WHEREAS, the resignation has created a vacancy in the Village of Baskin and the unexpired term of office in which the said vacancy exists will end on December 31, 2010 and exceeds one year. NOW THEREFORE, the Village of Baskin does hereby issue this Proclamation pursuant to LSA-R.S. 18:692(E)(2) ordering a special election to fill the said vacancy in the Village of Baskin for the remainder of the unexpired term as follows: (1) The Special Primary Election shall be held on Saturday, October 20, 2007; and (2) The Special General Election shall be held on Saturday, November 17, 2007. The dates for qualifying for the candidates in the Special Election shall be September 4th, 5th, and 6th, 2007. Present: Mayor Billy Joe Cupp, and Council members Theo Martin, Larry LaBorde, and Terry Humphreys. Also present: Town Clerk and guests. There being a quorum the meeting was called to order. Pledge of Allegiance and prayer were led by Mayor Billy Joe Cupp. The Town Clerk read minutes from the previous meeting. Motion was made by Theo Martin to accept minutes as read. Larry LaBorde seconded. 3 yeas. 0 nays. Minutes accepted. OLD BUSINESS: Adopt ordinance declaring speed limit change on Dobber Glass Rd. from 25 m.p.h. to 15 m.p.h. Motion made by Theo Martin. Larry LaBorde seconded. 3 yeas. 0 nays. Ordinance adopted. Mayor Billy Joe Cupp announced that the dog kennel is almost complete. Chief Tommy Hendry reported that the signs for Dobber Glass Rd. have been ordered. Alderman Larry LaBorde asked about the Welcome signs to put at the edge of town. Mayor Billy Joe Cupp announced that he would get some figures and check into the project. NEW BUSINESS: The cash flow report was provided for the month of June. Mayor Billy Joe Cupp asked permission to pay all bills. Motion was made by Theo Martin to accept the cash flow report and pay all bills. Terry Humphreys was introduced as the new Alderman replacing Billy Joe Cupp. Mayor Billy Joe Cupp read the resolution for the Village of Baskin Debit Card. Motion made by Larry LaBorde. Theo Martin seconded. 3 yeas. 0 nays. Resolution passed. POLICE REPORT: Chief Hendry reported that everything in his department was running smoothly. FIRE DEPT. REPORT: Larry LaBorde reported that on Saturday, June 30, 2007 the hydrants were tested. There was one hydrant on Seymour Rd. that did not work correctly due to the water being cut off. Chief Fife will contact North Franklin Water Works to correct this situation. Larry LaBorde also announced that the hoses will be tested this month. FURTHER BUSINESS: Mayor Billy Joe Cupp announced that the position of mayor pro-tem is vacant. This position will be addressed at the next Council Meeting. FURTHER RESOLVED THAT, Billy Joe Cupp is authorized to sign the Progressive Bank MasterMoney Business Debit Credit Card Application on behalf of the Business binding the Business to the Progressive Bank Agreement; is authorized to change the accounts designated in the application; and is authorized to designate the users to whom a Progressive Bank MasterMoney Business Debit Card be issued under the Agreement and the accounts of the Business to which each user shall have access. BE IT ORDAINED, By the Board of Alderman of the Village of Baskin that, the speed limit on Dobber Glass Road is twenty-five miles per hour. BE IT FURTHER ORDAINED THAT, There are families with children who reside on Dobber Glass Road and are at potential risk by those exceeding the speed limit. WHEREAS, The residents feel a need to lower the speed limit to fifteen miles per hour for the safety and well being of their children. THEREFORE, BE IT RESOLVED THAT, The speed limit be lowered to fifteen miles per hour and that Officers will cite anyone exceeding twenty-five miles per hour on Dobber Glass Road. BE IT FURTHER RESOLVED THAT, This ordinance be introduced at the regular Council meeting on the 12th day of June, 2007, and after being published in the local journal will be set forth for adoption at the Council Meeting on the 10th day of July, 2007 at 5:00 p.m. in the Baskin Town Hall. WHEREAS, in strict compliance with the provisions of Part I, Chapter 7, Title 40 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority supplemental thereto, the Franklin Parish Police Jury, State of Louisiana (the “Police Jury”) adopted a resolution on June 14, 2007, giving notice of its intention to amend and change the boundaries of Fire Protection District No. 3 of the Parish of Franklin, State of Louisiana (the “District”), to exclude the Village of Baskin therefrom, and ordering and directing the President of the Police Jury to give due notice of the proposed amendment and change of the boundaries of the District