VILLAGE OF BASKIN
REGULAR COUNCIL MEETING
AUGUST 14, 2007

The Mayor and Council of the Village of Baskin met in regular session on Tuesday, August 14, 2007 at 5:00 p.m. at the Village of Baskin Town Hall.
Present; Mayor Billy Joe Cupp, Council members Larry LaBorde, Theo Martin, and Terry Humphreys.
Also present: Town Clerk and guests.
There being a quorum the meeting was called to order.
The pledge of allegiance and prayer were led by Mayor Joe Cupp.
The Town Clerk read minutes from the previous meeting.
OLD BUSINESS:
Mayor Billy Joe Cupp reported that the park bathroom is nearing completion. Larry LaBorde questioned the possibly of constructing Village of Baskin signs at North and South entrances to town.
NEW BUSINESS:
The cash flow report was provided for the month of August.
Mayor Cupp asked permission to pay all bills.
Guest Ray Moore discussed the LCDBG Block Grant Program.
Mayor Cupp introduced Ordinance for Manufactured Home Park.
Larry LaBorde made motion. Theo Martin seconded. 3 yeas. 0 Nays. 0 absent.
Mayor Cupp recommended Sonny Stephens to serve as Court Magistrate effective September 7, 2007.

Assistant Chief Donald Moore informed the Council why the Police Department requests the new Dell Computer, Computer Desk, and printer.

POLICE REPORT:
Chief Tommy Hendry reported having trouble with cats at a local trailer park inside the city limits.
FIRE DEPARTMENT:
Larry LaBorde reported that the Fire Department had been having their monthly meetings and watching videos. Keyless entry for Fire Station is waiting for parts.
With no further business Mayor Billy Joe Cupp thanked everyone for doing a great job.

