Special Meeting
May 5, 2009 @ 8:30 A.M.
The Franklin Parish Police Jury met in special session on this the 5th day of May, 2009 at 8:30 A.M. in the Police Jury Meeting Room, Courthouse Building, Winnsboro, Louisiana with the following Jurors present: Honorable Harvey Guimbellot, Jackie Johnson, Ray Young, Ricky Campbell, and Troy Hendry.
Juror Ray Young led the group in Prayer and the Pledge.
Motion by Campbell and seconded by Hendry to approve the agenda. Unanimously approved
Jurors Leroy Scott and Buddy Parks were absent from the meeting.
Sam explained to Jurors and the Audience that the Wind Retrofitting Projects had gone over the allocated $1,000,000.00 (one million) budget. The projects had gone over by $238,706.00 which meant a project/projects would have to be cut.
Kevin Cobb of the Franklin Parish Sheriff’s Office told the Jury they could drop the Franklin Parish Sheriff’s office project. Lanny Johnson, Superintendent of Franklin Parish School Board told Jurors they could drop School Board’s project in exchange for blacktopping the around the football stadium. Discussion
Motion by Young and seconded by Campbell to allow Franklin Parish Sheriff’s Office and Franklin Parish School Board to drop their projects and fix the road at the High School that the Superintendent was talking about. Unanimously approved
There being no further business to discuss, on a motion by Campbell and seconded by Hendry to unanimously adjourn the meeting.

Regular Meeting
May 14, 2009 @ 6:00 P.M.
The Franklin Parish Police Jury met in Regular Session on this the 14th day of May, 2009 at 6:00 P.M. in the Police Jury Meeting Room, Courthouse Building, Winnsboro, Louisiana with the following Jurors present:  Honorable Harvey Guimbellot, Jackie Johnson, Ray Young, Leroy Scott, K.W. “Buddy” Parks, and Troy Hendry.
Juror Leroy Scott led the group in Prayer and the Pledge.
Motion by Johnson and seconded by Parks to approve the agenda.  Unanimously approved
Motion by Hendry and seconded by Johnson to approve April 9th, and April 23rd, 2009 meetings. Unanimously approved
Micah Touchet of NewBirth Creative talked to Jurors about designing a website for Turkey Creek Park.  He passed out some information with a fee schedule for the website.  The website will be used to get information on special events, availability of the Parks, hook-ups, different fishing sites, etc.
Motion by Johnson and seconded by Scott to hire Micah Touchet to design a website for Franklin Parish and Turkey Creek Park.  Unanimously approved
Jason Hardie, District Conservationist, NRCS, Winnsboro Office told Jurors to make sure before doing drainage projects to come by USDA to see if in compliance.  USDA participants (farmers) are to follow the law.
Robert Ulmer, Environmental Specialist with US Corps of Engineers told Jurors his agency handles permits for individual and public projects.  The Jury will need to get in touch with his office to let the Corps know of project plans.  This will determine the impact on wetlands issues.
Motion by Johnson and seconded by Young to appoint The Franklin Sun of the official journal.  Unanimously approved
Dr. Charles Reed told Jurors after 5 ½ years everything is reinstated and he has been exonerated of all charges filed against him by Franklin Medical Center.  The charges were false and no truth involved.  He said this matter can be put to rest. Discussion
Motion by Young and seconded by Scott to adopt a resolution on criteria to appoint engineering services to participate in the LCDBG Disaster Recovery Program administered by the Louisiana Office of Community Development Disaster Recovery Unit.  Unanimously approved
The selection committee will be Jackie Johnson, Buddy Parks, and Troy Hendry.
Laura Bradley with the LSU Ag Extension Office gave an update on 4-H activities for the month of May.
Motion by Young and seconded by Hendry permits for wells, irrigation pumps will no longer be charge a fee other permitting fees will remain the same.  Unanimously approved
Motion by Young and seconded by Johnson to allow Ann Johnson, Clerk of Court to keep income to make office improvements.  Unanimously approved
Motion by Young and seconded by Parks to approve a Cooperative Endeavor Agreement with the State of Louisiana asking assistance from CDBG Disaster Recovery Program through the parish implemented recovery program for damages suffered by the Parish as a result of Hurricanes Gustav and/or Ike.  Unanimously approved
Motion by Johnson and seconded by Young to adopt a resolution appointing Frye/Magee, LLC as the Administrative Consulting firm for the LCDBG Disaster Recovery Program for drainage improvement in Franklin Parish.
Jurors unanimously agreed that a Public Hearing should be advertised for additional funding.  Juror Johnson said everyone needs to be involved on how to utilize the funds.
Juror Johnson said he spoke with Mr. Ledell Heckard on the Washington Subdivision Sewer System.  Mr. Heckard said he can’t afford to operate the system.
Motion by Young and seconded by Parks to notify Mr. Buddy Smith with Health Department in Monroe to write letter to Mr. Heckard noting citation for not running the system properly.  Unanimously approved
Juror Johnson discussed Elam subdivision.  He said they should go into an agreement with Wisner Water System to collect payments.  State law requires that you connect to Water.
Motion by Johnson and seconded by Parks to go into a Cooperative Endeavor Agreement with Wisner Water System to collect payment.  Unanimously approved
Get in touch with David Doughty to prepare Cooperative Agreement.
Ken McManus, Engineer talked to Jurors briefly on Turkey Creek Park.  He also passed out some information to Jurors complete with drawings of the  Park.
Motion by Johnson and seconded by Parks to hire a Planner for grant money that’s coming in.  Unanimously approved
Sam to contact Eric Shaw on this matter.
The Recreation Committee will meet with Allen Butler and Daryl Enterkin to set date for Big Bass Tournament Monday, May 18, 2009 at 6:15 P.M. in the Conference room.  Other Recreation matters:  discussed getting Roy Cureington deputized, Sam to check on price for flags at Turkey Creek Park, and also discussed request to build a beach. This will have to go through the Corps of Engineer’s office.
Juror Johnson suggested that Jurors should meet and prepare and agenda for Legislative Day.
Motion by Parks and seconded by Hendry approving Sam Wiggin, Treasurer filing a financial statement for Fire District No. 2 and send a letter of intent that the financial statement was filed.  Unanimously approved
Superintendent’s Report:  Motion by Young and seconded by Hendry to approve Capital Outlay work schedule for April/May.  Unanimously approved
Greg also passed out information on an update for Disaster 1786.
Treasurers Report:  Sam told Jurors all bills were paid and she had some budget amendment that needed approval.  Motion by Parks and seconded by Young the following amendments to the budget would be approved.  Unanimously approved

