Franklin Parish Police Jury
Regular Meeting/Public Hearing
April 12, 2007 - 6:00 p.m.
The Franklin Parish Police Jury met in Regular Session following a Public Hearing, Thursday April 12, 2007 in the Police Jury Meeting Room, Courthouse Building, Winnsboro, Louisiana with the following members present: Hon. Harvey Guimbellot, President, Ray Young, K. W. “Buddy” Parks, Ricky Campbell, and Troy Hendry
Jurors Jackie Johnson and Leroy Scott entered later in the meeting.
Juror Ray Young opened the meeting with a Prayer and Pledge.
Motion by Hendry and seconded by Parks to approve the agenda. Unanimously approved
Motion by Parks and seconded by Hendry to approve the minutes of March 8th, 14th, 21st, and 30th. Unanimously approved
Juror Leroy Scott entered at this time.
The meeting was now opened for Public Hearing to receive any comments or protests to the closing of original Kendricks Ferry Road and taking a new road built up to the Church into the system. Mr. Julian Kimball spoke on this saying that he had a written agreement signed by the Church for the change.
Following verbal protests and comments given from the audience as well as written protests received, the following action was taken.
Motion by Scott and seconded by Parks to obtain an Attorney General’s Opinion on the change and bring it back before the Jury. Unanimously approved
Kori Myers, LSU 4-H Agent, gave Jurors an update on the various contests and camp trips scheduled for April through July. She also mentioned that Ginger Boutwell will be conducting a Financial Education Presentation throughout the State, April 22nd through 28th.
Under visitors, Annette and Sammy Lee of Summers Road approached the Jury requesting that Summers Road be re-evaluated on the priority list and moved up. She said that the road was in such bad shape, emergency vehicles were not able to go down the road safely. Superintendent, Greg Humphries explained that they had just bladed the road, and had rock scheduled to be placed on it.
Juror Jackie Johnson entered at this time.
Motion by Campbell and seconded by Parks to appoint the following Board Members to the Tourist Commission for a three (3) year term. Unanimously approved

Motion by Young and seconded by Parks to adopt a resolution to D.E.Q. stating that the Police Jury will take the necessary actions to comply with permit requirements contained in the LA Water Discharge Permit. Unanimously approved
A discussion by Juror Campbell, other Jurors, and Treasurer was held concerning reimbursement for travel expense for Justice of the Peace and Constables.
Treasurer, Shannon Gwin said that she would like to ask that the maximum rate of hotel expense be the rate of the Host Hotel and on travel, it will be based on the same travel expense policy the Police Jury uses.
Juror Scott said that the budget would have to be amended to included travel expense.
Motion by Young and seconded by Scott to amend the budget to pay the travel expense subject to the rates at the Host Hotel being the maximum. If they spend more on a hotel that will be on them and then we will address it again at Budget time next year. Unanimously approved
Juror Scott discussed heavy trucks tearing up parish roads, saying that there had to be some way to stop this. Superintendent, Greg Humphries explained that they have good communication with the truckers and have already talked with most of them on the problem.
Juror Scott also asked the Jury for an approximate 300 foot road through Ester Credit Park. Following a brief discussion, the following action was taken.
Motion by Scott and seconded by Johnson to look into a road through the park and see if it is feasible to do it. Unanimously approved
President, Guimbellot said that he had been approached by some citizens of the parish saying that the Police Jury sold the courthouse annex and then turned around and leased it. He asked Shannon if the Jury was getting any money on this, Shannon said no. Guimbellot then asked Elrod if he make mention of this in the Franklin Sun.
Juror Scott made the following comment for the record concerning the Annex. “The people that purchased the annex, if I’m not mistaken, they are leasing it for about $2,600.00 and I’m saying why couldn’t the Jury have done the same thing, $2,600.00? You multiply, just say close to $30,000.00 a year and in less than 2 1/2 years, you got the $71,000.00 back plus you got $30,000.00 coming in every year.”
