COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS

This Notice shall satisfy the above-cited two separate but related procedural notification requirements.
REQUEST FOR RELEASE OF FUNDS
On or about August 14, 2009 the Franklin Parish Police Jury will submit a request to the Louisiana Division of Administration for the release of Louisiana Community Development Block Grant Funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake a project known as FY 2008 LCDBG Public Facilities LASTEP Project, for the purpose of Water Improvements.
FINDING OF NO SIGNIFICANT IMPACT
The Franklin Parish Police Jury has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Parish Courthouse, Winnsboro, Louisiana and may be examined or copied weekdays (8:30) A.M. to (4:00) P.M.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the President of the Franklin Parish Police Jury. All comments received by August 13, 2009 will be considered by the Franklin Parish Police Jury prior to authorizing submission of a request for release of funds. Commentors should specify which part of this Notice they are addressing.
RELEASE OF FUNDS
The Franklin Parish Police Jury certifies to Division of Administration that Harvey R. Guimbellot in his capacity as President consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Division of Administration approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Franklin Parish Police Jury to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
The Division of Administration will consider objections to its release of funds and the Franklin Parish Police Juryís certification received by August 31, 2009 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the Franklin Parish Police Jury approved by the Division of Administration; (b) the (RE) has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the Division of Administration; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the Division of Administration at P.O. Box 94095, Baton Rouge, La. 70804-9094. Potential objectors should contact the Division of Administration to verify the actual last day of the objection period.

The Public Section of the application will be available at the Office of Financial Institutions for public inspection during the regular business hours of 8:00 a.m. to 4:30 p.m., Monday through Friday.

NOTICE
The Franklin Parish Pupil Progression Plan for 2009-2010 is available to the public at the Franklin Parish School Board office during regular office hours (8:00 A.M. to 4:00 P.M.), Monday – Thursday. The plan will be available for review beginning Monday, July 20 and remain available through Thursday, July 30. All interested persons may present written comments during this review period.

Once this plan is approved by the Louisiana Board of Elementary and Secondary Education, it shall become the official Pupil Progression document for the 2009-2010 school year.

PUBLIC HEARING NOTICE
The Village of Gilbert will hold a Public Hearing on Thursday, August 13, 2009 at 6:30 P.M. at the Village Hall, 7564 Gilbert Street, Gilbert, Louisiana. The purpose of this hearing is to obtain views on housing and community development needs of the Village and to discuss the submission of an application for funding under the State of Louisiana FY 2010 - FY 2011 Louisiana Community Development Block Grant (LCDBG) Program. The following information will be discussed at said hearing:
A. The amount of funds available for proposed community development and housing activities;
B. The range of activities that may be undertaken, including the estimated amount proposed to be used for activities that will benefit persons of low and moderate income;
C. The plans of the Village for minimizing displacement as a result of activities assisted with such funds and the benefits to be provided to persons actually displaced as a result of such activities;
D. The Village’s prior performance of LCDBG Programs funded by the State of Louisiana.
Accommodations will be made for disabled and non-English speaking individuals provided that a three (3) day notice is received by the Village.
All residents, particularly persons of low-to-moderate income and residents of blighted areas, are encouraged to attend this hearing.
