B.J 2008 - 89 RESCHEDULING OF THE 2008 PRlMAR Y, GENERAL AND PROPOSITION ELECTIONS POSTPONED BY BJ 08-85 WHEREAS, “in order to ensure maximum citizen participation in the electoral process and provide a safe and orderly procedure for persons seeking to qualify or exercise their right to vote, to minil’lize to whatever degree possible a person’s exposure to danger during declared states of emergency. and to protect the integrity of the electoral process,” the Louisiana Legislature enacted R.S. 18:40 1.1 to provide “a procedure for the emergency suspension or delay and rescheduling of absentee voting in person and elections”; WHEREAS, on September 2, 2008, pursuant to the provisions of R.S. 18:401.1 (B), the Secretary of State certified to the Governor that as a result of Hurricane Gustava state of emergency exists in the parishes of Allen, Avoyelles, Beauregard, Bienville, Bossier, Caddo, Caldwell, Catahoula, Claiborne, Concordia, DeSoto, East Carroll, Evangeline, Franklin, Grant, Iberville, Jackson, Jefferson, LaSalle, Lincoln, Madison, Morehouse, Natchitoches, Orleans, Ouachita, Pointe Coupee, Rapides, Red River, Richland, Sabine, St. Charles, St. Landry, St. Tammany, Tangipahoa, Tensas, Union, Vernon, Washington, Webster, West Carroll and Winn; WHEREAS, pursuant to the Secretary of State’s September 2, 2008 cel1ification, the following elections were postponed by Executive Order No. BJ 08-85: the elections for U.S. Representatives, 1st Congressional District - Democratic Party in the Parishes of Jefferson, Orleans, St. Charles, St. Tammany, Tangipahoa and Washington; U.S. Representatives, 2nd Congressional District -Democratic Party in the Parishes of Jefferson and Orleans; U.S. Representatives, 4th Congressional District - Democratic Party and U.S. Representatives, 4th Congressional District - Republican Party in the Parishes of Allen, Beauregard, Bienville, Bossier, Caddo. Claiborne, DeSoto. Grant, Natchitoches, Red River, Sabine, Vernon. and Webster; U.S. Representatives, 5th Congressional District - Republican Party in the Parishes of Allen, Avoyelles, Caldwell, Catahoula, Concordia, East Carroll, Evangeline, Franklin. Iberville, Jackson, LaSalle, Lincoln. Madison, Morehouse, Ouachita, Pointe Coupee, Rapides, Richland, Tensas, Union, West Carroll and Winn; Ivan Fire Protection District NO.3 in the Parish of Bossier; and Prairie Bass Gravity Drainage District in the Parish of St. Landry, all scheduled for September 6. 2008: and WHEREAS, on September 4. 2008, the Secretary of State recommended that an executive order be issued to reschedule the elections postponed by Executive Order No. BJ 08-85; NOW THEREFORE, I, BOBBY JINDAL, Governor of the state of Louisiana. by virtue of the authority vested by the Constitution and the laws of the state of Louisiana, do hereby order and direct as follows: SECTION I: Under the authority of R.S. 18:40 i.1 (B) and based on the September 2, 2008 certification of the secretary of state that a state of emergcncy exists in the parishes of Allen, Avoyelles, Beauregard, Bienville, Bossier, Caddo, Caldwell, Catahoula, Claiborne, Concordia, DeSoto, East Carroll, Evangeline, Franklin, Grant, Iberville, Jackson, Jefferson, LaSalle, Lincoln, Madison, Morehouse, Natchitoches, Orleans, Ouachita, Pointe Coupee, Rapides, Red River, Richland, Sabine, St. Charles, St. Landry, St. Tammany, Tangipahoa, Tensas, Union, Vernon, Washington, Webster, West Carroll and Winn and the September 4,2008 recommendation that the postponed elections be rescheduled the elections postponed by Executive Order No. B.I 08-85 are rescheduled as follows: A. Present: Mayor Billy Joe Cupp and council members Mike Ballard, Wanda Carroll and Larry LaBorde. Also present: Town Clerk and guests. There being a quorum, the meeting was called to order. The pledge of allegiance and prayer were led by Mayor Billy Joe Cupp. The Town clerk read minutes from the previous meeting. Larry LaBorde made a motion to accept minutes as read. Mike Ballard seconded. 