Motion by Campbell and seconded by Young to approve Treasurer, Shannon Gwin attending the Thursday, Governmental Finance Officers Association meeting in Lafayette with no overnight stay. Unanimously approved
Treasurer, Shannon Gwin explained that Rusty Roberts, overseer at Turkey Creek Park, was getting numerous calls from people wanting to know when they can start staying overnight at the Park. Juror Campbell explained that there was still work that the Jury had to do to complete their part before anyone could start staying. Jurors agreed that they needed to start looking into some rules and regulations for the park for when it is ready to open.
President Guimbellot discussed possibly taking in the two (2) breeze ways at the courthouse to provide extra space.
Motion by Campbell, and seconded by Scott to look into the cost and bring it back to the Jury. Unanimously approved
Under Personnel, a motion was made by Parks and seconded by Hendry to increase Ronnie Cassels hourly wage to $9.45 an hour due to his probationary period ending. Unanimously approved
Motion by Campbell and seconded by Hendry to approve the hiring of a part-time Receptionist at the Health Unit, Betty Ann Massey. Unanimously approved
Motion by Young and seconded by Campbell to approve a Hardship request from Adrian Wilson, 8905 Hwy 4, replacing a culvert and spreading rock. Unanimously approved
Motion by Young and seconded by Scott to approve a budget amendment to purchase Lap Tops for the Nursing Program at the Health Unit. Unanimously approved
Motion by Young and seconded by Parks to approve the purchase of new software for Fixed Assets, approximately $1,500.00, amending the budget to reflect this. Unanimously approved
Juror Scott said he would like to make the following comment for the record. “Shannon, Jenny, Johnnie, and Ms. Bobbie, I would like to commend ya’ll on your paperwork as far as the Audit concerns. They spoke very highly of you all and said we had one of the best audits if not the best. I would just like to come out vocal and make the statement. Good Job.”
President Guimbellot stated, “I would like to go on record to compliment the Office and the Staff of the Road Department for their excellent work over the past year. We have completed our annual audit and the Franklin Parish Police Jury received great reviews about the work done by the employees. We have a faithful, hard working staff and we appreciate all that they do. The General Public is not aware of what it takes day to day to run this parish. Our employees do a fine job keeping it all together. I want to thank each of them for a job well done and also I want to thank the taxpayers of the parish for giving us the funds to keep this work going.”
Superintendent, Greg Humphries, reviewed with Jurors print outs and gave an update on ongoing work being done in the parish. This included In-Kind services at Turkey Creek Park, dirt work at the boat ramp, review of 2007 chip-seal list, cost estimate to seal or patch Union Church road, calculations to chip-seal Abe Lincoln Subdivision roads, Disaster work, etc.
Under Old Business, Juror Jackie Johnson had concerns about the sewage system at Washington Subdivision. Mr. Heckard who owns the system was in the audience and explained that he has applied for grant funding for the system. He also explained that the sewage problems were not due to the system but the property owner’s connections to their homes which falls on the individuals.
There being no further business to discuss at this time, on a motion by Campbell and seconded by Hendry the meeting was unanimously approved adjourned.

Pursuant to the provisions of a resolution adopted on April 17, 2007, by the Hon. Steve E. Pylant, Sheriff of the Parish of Franklin, State of Louisiana (the “Sheriff”), and ex officio Chief Executive Officer of the Law Enforcement District of the Parish of Franklin, State of Louisiana (the “District”), NOTICE IS HEREBY GIVEN that a special election will be held in the Parish of Franklin on SATURDAY, JULY 21, 2007, and that at the said election there will be submitted to all registered voters in Franklin Parish who are qualified and entitled to vote at the said election under the Constitution and Laws of the State of Louisiana and the Constitution of the United States, the following proposition, to-wit:

STATE OF LOUISIANA
RESOLUTION
A resolution ordering and calling a special election to be held in the Law Enforcement District of the Parish of Franklin, State of Louisiana (the “District”), to authorize the levy of a sales and use tax therein, making application to the State Bond Commission in connection therewith and providing for other matters in connection therewith.