VILLAGE OF BASKIN
MANUFACTURED HOME PARK ORDINANCE
ORDINANCE NO. 08-07
AN ORDINANCE TO REGULATE AND GUIDE THE ESTABLISHMENT OF MANUFACTURED HOME PARKS TO PROMOTE THE PUBLIC HEALTH, SAFETY AND GENERAL WELFARE OF THE CITIZENS OF THE VILLAGE OF BASKIN.
Purpose
This Ordinance is designed to accomplish the following specific objectives:
(a) To further the orderly layout of manufactured home parks; (b) to secure safety for the citizens; (c) to provide adequate light and air; and (d) to ensure that facilities for transportation, parking and recreation are provided for manufactured home park residents. These regulations shall govern the establishment of each and every new manufactured home park and the alteration or expansion of existing manufactured home parks lying within the jurisdiction of the Village of Baskin.
Definitions:
Mobile/Manufactured Home Park: any plot within the limits of the Municipality on which two (2) or more mobile/manufactured homes, located on individual lots, each occupied for dwelling or sleeping purposes, are made for such accommodations.
Mobile Home/Manufactured Home: a manufactured unit that is not constructed with uniform residential building code for one and two family dwellings; is composed of one or more components each of which was substantially assembled in a manufacturing plant and designed to be transported to the home site on its own chassis; and exceeds forty feet in length and eight feet in width. The unit is designed to be used as a dwelling and provides complete, independent living facilities for one (1) family, including permanent provisions for living, sleeping, eating, cooking, and sanitation. Travel trailers and campers shall not be considered manufactured homes.
Approval Required
No manufactured home park within the jurisdiction of the Village of Baskin shall be established, altered or expanded until approval has been granted by the Franklin Parish Police Jury, authorizing such construction.
Streets and Parking
(1) Convenient access to each manufactured home space shall be provided by streets or drives with a minimum right-of-way of fifty (50) feet, of which twenty (20) feet shall be graded, drained and all-weather surfaced, for automobile circulation within the park. Maintenance of such streets shall be provided by the owner or operator of the park.
(2) A minimum of two (2) automobile parking spaces, all weather surfaced, shall be provided on or adjacent to each manufactured home space but shall not be located within any public right-of-way or within any street in the park.
(3) In manufactured home parks where the spaces are less than ten thousand (10,000) square feet, guest automobile parking shall be provided at the rate of one (1) parking space for each two (2) manufactured home spaces.
(4) All manufactured homes spaces within a manufactured home park shall be serially numbered for mailing address purposes. These numbers shall be displayed either on each lot space or on the manufactured home unit.
(5) Where more than five (5) rural mailboxes are used for mail delivery, the approval of the local Post Office Department and the District Highway Engineer may be required.
Manufactured Home Space
(1) Each manufactured home space shall be clearly defined by means of concrete or iron pipe markers placed at all corners.
(2) Each manufactured home shall be located at least twenty (20) feet from any other manufactured home, at least twenty (20) feet from any building within the manufactured home park, at least twenty (20) feet from any property line, and at least fifteen (15) feet from the edge of the right-of-way of any interior street and thirty (30) feet from the edge of the right-of-way of any publicly-maintained street or road.
(3) Each manufactured home park shall provide and maintain four hundred (400) square feet of recreation area for each manufactured home space that is less than ten thousand (10,000) square feet. No recreation area shall be less than twenty-five hundred (2,500) square feet.
General Provisions
Exterior, Appearance, Criteria
(1) All exterior walls and siding shall be in good condition and without holes, dents peeling or flaking paint and of a uniform color.
(2) All windows and doors shall be free of signs of deterioration or missing panes and shall be lockable from inside with a form of mechanical fastener.
(3) All roofing and gutters shall be free from defects such as buckling or sagging, holes or other defects that would result in air or water infiltration.
(4) All undersides of mobile home shall be in good condition and insulation will be secured in place by manufactured fabric as per mobile home industry or hardware cloth secured neatly.
(5) All mobile homes shall have manufactured skirting in place before electrical service will be turned on . All skirting shall meet one (1) of the following requirements.
(a.) Manufactured skirting or
(b.) Decorative metal, vinyl or plastic skirting or
(c.) Vinyl or plastic lattice work skirting or
(d.) Brick, mortar or other stone structure skirting.
(e.) Exclusion- Skirting made of wood products (including wood lattice work is excluded.)
(6) Mobile home must be tied down and staked.
Utility Requirements:
(1) An accessible, adequate, safe and palatable supply of water shall be provided in each manufactured home park.
(2) Adequate and safe sewage disposal facilities shall be provided in all manufactured home parks as approved by the Sanitation Director.
(3) The growth of brush, weeds, and grass shall be controlled to prevent harborage of noxious insects. Buildings and structures shall be maintained free of rodent harborage and infestation.
(a.) The manufactured home park owner shall not allow a non-operable automobile to remain in a manufactured home park for a period longer than sixty (60) days.
Registration of Occupants
Every manufactured home park owner or operator shall maintain an accurate register containing a record of owners of manufactured home in the park. The register shall contain the following information:
(a) Name of owner
(b) Manufactured home space number
(c) Make, model and registration number of manufactured home.
(d) Date when occupancy within the manufactured home park begins and date when occupancy within the manufactured home ceases.
Inspection
(1) The manufactured home park owner shall operate the manufactured home park in compliance with this ordinance and shall provide adequate supervision to maintain the park, its facilities and equipment in good repair and in a clean and sanitary condition. The manufactured home park owner shall notify park occupants of all applicable provisions of the Ordinance and inform them of their duties and responsibilities under this Ordinance.
ADMINISTRATION
Existing Manufactured Home Park
Manufactured home parks existing at the time of the adoption of this Ordinance with spaces completed and ready for occupancy shall be allowed to continue to operate. Manufactured home parks existing at the time of the adoption of this Ordinance shall not be allowed to expand or increase in any manner unless such expansion meets fully the requirements set forth in this Ordinance.
Penalty
Any person violating the provisions of this Ordinance shall be guilty of a misdemeanor and shall be subject to a fine of not more than fifty dollars (50.00) or imprisonment of not more than thirty (30) days. Each day that the violation continues to exist shall be considered a separate and distinct offense.
Separability
Should any section or provision of these regulations be held void or invalid by the Courts for any reason, it shall not affect the validity of any other section or provision hereof which is not itself held void and invalid.
Whenever the provisions of any other law, ordinance, or regulation impose higher standards that are required by the provisions of this Ordinance, the provisions of such law, ordinance, or regulations shall govern.
BE IT THEREFORE ORDAINED, That any ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. After being introduced in a Public Hearing and published in the local journal this ordinance is hereby adopted on this 14th day of August 2007, and becoming effective upon adoption. (3)(a) The legislature shall provide by law for the payment by the state of supplements to the salaries of full-time local law enforcement and fire protection officers of the state. No law shall reduce any payments by the state provided as a supplement to the salaries of full-time local law enforcement and fire protection officers of the state. Beginning with the fiscal year which begins July 1, 2003, the legislature shall appropriate funds sufficient to fully fund the cost of such state supplement to the salaries of full-time law enforcement and fire protection officers.

(c) Full funding as required in Subsubparagraph (a) of this Subparagraph shall be equal to the amount which is required to meet the requirements of law as such requirements are in effect on July 1, 2001.