3 yeas 0 nays. 0 absent. NEW BUSINESS: Mayor Billy Joe Cupp introduced Wanda Carroll as the new alderman. The cash flow report was provided for the month of August. Park repairs have been completed. POLICE DEPARTMENT: Assistant Chief Don Moore announced that everything is running smoothly. FIRE DEPARTMENT: Fire Chief Bobby Fife requested a new generator for the Pumper Truck. Firemen plan to participate in Fire Prevention week at Baskin School with Pre-K through 3rd grade. Dani Dean, Town Clerk Billy Joe Cupp, Mayor 9/17 1tb mmm Franklin Parish Police Jury Regular Meeting August 14, 2008 The Franklin Parish Police Jury met in regular session on this 14th day of August at 6:00 P.M. in the Police Jury Meeting Room, Courthouse Building, Winnsboro, Louisiana with the following members present: Honorable Harvey Guimbellot, Jackie Johnson, Ray Young, K.W. “Buddy” Parks, Ricky Campbell, and Troy Hendry. Juror Leroy Scott entered at 6:05 P.M. Juror Ray Young led the group in Prayer and the Pledge. Motion by Campbell and seconded by Hendry to approve the agenda. Unanimously approved Motion by Hendry and seconded by Campbell to approve the minutes of the July 10th, July 16th, and July 22nd, 2008 meetings. Unanimously approved. No action was taken on closing Brook’s Landing Road. There was discussion between Juror’s and the audience on getting additional funding to complete Union Church Road. The Juror’s decided that they should get in touch with Senator Neil Riser, Congressman Rodney Alexander, and Representative Noble Ellington to see if they could secure additional funding for the road. President Guimbellot discussed the theft of 911 signs and the seriousness of this. Guimbellot along with the other Juror’s passed a resolution on stealing and damaging signs. Motion by Young and seconded by Campbell to impose a $1,000.00 fine for anyone caught stealing or damaging road signs and looks into the rest of it as far as the reward is concerned. Unanimously approved President Guimbellot said he had talked with the Sheriff about a mandatory 3 day jail stay. Carol Pinnell-Alison of LSU Ag Center presented information to Jurors on Statewide Summary of Ag Impact in State of Louisiana and Catfish Production and the number of producers we have. She also gave an update on up-coming activities. David Doughty, Parish Attorney discussed vendor pricing due to rising fuel cost. David suggested putting an escalation clause or a shorter bid cycle. He also said that the bidder should honor their bid for one year. David and Greg are to schedule a meeting with vendors/bidders and discuss the bids. Greg Blount with IBTS appeared before the Juror’s. President Guimbellot, Parks, and Campbell said they have gotten complaints from citizens of Franklin Parish about the strict enforcement of building codes. None of the citizens making the complaints were present at the meeting. Greg said without specific instances he could not take any corrective action. Greg Blount and Larry Walters are scheduled to meet a later date to discuss this matter with citizen’s who have any complaints. Motion by Campbell and seconded by Parks approving Johnnie Wesley, Secretary to attend Organization of Parish Administrator’s Conference in Houma, Louisiana August 20-22, 2008. Unanimously approved Motion by Scott and seconded by Young to change status of employee Chris Hunt from part-time to regular full-time employee after he graduates from ULM in December, 2008. Unanimously approved John Lawrence extended appreciation to the President and the entire Jury plus staff on behalf of the citizens of the Bush Road and Doyle Road community for what is being done for them. Ruby Posey addressed the Juror’s on the next phase of completing Turkey Creek Dam. Juror Campbell said he would like to see the dam fixed. He said no funds had been earmarked for this project. There was discussion between Juror’s and audience. It was decided that the Jury would invite Senator Neil Riser and Representative Noble Ellington to the September 11, 2008 meeting to discuss this matter. Motion by Campbell and seconded by Parks to permanently change polling place at Franklin Parish High School from the Cafeteria