WHEREAS, Act No. 689 of the Regular Session of the Louisiana Legislature for the year 1976 (R.S. 33:9001, et. seq.) (the “Act”) created a law enforcement district in each Parish, with boundaries coterminous with the boundaries of such parish, and designated the Sheriff of the respective parish as the ex officio Chief Executive Officer thereof; and
WHEREAS, the Act provides for the methods of funding the said law enforcement districts, and authorizes the Sheriff and ex officio Chief Executive Officer of each district to call a special election to authorize the levy of a sales and use tax therein; and
WHEREAS, the Law Enforcement District of the Parish of Franklin, State of Louisiana (the “District”), has found and determined a necessity to call a special election on Saturday, July 21, 2007 for the purposes described above;
THEREFORE, I, STEVE E. PYLANT, Sheriff of the Parish of Franklin, State of Louisiana (the “Sheriff”), and ex officio Chief Executive Officer of the Law Enforcement District of the Parish of Franklin, State of Louisiana (the “District”), pursuant to the authority vested in me by the Act, resolve that:
SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Section 30 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5, Chapter 6-A and Chapter 6-B of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, a special election is hereby called and order to be held in the District on SATURDAY, JULY 21, 2007, between the hours of six o’clock (6:00) a.m., and eight o’clock (8:00) p.m., in accordance with the provisions of La. SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in the “Franklin Sun,” a weekly (Wednesday) newspaper of general circulation within the District, published in Winnsboro, Louisiana, and being the official journal of the District, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date fixed for the election, which Notice shall be substantially in the form attached hereto, as “Exhibit A” and incorporated herein by reference the same as if it were set forth herein in full.
SECTION 3. Canvass. The Sheriff, acting as the governing authority of the District, shall conduct a meeting of the District at its regular meeting place, the Sheriff’s Office, 6556 Main Street, Winnsboro, Louisiana, on THURSDAY, JULY 30, 2007, at TWO O’CLOCK (2:00) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of said special election.
SECTION 4. Polling places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.
SECTION 5. Election Commissioners: Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Thursday, July 30, 2007, as provided in Section 3 hereof. All registered voters in the District are entitled to vote at said special election and voting machines shall be used.
SECTION 6. Authorization of Officers. The Sheriff shall arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and shall further take any and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Federal Voting Rights Act of 1965, as amended.
SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines in and for the Parish of Franklin, State of Louisiana, and the Registrar of Voters in and for said Parish, as notification of the special election herein called in order that each may prepare for said election and perform their respective functions as required by law.
SECTION 8. Applicable to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the aforesaid special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the sales and use tax provided for therein, and a certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.

The polling places set forth above are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, shall be those persons designated according to law.
The said special election will be held in accordance with the applicable provisions of Chapter 5, Chapter 6-A and Chapter 6-B of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, and the officers appointed to hold the said election, as provided in this Notice of Special Election, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, will make due returns thereof to the Sheriff, and NOTICE IS HEREBY FURTHER GIVEN that the Sheriff will conduct a meeting of the District at it regular meeting place, the Sheriff’s Office, 6556 Main Street, Winnsboro, Louisiana, on THURSDAY, JULY 30, 2007, at TWO O’CLOCK (2:00) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election. VILLAGE OF GILBERT
REGULAR SESSION
THURSDAY, APRIL 12, 2007
The Village of Gilbert Mayor and Board of Aldermen met in regular session on Thursday, April 12, 2007 at 6:30 p.m., at the Gilbert City Hall.
Those present were as follows: Mayor Mike Stephens; Clerk Diane Parker; Alderman Crystal Welch, Leo Miller, and Lovie Ezell, Joann Evans, Don Beaube, Bill McLemore, Ty Britt, Jimmy Evans and citizens.
CALL TO ORDER:
Mayor Mike Stephens called the meeting to order. Leo Miller led in opening prayer. Diane Parker led in the pledge of allegiance.
