Certification Ordinance #3406. The amendments are listed in the following motion. Motion by Hendry and seconded by Johnson to amend the Hardship Ordinance #3406 as follows: change “owner of a home” to “owner/resident of a home; amend the application add a space to mark Owner/Resident and add a line for the owner to consent and add additional line for the resident’s consent. Unanimously approved New Business: Scott asked to reduce the speed limit on Deer Run Road from 25 mph to 15 mph. Motion by Johnson and seconded by Scott to reduce the speed limit from 25 mph to 15 mph on Deer Run Road. Unanimously approved Scott also asked Greg to inspect the ramp at Turkey Creek to the Gazebo. Discussion Motion by Scott and seconded by Johnson to inspect the ramp at Turkey Creek to the Gazebo for safety purposes. The Franklin Parish Police Jury met in Special Session on Friday, April 30, 2010 at 4:30 P.M. in the Police Jury Meeting Room, Courthouse Building, Winnsboro, Louisiana with the following Juror’s present: Honorable Ricky Campbell, President, K.W. “Buddy” Parks, James Harris, Leroy Scott, Harvey Guimbellot, and Troy Hendry. Jackie Johnson was absent from the meeting. Leroy Scott led the group in Prayer and the Pledge. Motion by Parks and seconded by Hendry to approve the agenda. Unanimously approved Motion by Scott and seconded by Guimbellot to advertise for a Shop Foreman and Mechanic Helper. Unanimously approved Motion by Scott and seconded by Parks approving advertisement of Accounts Payable Clerk. Unanimously approved Guimbellot had questions about pay and if a job description for the position has been done. Sam stated Jamie was hired through Workforce and started out at $8.00 per hour and a job description is given out with each application. Motion by Parks and seconded by Scott approving NaturChem spraying roadsides one (1) time. Unanimously approved Motion by Hendry and seconded by Guimbellot to accept the low bid of Equipment Resource Management (ERM) for a 48 month lease at $1380.00 per month with a $1.00 buy back option on a new Double Drum Vibratory Roller. Unanimously approved Motion by Hendry and seconded by Guimbellot approving the lease between Franklin Parish Police Jury and L.P. Brogal duly represented by Ted Oliver regarding Bakers Cut-off pending liability quote. If you would like to become a volunteer member of the Council, please stop by our office at 714 Adams Street, Winnsboro, and complete a membership card.
