Regular Meeting
April 10, 2008
The Franklin Parish Police Jury met in Regular Session on this 10th day of April, 2008 at 6:00 P.M. in the Police Jury meeting room, Courthouse Building, Winnsboro, Louisiana with the following members present: Honorable Harvey Guimbellot, Jackie Johnson, Leroy Scott, Ray Young, K.W. “Buddy” Parks, Ricky Campbell, and Troy Hendry. Also present were Larry Clark, Treasurer, Hope Young with the Franklin Sun, and Mayor Jack Hammonds.
Juror Scott led the group in Prayer and the Pledge.
Motion by Hendry and seconded by Campbell to approve the agenda.
Juror Young said that he would like to amend the agenda. he said he didn’t like amending the agenda if it is a controversial subject. If any person disagrees, he will withdraw the motion. Want everyone to be comfortable with it or he will put if off until another time. Juror Young offered a motion to discuss Home Rule charter. Juror Johnson said he felt uncomfortable. Juror withdrew his motion.
Motion by Campbell and seconded to approve the minutes of March 13, and March 24 meetings. Unanimously approved
Don Middleton, with the Crowville Fire District appeared before the Jurors to discuss and seek approval to buy a fire truck for Crowville Fire Station. Also present were Kelly Clark and John Shelton. Middleton stated that the District received a grant from FEMA for $80,000.00. He said that the District had about $35,000.00. There were a total of five (5) bidders. The lowest bidder was Ferrara Fire Apparatus with a cost $172,900.00. Juror Johnson said that the Crowville Fire District should be commended. He said that they were one of the first fire Districts that we had in Franklin Parish. Juror Johnson said that Crowville has been an example as to how a Fire District should work and that the Jury should provide any type of assistance to them toward their efforts.
Motion by Hendry and seconded by Scott giving Crowville Fire District approval to purchase a Fire Truck. Unanimously approved
Larry Clark, Treasurer read a letter from the Attorney General‚s office regarding Administrative fees. The Attorney General office said that Administrative fees can not be taken out of each fund. President Guimbellot said that we should take this to the citizens of Franklin Parish for a vote. Juror Johnson agreed and said that we could take the administrative cost from each fund and distribute the money to enable the Police Jury to operate in an efficient manner.
Motion by Johnson and seconded by Hendry to get the concensus to the citizens of Franklin Parish on whether or not Administrative fees can be collected from each fund. Unanimously approved.
Larry also talked to Jurors about Polling Places that need to be handicap accessible. He said that the state would reimburse the Jury for repairs. Juror Johnson said that we would need some type of agreement with the owner’s of the buildings since the Jury didn’t own any of these buildings. Juror Scott asked Greg if he could go around to all polling places and check and see what repairs needed to be done. Woodmen of the World will need the most repairs.
Motion by Scott and seconded by Johnson Greg check to see what repairs need to be made to make all polling places handicap accessible. Unanimously approved
Ginger Boutwell with the LSU Extension office gave Jurors and update on activities happening during the month of April.
John Lawrence asked Greg about the scheduling of hard surfaced roads to see where the South end of Bush Road is on the list.
Bessie Mathis from the Abe Lincoln Subdivision addressed Jurors concerning a ditch that runs along side of her house. She said that the ditch has an order. Also a neighbor has dog pin with several dogs in it. She didn’t know exactly if the odor was coming from the ditch or the dog pin. Ken McManus said that if it is a sewer problem, she should contact the Sewer Board. President Guimbellot said to contact the Health Department. Mrs. Mathis also wanted to know when her street was scheduled for black topping. Greg said that all roads the Abe Lincoln Subdivision should be black topped by August.
Ms. Melissa Robinson had concerns about mowing the Park at the Ephron Rollins Park.
Juror Young wanted to know if we are mowing all Parks in the Parish. Juror Johnson said just Parish owned .
Horace Robinson said he was not here tonight to complain but he was pleased with the way things are going. He said that he had good responses when he had problems.
Motion by Campbell and seconded by Parks that Larry Clark would be Administrative Assistant to Bill Mulkey, Director of Homeland Security. Unanimously approved
Larry talked to Jurors about $15,000,000.00 funds being available for safety innovation program. He said that there are electronic devices available to collect data. There were a few places in the Parish where the devices could be used. They are: New Zion where it intersects with Highway 4, Loflin Road where it intersects with Highway 135. Several accidents have happened at these locations. Juror Scott asked Larry to check into this and get back with Jurors at a later time.