Proposing to amend Article X, Section 10(A)(1) of
the Constitution of Louisiana, relative to state and city civil service commission rules; to authorize supplemental pay for certain sworn, commissioned, law enforcement officers and fire protection officers
employed on a full-time basis by a police agency of the state or its political subdivisions and a port authority from any available funds; and to specify an election for submission of the proposition to electors and provide a ballot proposition.
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members elected to each house concurring, that there shall be submitted to the electors of the state, for their approval or rejection in the manner provided by law, a proposal to amend Article X,
Section 10(A)(1) of the Constitution of Louisiana, to read as follows:
ß10. Rules; Investigations; Wages and Hours
Section 10.(A) Rules. (1) Powers. (a) Each commission is vested with broad and general rulemaking and subpoena powers for the administration and regulation of the classified service, including the power to adopt rules for regulating employment, promotion, demotion, suspension, reduction in pay, removal, certification, qualifications, political activities, employment conditions, compensation and disbursements to employees, and other personnel matters and transactions; to adopt a uniform pay and classification plan; to require an appointing authority to institute an employee training and safety program; and generally to accomplish the objectives and purposes of the merit system of civil service as herein established. It may make recommendations with respect to employee training and safety.
(b) Nothing herein shall prevent the legislature from supplementing the uniform pay plans for sworn, commissioned law enforcement officers employed by a bona fide police agency of the state or its political subdivisions and for fire protection officers employed by a port authority, from any available funds of the state, the department, the agency, or the political subdivision, provided that such supplement may be made available only for those sworn, commissioned law enforcement officers employed on a full-time basis who serve the welfare of the public in the capacity of a police officer by providing police services to the general public, by effecting arrests, issuing citations, and serving warrants while patrolling waterways and riverfront areas and for those fire protection officers employed on a full-time basis who provide fire protection services to a port authority.

Section 2. Be it further resolved that this proposed amendment shall be submitted to the electors of the state of Louisiana at the statewide election to be held on October 20, 2007.
Section 3. Be it further resolved that on the official ballot to be used at said election there shall be printed a proposition, upon which the electors of the state shall be permitted to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall read as follows:

(5)(a) All assets, proceeds, or income of the state and statewide public retirement systems, and all contributions and payments made to the system to provide for retirement and related benefits shall be held, invested as authorized by law, or disbursed as in trust for the exclusive purpose of providing such benefits, refunds, and administrative expenses under the management of the boards of trustees and shall not be encumbered for or diverted to any other purpose. The accrued benefits of members of any state or statewide public retirement system shall not be diminished or impaired.
(b) Future benefit provisions for members of the state and statewide public retirement systems shall only be altered only by legislative enactment; however, no
such benefit provision for any member of a state retirement system having an actuarial cost shall be approved by the legislature unless a funding source
providing new or additional funds sufficient to pay all such actuarial cost within ten years of the effective date of the benefit provision is identified in such enactment. This Subsubparagraph shall be implemented as provided by law.

Section 3. Be it further resolved that on the official ballot to be used at said election there shall be printed a proposition, upon which the electors of the state shall be permitted to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall read as follows:
To provide that no benefit provision for members of any state retirement system having an actuarial cost shall be approved by the legislature unless a funding source providing new or additional funds sufficient to pay all such actuarial cost within ten years of the effective date of the benefit provision is identified in such enactment. (Amends Article X, Section 29(E)(5))

A JOINT RESOLUTION
Proposing to amend Article VII, Section 21(C)(19) of
the Constitution of Louisiana, relative to ad valorem property tax exemptions; to provide an exemption for certain jewelry; to provide for submission of the proposed amendment to the electors; to provide for an effective date; and to provide for related matters.
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members elected to each house concurring, that there shall be submitted to the electors of the state of Louisiana, for their approval or rejection in the manner provided by law, a proposal to amend Article VII, Section 21(C)(19) of the Constitution of Louisiana, to read as follows:
ß21. Other Property Exemptions
Section 21. In addition to the homestead exemption provided for in Section 20 of this Article, the following property and no other shall be exempt from ad valorem taxation:

(19) All artwork including sculptures, glass works, paintings, drawings, signed and numbered posters, photographs, mixed media, collages, jewelry, or any other item which would be considered as the material result of a creative endeavor which is listed as a consignment article by an art or jewelry dealer.

Section 2. Be it further resolved that this proposed amendment shall be submitted to the electors of the state of Louisiana at the statewide election to be held on October 20, 2007, to become effective January 1, 2008.