Purchasing Committee Report: Motion by Hendry and seconded by Young to accept the bid of Scott Equipment for $3,600 for 36 months on the lease of a new 2009 Kobelco SK 260 LC Excavator. Unanimously approved.
Recreation Committee Report: Motion by Scott and seconded by Johnson to hire Maple Shaw —Ephron Rollins and Alvin White — Ester Credit Park to clean bathrooms, pick up trash/debris, etc., for 2 1/2 months for $500.00 each to be paid out the Recreation Fund.
Personnel Committee Report: New policies—Sam asked that the agenda and agenda items are to be given to the Jury and Administrative staff two (2) days prior to all meetings and when advertising for bids the Secretary must contact by mail or-email all eligible applicants within a 100 mile radius in addition to advertising.
Old Business: President said its Mosquito Season again. Ask Steve to order chemicals for spraying.

EARLY PUBLIC REVIEW NOTICE
The Franklin Parish Police Jury intends to carry out an action which may affect or be affected by the 100 year flood plain and wetlands and seeks to involve the public in the decision making process. The Franklin Parish Police Jury is proposing to make water system improvements to North Franklin Waterworks by constructing the following:

PERRYVILLE GAS STORAGE LLC
Take notice that on May 26, 2009, Perryville Gas Storage LLC (hereinafter referred to as “PERRYVILLE STORAGE”), Three Riverway, Suite 1350, Houston, Texas 77056, filed in Docket NO. CP09-418-000, pursuant to Section 7(c) of the Natural Gas Act and the Federal Energy Regulatory Commission’s (“FERC” or “Commission”) regulations thereunder, an application for a certificate of public convenience and necessity authorizing PERRYVILLE STORAGE to construct, own and operate a natural gas storage project to be located in Franklin and Richland Parishes, Louisiana (“Project”). Through its application, PERRYVILLE STORAGE also seeks approval of its Pro Forma Tariff and requests authorization to charge market-based rates for the proposed storage services. Additionally, PERRYVILLE STORAGE requests a blanket certificate authorizing PERRYVILLE STORAGE to engage in certain self-implementing routine activities under Part 157, Subpart F, of the Commission’s regulations and a blanket certificate authorizing PERRYVILLE STORAGE to provide open-access non-discriminatory firm and interruptible natural gas storage services and hub services on behalf of others with pre-granted abandonment of such services, under Part 284, Subpart G of the Commission’s regulations.
PERRYVILLE STORAGE proposes to construct, own and operation a high-deliverability natural gas storage project to be located in Franklin and Richland Parishes, Louisiana that will provide approximately fifteen (15) Bcf of working gas storage capacity in two (2) caverns. The Project will include interconnections with the interstate gas pipeline systems of CenterPoint Energy Gas Transmission and Columbia Gulf Transmission.

The sources of drinking water (both tap water and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs and wells. As water travels over the surface of land or through the ground, it dissolves naturally-occurring minerals and, in some cases, radioactive material, and can pick up substances resulting from the presence of animals or from human activity. Contaminants that may be present in source water include:
Microbial Contaminants - such as viruses and bacteria, which may come from sewage treatment plants, septic systems, agricultural livestock operations, and wildlife.
Inorganic Contaminants - such as salts and metals, which can be naturally-occurring or result from urban stormwater runoff, industrial, or domestic wastewater discharges, oil and gas production, mining or farming.
Pesticides and Herbicides - which may come from a variety of sources such as agriculture, urban stormwater runoff, and residential uses.
Organic Chemical Contaminants - including synthetic and volatile organic chemicals which are by-products of industrial processes and petroleum production, and can also come from gas stations, urban stormwater runoff, and septic systems.
Radioactive Contaminants - which can be naturally-occurring or be the result of oil and gas production and mining activities.
A Source Water Assessment Plan (SWAP) is now available from our office. This plan is an assessment of a delineated area around our listed sources through which contaminants, if present, could migrate and reach our source water. It also includes an inventory of potential sources of contamination within the delineated area, and a determination of the water supply’s susceptibility to contamination by the identified potential sources. According to the Source Water Assessment Plan, our water system had a susceptibility rating of “”. If you would like to review the Source Water Assessment Plan, please feel free to contact our office at the number provided in the following paragraph.