Juror Scott said that he and Juror Johnson had been approached by the Black Achievers Association concerning building a Gazebo at Westside Park. The cost of the materials would be $800.00. Juror Scott said that he would donate $400.00 from his Park fund and Juror Johnson said he would donate $400.00 from his Park fund.
Juror Young said the following: “We need to be more in the business of doing things that would qualify as needs in the Parish as a Jury. I don’t believe I quite see the need of a Gazebo. We help build the fence and I can see the practicality of that, but I can’t see the practicality of this Jury taking on the duty of building a Gazebo at a Park. I can’t see that.”
Juror Scott said: “It’s a lot of things we can say we don’t need until you get into a situation. The Black Achievers Association brings in a lot of money and people in the Parish. Winnsboro is a beautiful city. Anytime you drive down Highway 15 you can’t help from noticing the beautification of Winnsboro. That attracts people. When you attract people in Winnsboro you are building up Winnsboro. You are placing Winnsboro on the map and this is what it is all about. That is a need. Anytime you can improve the economy in any given situation any place it is a need. It’s all about being attractive and attracting people.”
Juror Young said that he would like to make a statement: “I’m not sure about Gilbert but I can tell you how the Gazebo came about in Wisner. A group of ladies that was on a Community Improvement Committee got out and made up the money. They brought the money in they didn’t ask the Police Jury to build the Gazebo, they didn’t ask the Town of Wisner to build the Gazebo. They got out and got interested citizens. That came from the citizens and when the citizens do it there’s a lot more pride in it. You look at that area it is spotless. Those women make sure the place is taken care. It’s about community pride. Let the community get out and round up a little money, take care of it and make it look good, enhance the need. There’s a lot of things we can do to enhance the looks of places besides building a Gazebo. That’s my sermon and I’m sticking to it.”
Juror Scott said: “The question was not where it came from. You made a statement about the need. We can go a little further on this because I knew you were going to be against it in from the start. First of all, you look at the resources of people in different positions getting X number of hours and high paying jobs. The Lord bless those who have pity on the poor. He is going to repay you. Now there are a lot of people who are not in the position to do such.”
Juror Johnson said that the Gazebo is going to be in the Park area not at the Baseball field. It will be located in an area where events are held. The last parade we held ended at that location. Johnson said it is needed for moral boosting. Look at the overall money spent in the Districts in Franklin parish and look at the money spent in these areas. They are taxpayers also. Johnson said he feels justified in creating this.
Juror Parks asked if the money was coming out of the Recreation fund?
Juror Scott said the Black Achievers Association will furnish labor and he was volunteering his service.
John Lawrence said that he was concerned about the less fortunate people who can’t afford to contribute money in that area. He said that Westside Park is in a poor Black neighborhood and he thought this should be taken under consideration. Lawrence said that we need to understand that everybody is not as fortunate as some of us. He can’t understand why a Gazebo should be a big hill to climb. These people we are talking about are living in subsidized housing and are on fixed incomes, they can’t afford it. He said that we ought to be more sensitive to the people who can’t help themselves. We want to see our Parks attractive. He said that he didn’t live in the City of Winnsboro but he pays taxes there. He also said we want to see our parks attractive like the one over by Progressive Bank and the one on Highway 15. Lawrence said he thinks it is only fair that our Parks are as attractive as those Parks and we shouldn’t be selfish to say that is not necessary.
Motion by Johnson and seconded by Scott that $800.00 be taken from Recreation Fund with $400.00 from Juror Scott Park fund and $400.00 from Juror Johnson’s fund. All voted yes except Young who voted no.
Juror Scott had some concerns about items on the agenda. He cited some items were taken off a special meeting agenda. Juror Young said when you schedule items on special meeting agenda, all you have to do it post it 24 hours ahead of time. When we schedule items that are not of an emergency nature, that is not fair to taxpayers of Franklin Parish because they can’t come by the Courthouse everyday and check and see if a special meeting is scheduled.
There was discussion between Juror’s Scott and Campbell about the time being set for some Special meetings. President Guimbellot said he thought they were on Spring break and scheduled the meeting for 8:00 A.M.
Joe Walters appeared before the Jury and passed out a sample resolution opposing HB 440, 442, and 453 that would result in Louisiana Department of Revenue collecting, distributing and disbursing local sales taxes.
