SPECIAL MEETING
JUNE 22, 2009
The Village of Gilbert met in special called meeting on Monday, June 22, 2009 at 7:00 a.m. at the Gilbert City Hall.
Those present were as follows: Mayor Mike Stephens, Clerk Diane Parker, Assistant Clerk Jo Ann Evans, Alderman Kay Dunaway, Leo Miller, Absent was Louis Ezell.
CALL TO ORDER:
Mayor Mike Stephens called the special meeting to order.
PRAYER: Leo Miller led in opening prayer.
PLEDGE OF ALLEGIANCE: Diane Parker led in the pledge of allegiance.
ADOPT ORD. #311 BUDGET FOR FY 2009-2010:
Motion made by Leo Miller, seconded by Kay Dunaway to open public hearing for discussion on 2009-2010 budget. Motion carried. Discussion was held. Motion made by Kay Dunaway, seconded by Leo Miller to close public hearing. Motion carried. Motion made by Leo Miller, seconded by Kay Dunaway to adopt ordinance #311 budget for fiscal year 2009-2010. Motion carried.

VILLAGE OF GILBERT, LOUISIANA
ORDINANCE NO. 311
AN ORDINANCE TO ADOPT THE ANNUAL BUDGET OF REVENUE AND EXPENDITURES FOR THE FISCAL YEAR OF JULY 1, 2009 TO JUNE 30, 2010 FOR THE VILLAGE OF GILBERT.
BE IT ORDAINED, by the Board of Aldermen of the Village of Gilbert, Louisiana, in regular session convened on June 11, 2009 to adopt the following:
SECTION 1: Attached estimate of revenue as reflected in the consolidated statement, and such other fiscal exhibits and information as required by Section 1308 (D), Louisiana Local Government Budget Act, be and the same is hereby adopted to serve as the adopted budget of expenditures for the Village of Gilbert for the fiscal year July 1, 2009 to June 30, 2010, to wit:
General Fund Revenue: $272,000.00. Enterprise Fund Revenue: $124,360.00. Sales Tax Fund Revenue: $40,180.00.
SECTION 2: Attached estimate of expenditures as reflected in the consolidated statement, and such other fiscal exhibits and information as required by Section 1308 (D), Louisiana Local Government Budget Act, be and the same is hereby adopted to serve as the adopted budget of expenditures, to-wit: General Fund Expenditures: $259,705.00. Enterprise Fund Expenditures: $121,040.00. Sales Tax Fund Expenditures: $37,350.00.
SECTION 3: The adoption of the budget of expenditures as reflected in the attached adopted budget containing object of expenditures classification shall be declared to be the appropriation of the amounts set therein as established in each budget classification by object of expenditure. All salaries are hereby adopted by this section.
SECTION 4: The amounts appropriated for all accounts shall not exceed the amount fixed therefore in the budget of expenditures. Nothing contained herein shall prohibit this authority from adopting this budget or making an appropriation to and from contingent to be used in cases of emergency.
Any ordinances or parts of ordinance in conflict with this ordinance, to the extent of that conflict, are hereby repealed.
Said Ordinance been introduced on the 11th day of June, 2009, notice of public hearing having been published, and said public hearing have been held. The title having been read and the ordinance considered, on a motion by Leo Miller and seconded by Kay Dunaway, to adopt the ordinance on 22nd day of June, 2009. A recorded vote was taken and the following result was had:

FRANKLIN PARISH POLICE JURY
FLOOD PLAIN AND WETLAND EXPLANATION
The Franklin Parish Police Jury intends to carry out an action which may affect or be affected by the 100 year flood plain and wetlands and seeks to involve the public in the decision making process. The Franklin Parish Police Jury is proposing to upgrade 4 lift stations throughout the Police Jury. The proposed project will consist of the following:
Dobber Glass Road water system improvements:
Approximately 1,500LF of 3" diameter PVC water main
8 water services and related work
Jasper Wilson Road water system improvements:
Approximately 7,100LF of 3" diameter PVC water main
5 water services and related work.
Pursuant to Executive Orders 11988 and 11990, the Police Jury has determined this area to be in the one hundred year flood plain and potentially impacts wetlands.
The United States Department of the Army, Corps of Engineers stated in their letter dated March 16, 2009, that there appear to be jurisdictional areas in the project sites. These jurisdictional areas are subject to regulation pursuant to Section 10 of the Rivers and Harbors Act of 1899 and/or Section 404 of the Clean Water Act.
The proposed improvements conform to all applicable State and Federal floodplain protection standards and wetlands delineation, determination and mitigation. The other agency involved in this project is the U.S. Department of Housing and Urban Development and the United States Army, Corps of Engineers.
The project file with the details available is located at the Franklin Parish Courthouse, Winnsboro, LA 71295 and may be examined during the hours of 8:00 a.m. to 4:00 p.m. Monday through Friday. Comments may be submitted to the Police Jury until July 8, 2009.
Accommodations will be made for handicapped and non-English speaking persons provided those persons request said accommodations 3 days prior to the requested date of examination.
Those interested in submitting written comments, particularly those residents of slums and blighted areas, may do so to Mr. Harvey R. Guimbellot, President, Franklin Parish Police Jury, 6558 Main Street, Winnsboro, LA 71295. Any negative comments received will be forwarded to the State of Louisiana, Division of Administration.

The Town of Wisner is hereby notifying the citizens of Wisner that a public hearing will be held on the 9th day of July, 2009 at 6:30 P.M. at the Town Hall.
The purpose of the meeting is to discuss the submission of an application for project funding under the State of Louisiana FY 2010/2011 Community Development Block Grant (LCDBG) Program.
The following items will be discussed at the public hearing:
1). The amount of funds available for proposed community development and housing activities;
2). The range of activities that may be undertaken, including the estimated amount of funds proposed to be used for activities that will benefit persons of low and moderate income;
3). The plans of the Town for minimizing displacement of
person as a result of activities assisted with such funds and the benefits
to be provided to persons actually displaced as a result of such activities; and,
4). The Towns performance in prior LCDBG programs funded by the State of Louisiana, Division of Administration.
All citizens, particularly persons of low to moderate income and residents of blighted areas, are encouraged to submit their views and proposals regarding community development and housing needs. MEMORANDUM ORDER
Pending before the Court is a Motion for Temporary Restraining Order and Preliminary Injunction [Doc. No. 2] filed by Plaintiff ETC Tiger Pipeline LLC (“ETC Tiger”). ETC Tiger seeks authorization for immediate entry upon Defendants’ property to conduct surveying and other examinations of the property. Along with its motion for injunctive relief, ETC Tiger also filed a Rule to Show Cause [Doc. No. 2-17], seeking a hearing.
IT IS ORDERED to Rule to Show Cause is GRANTED to the extent that ETC Tiger requests a hearing. A hearing is set for July 6, 2009, at 10:00 a.m., at the United States District Courthouse, 201 Jackson Street, Monroe, Louisiana, before the undersigned. ETC Tiger shall appear and offer evidence to support its alleged need for immediate entry to the property of Defendants. Any Defendants who oppose ETC Tiger’s entry upon their property should also appear to contest the motion.