and providing for the hearing of any and all objections thereto; and WHEREAS, notice of intention to change or alter the boundaries of the District and of the public hearing to be held in connection therewith were duly published as required by law and as directed by said resolution of June 14, 2007; and WHEREAS, the Police Jury did at the hour and place and on the date designated in said resolution of June 14, 2007, meet in open and public session for the purpose of hearing any and all objections relative to the proposed change or alteration of the boundaries of the District; and WHEREAS, no objections were filed or presented to this Police Jury in writing and no other objections were expressed, and the Police Jury is of the opinion that the proposed amendment and change of the said boundaries is to the best interest of the District and its inhabitants; and WHEREAS, the District has not entered into any contracts which will be impaired by changing or altering the boundaries of the District; NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Franklin, State of Louisiana, acting as the governing authority of the Parish of Franklin, State of Louisiana, that: SECTION 1. In compliance with the provisions of Part I, Chapter 7, Title 40 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority, the boundaries of Fire Protection District No. 3 of the Parish of Franklin, State of Louisiana (the “District”), previously created by a resolution adopted by this Police Jury on May 9, 1996 (the “Police Jury”), are hereby amended and changed to exclude the Village of Baskin therefrom. SECTION 2. The District shall continue to be known as “Fire Protection District No. 3 of the Parish of Franklin, State of Louisiana,” and shall continue to constitute a public corporation and political subdivision of the State of Louisiana, and as such, shall have all the powers incidental thereto as granted by the Constitution and Statutes of the State of Louisiana, including the authority to incur debt, to issue bonds and to levy taxes and parcel fees. SECTION 3. Due notice of the amendment and change of the boundaries of the District shall be published in the official journal of the Police Jury in accordance with law, and the President of this Police Jury is hereby ordered, directed and instructed to issue the required notice and to cause the same to be published in the manner provided by law, a copy of which is attached as “Exhibit A.” SECTION 4. This resolution shall not be interpreted or construed as having any effect on the District or its governing authority other than effecting a change in the boundaries and territorial limits of the District, as hereinabove set forth. SECTION 5. This resolution shall be published in full in one (i) issue of the official journal of the Police Jury as soon as possible and shall be in full force. Absent: Nettie B. Brown. Also present: Chief Cureington and guests. There being a quorum the meeting was called to order by Mayor Cheek. The invocation was given by Bobby Blount. The pledge of Allegiance was led by Allyn Jean Luckett. Motion by Marc McCarty to accept minutes from previous month. Seconded by Bobby Blount. Motion carried. The financial reports and expenditures were provided for the month of June. After a brief discussion concerning the wireless phone bill, a motion was made by Marc McCarty to accept the financial report. Seconded by Allyn Jean Luckett. POLICE DEPT. REPORT: Chief Billy Cureington asked permission to put Officer Fred Murphy on a monthly salary. Motion by Bobby Blount to put Officer Fred Murphy on salary. Motion carried. MAINTENANCE DEPT.: Eddie Pete report that he had mowed and sprayed weed killer in the needed areas, bush hog the football field and behind the gin, put in a culvert at School and Calhoun Streets, marked where culverts were to be replaced on Kansas and Pine Streets, and had started reading water meters. ADMINISTRATION: Council received a servitude agreement between Lansing-Louisiana and the Town of Wisner for a sewer line. Motion was made by Thomas Moore to adopt the servitude agreement. Seconded by Marc McCarty. Motion carried. Council was provided with a temporary yearly budget which needed to be amended and finalized before being adopted. Bobby Blount made a motion to accept the temporary budget. Marc McCarty seconded. Motion carried. FURTHER BUSINESS: A resident appeared before the board with concerns about the rate of his water bill and was told that the water supervisor would look into what might be causing the problem. There was discussion about having a dog registration program in the Town of Wisner. With no further business motion was made by Marc McCarty to adjourn.