Motion by Young and seconded by Campbell that the Franklin Parish Police Jury adopt a resolution opposing HB 440, 442, and 453 calling for the appointment of the Louisiana Department of Revenue to collect, distribute and disburse local sales taxes. Unanimously approved
Motion by Johnson and seconded by Scott to rename Ponderosa Park Nolan Norman Park. Unanimously approved
Larry discussed an increase in premium for BlueCross BlueShield Insurance. He is to meet with the Finance Committee before the next meeting to discuss the increase.
Dr. Joel Eldridge, Franklin Parish Coroner asked that the Jury give him $500.00 stipend instead of paying insurance premium. Dr. Eldridge already has insurance.
Juror Scott motion that the Jury would pay the $500.00 stipend to Dr. Eldridge instead of paying insurance. There was discussion among Jurors and the Treasurer saying that other employees might want to do the same. If was decided that this item would be tabled until later. Meet with Finance Committee to discuss situation. Juror Scott withdrew his motion.
Motion by Campbell and seconded by Parks to raise the launch fee of $2.00 to $3.00 with campers launching their boats at no charge. Unanimously approved
The Recreation Committee will meet with Rusty Roberts concerning his salary and mowing.
Larry talked about Connie Day and John Ogden Justice of the Peace. Connie was appointed to serve as Justice of Peace because of death of William Till until someone was elected. John Ogden was elected and sworn in on January 11, 2008. Connie received salary for January and February. John Ogden did not.
Motion by Parks and seconded Young that Connie Day would repay two months salary which should have gone to Ogden. Unanimously approved
John Lawrence told Jurors that Greg Humphries was the best Superintendent in the Parish. He said that Greg was very responsive to the needs of the people.
Juror Scott said that the Turkey Creek Big Bass Challenge would be changed to June 14, 2008. He suggested that a weigh station be built. He said that it would probably take 2 or 3 yards to concrete to this.
Under Public Works Committee Report: Motion by Campbell and seconded by Johnson to bring Dove Lane and Boardwalk Lane into the Parish road system. All paperwork is in order. Unanimously approved
Greg reported on work schedule for April and May. Six roads for chip seal, one road for capital improvement and FEMA projects (Abe Lincoln Subdivision) in April and May.
Motion by Campbell and seconded by Young to combine chip seal road list and capital improvement road list and vote on monthly schedule for road work. Unanimously approved
Under Personnel Committee Report: Motion by Campbell and seconded by Johnson that Joseph Bettencourt would be hired on a Work Release program at $7.00 per hour. Unanimously approved
Motion by Parks and seconded by Campbell that we would advertise for a Grader Operator. Unanimously approved
Motion by Campbell and seconded by Hendry that Percy Green would be hired as a part time Truck Driver at $9.00 per hour. Unanimously approved
Motion by Hendry and seconded by Parks that David Robinson would be hired as Seasonal Bush Hog Operator with no benefits at $8.00 per hour. Unanimously approved
Motion by Campbell and seconded by Hendry that Camden Beach would be hired as Seasonal Bush Hog Operator with no benefits at $8.00 per hour. Unanimously approved
Motion by Hendry and seconded by Parks that Daniel Whiseant would be hired as Seasonal Bush Hog Operator with no benefits at $8.00 per hour. Unanimously approved
Greg said that we are still taking quotes on mowing the Parks.
Motion by Johnson and seconded by Campbell that James Allen’s salary would increase from $9.63 to $10.43 per hour (6 months probation up). Unanimously approved
Motion by Campbell and seconded by Johnson that Violet Temple would be hired as Section 8 Administrator at $400.00 per month plus $100.00 administrative fee. Unanimously approved
Under Superintendent Report:
(a) Greg discussed adopting a resolution certifying compliance with public Bid Laws Project
Number 07-07-491E.
(b) Spoke with Governor’s office about contracting Trucks to help put out gravel. Since this isn’t in the scope of things, we will have to get permission which means we will have to write a letter and wait for approval.
(c) Discussed hauling gravel on Saturdays.
Juror Young wanted to know where L.D. Knox road is on capital improvement list.
Motion by Young and seconded by Hendry to adopt a resolution certifying compliance with Public Bid Laws Project No. 07-07-491E. Unanimously approved
Ken McManus gave an update on Raspberry Road Bridge Repair. There was one bidder Louisiana Bridge whose bid was $198,425. Ken said that about $25,000 would be left. Greg said that they would Rip Rap with the money.