If present, elevated levels of lead can cause serious health problems, especially for pregnant women and young children. Lead in drinking water is primarily from materials and components associated with service lines and home plumbing. Turkey Creek Water System is responsible for providing high quality drinking water, but cannot control the variety of materials used in plumbing components. When your water has been sitting for several hours, you can minimize the potential for lead exposure by flushing your tap for 30 seconds 2 minutes before using water for drinking or cooking. If you are concerned about lead in your water, you may wish to have your water tested. Information on lead in drinking water, testing methods, and steps you can take to minimize exposure is available from the Safe Drinking Water Hotline or at http://www.epa.gov/safewater/lead.
In order to ensure that tap water is safe to drink, EPA prescribes regulations which limit the amount of certain contaminants in water provided by public water system. Food and Drug Administration regulations establish limits for contaminants in bottled water which must provide the same protection for public health. We are pleased to report that our drinking water is safe and meets Federal and State Requirements. We want our valued customers to be informed about their water utility. The Louisiana Department of Health and Hospitals - Office of Public Health routinely monitors for constituents in your drinking water according to Federal and State laws. The tables that follow show the results of our monitoring during the period of January 1st to December 31st, 2008. Drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. The presence of contaminants does not necessarily indicate that water poses a health risk.
In the tables below, you will find many terms and abbreviations you might not be familiar with. To help you better understand these terms, we’ve provided the following definitions:
Non-Detects (ND) - laboratory analysis indicates that the constituent is not present.
Parts per million (ppm) or Milligrams per liter (mg/L) - one part per million corresponds to one minute in two
years or a single penny in $10,000.
Parts per billion (PPB) or Micrograms per liter (ug/L) - one part per billion corresponds to one minute in 2,000 years, or a single penny in $10,000,000.
Parts per trillion (ppt) or Nanograms per liter (ng/L) - one part per trillion corresponds to one minute in 2,000,000 years, or a single penny in $10,000,000,000.
Parts per quadrillion (ppQ) or Picograms per liter (pg/L) - one part per quadrillion corresponds to one minute in 2,000,000,000 years or one penny in $10,000,000,000,000.
Picocuries per liter (pCi/L) - picocuries per liter is a measure of the radioactivity in water.
Millirems per year (mrem/yr) - measure of radiation absorbed by the body.
Million fibers per liter (MFL) - million fibers per liter is a measure of the presence of asbestos fibers that are longer than 10 micrometers.
Nephelometric Turbidity Unit (NTU) - nephelometric turbidity unit is a measure of the clarity of water. Turbidity in excess of 5 NTU is just noticeable to the average person.
Variances & Exemptions (V & E) - State or EPA permission not to meet MCL or a treatment technique under certain conditions.
Action level (AL) - the concentration of a contaminant that, if exceeded, triggers treatment or other requirements that a water system must follow.
Treatment technique (TT) - a treatment technique is a required process intended to reduce the level of a contaminant in drinking water.
Maximum contaminant level (MCL) - the “Maximum Allowed” MCL is the highest level of a contaminant that is allowed in drinking water. MCL’s are set as close to the MCLG’s as feasible using the best available treatment technology.
Maximum contaminant level goal (MCLG) - the “Goal” is the level of a contaminant in drinking water below which there is no known or expected risk to human health. MCLG’s allow for a margin of safety.
Maximum residual disinfectant level (MRDL) - The highest level of a disinfectant allowed in drinking water. There is convincing evidence that addition of a disinfectant is necessary for control of microbial contaminants.
Maximum residual disinfectant level goal (MRDLG) - The level of a drinking water disinfectant below which there is no known or expected risk to health. MRDLGs do not reflect the benefits of the use of disinfectants to control microbial contaminants.
During the period covered by this report we had the below noted violations of drinking water regulations.

Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. EPA/CDC guidelines on appropriate means to lessen the risk of infection by Cryptosporidium and other microbial contaminants are available from the Safe Drinking Water Hotline (800-426-4791).

The TURKEY CREEK WATER SYSTEM water system is required to monitor for Disinfection By-Products in accordance with the Federal Stage 1 Disinfectant/Disinfection By-Products (DDBP) Rule (40 CFR 141.132(b)(l)(ii)). Systems conducting Stage 1 DDBP monitoring are required under (141.153(d)(4)) to include the Total Trihalomethanes (TTHMs) and Haloacetic Acids (HAA5s) highest running annual average (RAA) and the range the last monitoring year within their annual Consumer Confidence Report (CCR).
The TURKEY CREEK WATER SYSTEM water system shall utilize TTHMs and HAA5s results for all compliance samples collected from 2nd quarter of 2007 to the 4th quarter of 2008 to determine the highest running annual average. If the water system monitors less than quarterly (i.e, annually or triennially), use the most recent results as the RAAs.
The TURKEY CREEK WATER SYSTEM water system shall utilize the TTHMs and H AA5s results for all compliance samples collected within the last monitoring year to determine the range (minimum and maximum value) for the entire system.

All bids must be accompanied by bid security equal to ten percent (10%) of the base bid and all additive alternates, and must be in the form of a certified check, cashier’s check or bid bond written by a company licensed to do business in Louisiana, countersigned by a person who is under contract with the surety company or bond issuer as a licensed agent in this State and who is residing in this state. No Bid Bond indicating an obligation of less than ten percent (10%) by any method is acceptable.
The successful Bidder will be required to furnish a performance and payment bond written by a company licensed to do business in Louisiana, and shall be countersigned by a person who is contracted with the surety company or bond issuer as agent of the company or issuer, and who is licensed as an insurance agent in this State, and who is residing in this State, in an amount equal to the 100% of the contract amount.
No bid may be withdrawn for a period of thirty (30) days after receipt of bids, except under the provisions of Act 111 of 1983.
A mandatory pre-bid conference will be June 18, 2009, at 12:00 P.M. at the job site at the Winnsboro Housing Authority Office. Bids shall be accepted only from Contractors who attend the Pre-bid Conference. Subcontractors are welcome to attend. Bids shall be accepted from prime bidders who are licensed in Louisiana under the classification of Building Construction.
The Owner reserves the right to reject any and all bids.