MINUTES FROM LAST MONTH:
Motion made by Lovie Ezell, seconded by Crystal Welch to accept the minutes as presented. Motion carried.
FINANCIAL DOCUMENTS:
Motion made by Leo Miller, seconded by Crystal Welch to accept the financial documents as presented. Motion carried.
PAY MONTHLY BILLS:
Motion made by Crystal Welch, seconded by Lovie Ezell to pay the monthly bills. Motion carried.
WATER AND SEWER DEPARTMENT:
Don Beaube gave update on the department.
FIRE DEPARTMENT:
Bill McLemore and Brian Goodman gave update on the fire department. The fire department did assist Winnsboro Fire Department in a trailer house fire. We have a community service worker doing some work at the fire station. Bill asked that we have the street light turned off at the fire station.
POLICE DEPARTMENT:
Chief Ty Britt stated that the police department had a good month. Chief Britt asked if the town was going to keep the gray car, if so it needed some repairs. Motion made by Lovie Ezell, seconded by Crystal Welch to fix transmission repairs on the gray car and it would be used as a stand by when the new police car comes in. Mayor asked clerk to check on the insurance rates on the police cars.
OLD BUSINESS:
UPDATE ON COLLECTION OF BENCH WARRANTS:
Mayor Stephens advised the collection of bench warrants were being collected and stated with postage, the time in labor, and paper work that it had already paid off. All local law enforcement has been notified of warrants and we are receiving payments daily.
UPDATE ON POLICE CAR GRANT AND TRACTOR GRANT:
Mayor Stephens announced the grant papers have arrived on the police car. The police car has been ordered, the car should be here in the next few weeks. The clerk advised that the grant papers for the tractor were mailed and as soon as the mayor signs, send back they would notify us when to order the tractor.
BUILDING INSPECTOR:
A motion by Lovie Ezell, seconded by Leo Miller to let the town attorney prepare a cooperative endeavor agreement with Franklin Parish Police Jury and the Village of Gilbert to allow the Police Jury to handle the building permits and to use their building inspector.
NOMINATE COMMITTEE FOR STOP SIGN ON BOND AND WARD:
Mayor Stephens reminded everyone that a resolution was passed last month on putting a 4 way stop sing on corner of Bond and Ward Street, their being conflict over the stop signs, discussion was held to nominating a committee to review the area in question and report their decision to mayor. Mayor reminded committee they would be representing the safety point in view of the town.
ADVERTISE FOR DOG & CAT CATCHER:
Motion by Crystal Welch, seconded by Leo Miller to check with local dog catcher, of not interested we would advertise for a dog and cat catcher.
NEW BUSINESS:
WATER/SEWER SUPT. ANNUAL CERTIFICATION SCHOOL:
Motion by Lovie Ezell, seconded by Crystal Welch to send Don Beaube to the Louisiana Rural Water Association class in July.
FLAT RATE ON BUILDING PERMIT:
Mayor Stephens advised that this matter was tabled from last month meeting, when we get the paper work complete with the Franklin Parish Police Jury, we would disregard this.
CLEAN UP GILBERT DAY: ORDINANCE #42
Mayor Stephens asked council to allow TRASH BASH DAYS to begin on April 30 thru May 11; there will be a dumpster available those days, the dumpster will be by the city hall. No tires, appliances, no TV’s, and no industrial chemicals can be put in the dumpster. Stephens stated that several lots in town needs to be cleaned up and that letters would be going out to the owners giving 10 day notice to clean up or the town would clean up at the owner’s expense. Motion by Leo Miller, seconded by Crystal Welch to publish the trash bash days in the local paper and call about reserving the dumpster.
DISCUSS THE 36 ACRES OF LAND:
Mayor Stephens stated that the land had been disked and would be leveled. Stephens asked the aldermen to be thinking of something to do with the land.
NATIONAL DAY OF PRAYER - MAY 3, 2007.
Mayor Stephens announced that we would be having national day of prayer on May 3, 2007 at 12:00 in front of the city hall. Everyone is invited to attend.