Motion by Campbell and seconded by Parks to award bid to Louisiana Bridge contingent on approval from Facility Planning and Control office. Unanimously approved
Ken also gave update on Union Church Road. He said that they have been waiting on Exhibit A to come from Attorney General Office. Finally got Exhibit A. Larry said that paperwork had been faxed to Baton Rouge.
Under Treasurer Report: Larry passed out Treasurer report to Jurors.
Juror Parks said that he would like to commend Larry on doing a fine job as Treasurer. This was Larry’s first meeting since being hired last month as Treasurer.
Juror Scott had a question about whether or not the Police Jury had a website. Larry said he would check into this.
Juror Scott also mentioned to the President that when the President ask for a show of hands on a particular vote, he would like for the President to say how the vote went.
There being no further business to discuss at this time, on a motion by Campbell and seconded by Hendry the meeting was unanimously approved adjourned.

Special Session
April 25, 2008
The Franklin Parish Police Jury met in special session on this 25th day of April, 2008 in the Police Jury meeting room, Courthouse Building, Winnsboro, Louisiana with the following members present: Honorable Harvey Guimbellot, Jackie Johnson, Ray Young, Leroy Scott, Ricky Campbell, and Troy Hendry.
Juror K.W. “Buddy” Parks was absent.
Juror Scott led the group in Prayer and the Pledge.
Motion by Campbell and seconded by Young to approve the agenda.
Allen Butler talked to Jurors about the Bass, Bucks, and Ducks Tournament. On this day there will be a large number of fishermen participating in this event. Of concern to the Jurors and Mr. Butler is the number of fish that will be caught on that day. After the fish are caught, they will be taken to West Monroe for weighing. Jurors wanted to know if the fish will be let out in the Ouachita River or brought back to Turkey Creek. Allen Butler said Sam Haring is going to furnish a truck to take the fish to West Monroe and bring them back to and release them into Turkey Creek for $500.00. There was discussion between Jurors and Allen Butler.
Motion by Campbell and seconded by Young that the Franklin Parish Police Jury will pay $500.00 to Sam Haring to take fish to West Monroe for weighing and bring fish back and release them in Turkey Creek. Unanimously approved
Juror Scott said for the record: “let this be a trial. Be careful spending tax payer’s money. Wait and see if this is worth the effort.”
Juror Scott also said that a letter of thanks be sent to Sam Haring for his help.
Juror Scott introduced Mrs. Tammie Lynch and others to the Jury. These ladies went to Turkey Creek to fish and were not allowed to fish from the bank or the pier by Rusty Roberts Park Supervisor. President Guimbellot apologized to the ladies and told them that fishing from the bank and pier is allowed.
Juror Johnson said that Rusty should be reprimanded for his actions.
There was discussion among Juror on a sewer waiver for John Wiggins on Dobber Glass Road. Juror Johnson said that we had passed a law saying that you can’t do it. Juror Johnson also said that we are being selective as to who can discharge sewage in parish ditches. Juror Young said that every rule should have an exception. President said that we can get a waiver from the Parish Sanitarian
Motion by Campbell and seconded by Young to approve a sewer waiver for John Wiggins on Dobber Glass Road. Yeas: Guimbellot, Young, Campbell, and Hendry. Nays: Johnson
Juror Scott was not in the meeting at that time.
Greg spoke to the Jurors and told them one Bush Hog Operator had tested positive on drug test and the other Bush Hog Operator got a job off shore. He wanted to know what they wanted to do re-advertise or hire from the applications left. There was discussion as to whether this was an emergency. Juror Johnson said he thought they should re-advertise. One of the applicants was a brother to an employee and the other was the nephew of one of the employees
Motion by Young and seconded by Campbell that the two (2) applicants left Delmus McMurray, Jr. and Wayne Robinson would be hired as Bush Hog Operator’s at $8.00 per hour seasonal with no benefits. Yeas: Guimbellot, Young, Campbell, and Hendry. Nays: Johnson
Juror Scott was not in the meeting at that time.
There being no further business to discuss, on a Motion by Campbell and seconded by Young the meeting was unanimously approved adjourned.

If you would like to become a member of the council, please stop by our office at 714 Adams Street, Winnsboro, to complete a membership card. A card must be on file at the Council’s office no later than June 2, 2008. You must be a parish resident and be interested in assisting elderly resident in Franklin Parish. The next annual meeting is to be held Monday, June 16, 2008.
