CITY OF WINNSBORO
ORDINANCE NO. 925
An Ordinance setting the franchise fee to be paid by those entities providing cable or video service within the City’s municipal limits under a state - granted franchise authority and otherwise providing with respect thereto.
WHEREAS, pursuant to the provisions of the Consumer Choice for Television Act of 2008, codified at LSA-RS. 45:1361 et seq, any person or entity desiring to provide cable or video services within the City of Winnsboro may do so by obtaining a state-issued certificate of franchise authority;
WHEREAS, pursuant to the provisions of LSA-R.S. 45:1366, the holder of a state-issued certificate of franchise authority for cable or video service is required to pay a franchise fee to a municipality in which it operates upon the passage of an ordinance by municipality setting such a fee; and
WHEREAS, there are persons or entities which operate or desire to operate cable or video services within the City’s municipal limits.
BE IT THEREFORE ordained by the City Council of the City of Winnsboro, State of Louisiana, that all persons or entities providing cable or video services to the citizens of the City of Winnsboro pursuant to a state-issued certificate of franchise authority as provided in LSA-R.S. 45:1361 et seq shall, pursuant to the provisions of LSA-R.S. 45:1366, pay the City of Winnsboro a franchise fee equal to 5% of the cable or video service provider’s gross revenues, as that term is defined by the “Consumer Choice for Television Act of 2008,” derived from operations within the City’s municipal limits.
BE IT FURTHER RESOLVED, that all ordinances and resolutions in conflict herewith are hereby repealed, except those approving any cable or video franchise agreement in force and effect between the City and any cable or video service provider.
The foregoing proposed Ordinance approved and adopted this 15th day of September 2008 by the following vote:
Yeas: Mahoney, Dumas, Johnson, Gill, McCarthy

CITY OF WINNSBORO
ORDINANCE NO. 926
An Ordinance requiring the payment of public, educational, governmental access programming support to the City of Winnsboro by cable or video service providers operating within the City’s municipal limits under a state-issued certificate of franchise authority and otherwise providing with respect thereto.
WHEREAS, pursuant to the provisions of the Consumer Choice for Television Act of 2008, codified at LSA-RS. 45:1361 et seq, any person or entity desiring to provide cable or video services within the City of Winnsboro may do so by obtaining a state-issued certificate of franchise authority;
WHEREAS, the City of Winnsboro has requested those entities providing cable or video services within the municipal limits of the City of Winnsboro to provide public, educational, and governmental access programming, streams, or channels (“PEG”) and desires to collect PEG access support from these cable or video service providers pursuant to the provisions of LSA-R.S.45:1370
BE IT THEREFORE ordained by the City Council of the City of Winnsboro, State of Louisiana, that pursuant to the provisions of LSA-R.S.45:1361 et seq, providers of cable or video services holding a state-issued certificate of franchise authority as provided in LSA-R.S. 45:1361 et seq and operating within the City’s municipal limits shall pay to the City of Winnsboro an amount equal to one half percent of the gross revenues, as that term is defined by the “Consumer Choice for Television Act of 2008,” derived from operations within the City’s municipal limits.
BE IT FURTHER RESOLVED, that all ordinances and resolutions in conflict herewith are hereby repealed, except those approving any cable or video franchise agreement in force and effect between the City and any cable or video service provider.

TOWN OF WISNER
REGULAR COUNCIL MEETING
SEPT. 11, 2008
The Town Council of Wisner met in regular session on Thursday, September 11, 2008 at 6:30 p.m. at the Wisner Town Hall.
Present: Mayor Allyn Jean Luckett, Thomas Lemle, Thomas Moore, Nettie B. Brown, Marc McCarty and Bobby Blount.
Also present: Town Clerk, and guests.
There being a quorum the meeting was called to order by Mayor Luckett.
The invocation was led by Marc McCarty.
The Pledge of Allegiance was led by Thomas Moore.
Mayor Luckett opened the meeting with a thank you to everyone for helping with the clean-up after the storm.
Marc McCarty made a motion to accept the minutes from previous meeting.
Nettie B. Brown seconded. Motion carried.
The financial reports and expenditures were provided for the month of August.
Mayor Luckett asked permission to pay all bills.
Thomas Lemle made a motion to accept the financial reports and pay all bills.
Seconded by Nettie B. Brown. Motion carried.
NEW BUSINESS:
DEPARTMENT REPORTS:
Bobby Rushing gave a report for the maintenance department.
Myles Kiper gave a report for the fire department.
Billy Cureington gave a report for the police department and asked if he could hire Chad McMurray as a part-time officer.
Marc McCarty made a motion to hire Chad McMurray as a part-time officer.
The clerk was instructed to open sealed bids. The bid for the Crown Victoria was awarded to Viencent Smith.
Mayor Luckett gave an update on current projects.
FURTHER BUSINESS:
Guests complained that the school bus was still not able to turn around on Wall St. because of the trees and culvert.
Marc McCarty made a motion to trim the trees and extend the culvert on town’s property for the school bus accessibility.
Bobby Blount seconded. Motion carried.
With no further business Marc McCarty made a motion to adjourn.