to the Junior ROTC Building. Unanimously approved President Guimbellot said that the Jury purchased a cooler for the Franklin Parish Community Development Center to store perishable items such as cheese, butter, etc. The cooler has not been used since it was purchased. John Lawrence who is a Board member said he would check into this matter. Motion by Campbell and seconded by Scott to send a letter to a property owner asking them to cut their grass after receiving a complaint from Velda Pleasant. Unanimously approved Juror Scott asked Greg to post load limit signs on Guice Road and check the signs. Juror’s gave their approval for representatives from AFLAC to address employees regarding supplemental insurance. Superintendent Report: Motion by Hendry and seconded by Parks to accept the work schedule for August/September as submitted by the Superintendent. Unanimously approved Motion by Hendry and seconded by Parks to approve the request from the Village of Baskin to repair pot holes on Dobber Glass Road. Unanimously approved Greg also gave information to the Juror’s on the Off- System Highway Bridge Program and DOTD projects in Franklin Parish. Treasurer’s Report: Larry passed out a Financial Report to all Juror’s and said that all bills were paid were paid for the month of August. Public Works Committee Report: Motion by Hendry and seconded by Parks surplus equipment to be haul for scrap iron. Unanimously approved Motion by Campbell and seconded by Hendry to send resolution approving proposed alignment and speed limit change, which requires more right of way as requested by Gary C. Pentek, Plan Development Engineer DOTD. Unanimously approved Motion by Campbell and seconded by Parks to pass resolution to apply for 2008-2009 L-GAP for $67,000 to replace sewer pump in Abe Lincoln community. Unanimously approved Motion by Parks and seconded by Campbell to get letter of support from Senator Riser and Representative Ellington on resolution. Unanimously approved Motion by Hendry and seconded by Scott to apply for the Recreational Trail Program and appoint some to complete the paperwork necessary for the completion of the project. Purchasing Committee Report: Greg submitted quote from First Alarm Fire Equipment, Inc., in the amount of $1975.00 to repair fire truck in Wisner. Personnel Committee Report: Motion by Hendry and seconded by Parks to increase salary of Mick Freeman from $8.50 to $9.50 per hour (6 months probation period over). Unanimously approved Motion by Parks and seconded by Johnson to approve request from Benton Moore, Transportation Manager at Franklin Parish School Board to patch pot holes in parking lots at Fort Necessity, Baskin, and Horace G. White Learning Center. Unanimously approved Motion by Johnson and seconded by Parks to purchase IWORQ software program. Unanimously approved Discussion of donating or selling fire trucks owned by the Police Jury to fire districts who maintain them was tabled. No action was taken on adjudication of old Lachney service station property in Gilbert to Police Jury. Present: Mayor Allyn Jean Luckett, Thomas Lemle, Thomas Moore, Nettie B. Brown and Bobby Blount. Absent: Marc McCarty. Also present: Town Clerk, and guests. There being a quorum the meeting was called to order by Mayor Luckett. The invocation was led by Bobby Blount. The Pledge of Allegiance was led by Thomas Lemle. Motion by Thomas Lemle to accept minutes from previous month. Seconded by Thomas Moore. Motion carried. The financial reports and expenditures were provided for the month of July. Mayor Luckett asked permission to pay all bills. Bobby Blount made a motion to accept the financial report and pay all bills. Seconded by Nettie B. Brown. Motion carried. NEW BUSINESS: Mayor Luckett gave an update on the current projects. Council members were informed that the town would be applying for a grant from the Local Government Assistance Program. Thomas Moore introduced an ordinance to compensate the mayor and aldermen. Thomas Lemle made a motion to accept the ordinance. Seconded by Nettie B. Brown. Abstained by Bobby Blount.
